How Obama Is Using The Grossly Unconstitutional "No Fly List" To Push Gun Control

Tyler Durden's picture

Submitted by Mike Krieger via Liberty Blitzkrieg blog,

The faux “liberal” who holds the White House was at it once again last night. As he’s accommodated to doing, he presented a radically undemocratic and unconstitutional practice as a common sense appeal to the American public to accept gun control. What I am referring to specifically is the following passage from last night’s speech:

To begin with, Congress should act to make sure no one on a no-fly list is able to buy a gun. What could possibly be the argument for allowing a terrorist suspect to buy a semi-automatic weapon? This is a matter of national security.

Obama is not stupid. He knows exactly how shady the no fly list is, yet he’s pushing on national television as a way to enact gun control. The effectiveness of his bullshit depends on an unbelievably ignorant voter base, as well as the cultish, thoughtless devotion from what’s left of his zombified supporters.

To explain what I mean, it’s important to understand what the “no-fly” list actually is. As relates to a lawsuit it filed against the government on behalf of veterans placed on the list without notice, the ACLU notes the following:

In a motion for partial summary judgment, the ACLU asked the court to rule that the inadequate redress process for people on the list violates the Constitution’s guarantee of due process. The court partially granted that motion in August 2013, holding that the Constitution applies when the government bans Americans from air travel. In June 2014, the court struck down the government’s redress process as unconstitutional, and it ordered the government to tell the ACLU’s clients why they are on the No Fly List and give them the opportunity to challenge their inclusion on the list before the court. In October 2014, the government finally informed seven of the 13 plaintiffs that they were not on the list, and it then provided the remaining six plaintiffs with unclassified “summaries” of the reasons for their placement on the list. However, the government still keeps its full reasons secret. It also withholds evidence and exculpatory information from our clients and refuses to give them a live hearing to establish their credibility or cross-examine witnesses. Because of these and other serious problems, the ACLU has challenged the revised process as unconstitutional.

Until the government fixes its unconstitutional new process, people on the No Fly List are barred from commercial air travel with no meaningful chance to clear their names, resulting in a vast and growing group of individuals whom the government deems too dangerous to fly but too harmless to arrest.

Just in case you still aren’t aware of how egregiously the “no-fly” list flies in the face of the Bill of Rights, here’s the 5th Amendment to the U.S. Constitution:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

The “no-fly” list since inception has without question deprived American citizens of life and liberty without due process. In fact, the government made slight improvements only after being sued by the ACLU. Furthermore, were the San Bernardino shooters on the “no-fly” list? Where any of the other highly publicized mass shooters on it?

Meanwhile, as the Intercept noted last year, nearly half of the people on the U.S. government’s widely shared Terrorist Screening Database from which the no-fly list names are selected, are not connected to any known terrorist group. In addition, it noted that:

Since taking office, Obama has boosted the number of people on the no fly list more than ten-fold, to an all-time high of 47,000 - surpassing the number of people barred from flying under George W. Bush.

So should we be at all surprised that President Obama is using one egregious violation of Constitutional rights to target another?

Tsarnaev brothers and these recent people were not on the no fly list.

If they are on no fly list perhaps they shouldn't be in our country and should be exiled.

I guess no one understands that Obama is not talking to us the public, but them the elites that paid to have him sitting there. The tribe lobby and the rest of the tribe wannabes. He's talking to them, not us. We are not his peers.

let's go right to martial Crime wil drop like a rock, the police can just shoot anybody on sight. Within reason of course, they cannot shot people on their own property. That comes later. That way, people do not need guns, cars (which can be used as weapons). Knives are useless if you cannot leave your property.

future building codes will require cinder block house construction.

If we take away all rights, say phased in over 10 years, we wil hardly notice it. To help, each person gets two 50 inch TVs. and new ones each 3 years toe eep up with technology--that way, people wil be happier at home. The TV of course -cable and sat TV can be overseen by th egovernment so everyday you can see some consistent real news.

Windows wil be boarded up aso homes efficiency improves.

This kind of idea has legs--lets brainstorm for better ideas.

I was put on the "no fly" list by George Bush in 2003 when I emailed him a couple of times telling him not to go to war in Iraq. No criminal record, just a Caucasian man who saw the handwriting on the wall. For all I know I'm still on the list but stopped flying years ago when doing business become untenable. Maybe I should be exiled like "One And Only" said. The no fly list is bullshit, a place where people who don't kowtow to the state end up. I'd guess that about 75% of the posters on ZH qualify by the way based on the comments they post.

47,000 people is really nothing compared to the almost 6,000,000 felons who can not already purchase/own firearms. I think they'll try to target agitators of the state instead of actual threats, and abuse the shit out of this as they have with the no-fly list in general. If they do overstep they'll get their shit pushed in by the outrage of the right. All it will take is one story of a veteran trying to go on a honeymoon with his wife who can't fly or is denied a firearm purchase. Consider that the DHS considers White veterans, Whites who oppose gun control and immigration as being "TERRORISTS" then you can figure out what Obama is doing...

OBAMA COMING FOR GUNS IN FINAL YEAR

The NRA will fall. It’s inevitable. Just look at the demographics. The Washington Post, October 19, 2015
by Adam Winkler professor at UCLA School of Law

The fastest-growing minority group in America is Latinos. Between 2000 and 2010, the nation’s Latino population grew by 43 percent. Hispanics, which make up 17 percent of the population today, are expected to grow to 30 percent of the population in the coming decades.

Gun control is extremely popular among Hispanics, with 75 percent favoring gun safety over gun rights.

Asian Americans also represent a growing anti-gun demographic. Although only about 5 percent of the population today, the Asian American population is predicted to triple over the next few decades. A recent poll of Asian American registered voters found that 80 percent supported stricter gun laws.

Many whites — even those with no understanding of the complexities — are keenly aware that their world is changing against their will. Most whites have never visited any of the numerous New Right websites but they know that they were never asked if they wanted their cities to contain massive Mexican barrios or if they wanted Somali gangs in their small towns. They were never told that Islam is, demonstrably, not a religion of peace. They were never told that nearly 100% of interracial rape is black-on-white. No one asked them if capitalists could import foreign labor to undercut their wages. They see the crime and the filth and the disorder and they do not know how it happened. We have to be there to explain it to them when they seek answers.

1. Pass an amendment to the constitution that repeals the second amendment.

2. Individually prosecute every person on the no fly fully through the court system, have them be labeled a traitor, have their citizenship revoked and banish them from the country.

Otherwise there is no logical explanation for either the no fly list OR trying to take away their rights.

So, if the Gustapo puts you on their political list for being a political undesirable, "anti-semite", anti-government, anti-banking whatever and you can no longer fly, consequently, this affects your ability to earn an income (in this shit economy that they have destroyed) and you have decided to purchase yourself a Rosetta Stone learn Russian and then you are luckily accepted for immigration to Russia because you have skills they need and they know your government is nuts, how would you get out?

Goldman Sachs buys into Turkish Petkim’s Aegean port

http://www.hurriyetdailynews.com/goldman-sachs-buys-into-turkish-petkims...

U.S. multinational investment banking company Goldman Sachs has become a partner in Turkey’s largest integrated port, operated by petrochemicals maker Petkim, in a deal that will boost the company’s plans to develop the port to make it largest of Aegean region.

Petkim has announced that it has reached a preliminary agreement to sell its 30 percent stakes in Petkim Limanc?l?k (Petlim) for $250 million, after months of talks that started in February this year.

Petkim and Petlim are controlled by the Turkish branch of Azeri energy giant Socar. Petlim was founded to deal with the economic operation of Petkim’s port in the Alia?a district of the Aegean province of ?zmir.

“One of the world’s biggest investors becoming a partner to our port company means approval of the value and economy of our project,” Socar Turkey President Kenan Yavuz said, speaking after a ceremony to mark the signing of the deal as well as a preliminary financing agreement with Turkish lender Akbank for the port project.

“We have signed a preliminary agreement for our port investment’s project financing with one of Turkey’s largest banks Akbank. We will secure $211 million in financing with a 13 year maturity within the term-sheet,” Yavuz said.

“We’re very glad to realize the share transfer deal with a global giant such as Goldman Sachs and the project financing agreement with Akbank on the same day,” he added.

The investment, which will become Turkey’s third container port, will become operational in the last quarter of 2015, Yavuz also said.

The Petkim Container Port, which for the first time in Turkey will enable the berthing of ships with 11,000 TEUs, will possess a starting capacity of 1.5 million TEUs. A logistic field with a total of 48 hectares will be created, with 42 hectares in the port field for container storage and 6 hectares in the rear service area.

"Pipkin and a team of lawyers handled the case pro bono, spending $300,000 in court costs and racking up $3.8 million in legal fees covering some 11,000 hours of work, she said. “Why in the United States of America does it cost that much to clear a woman’s name?” she asked in a telephone interview."

With respect to denial of firearm purchases based upon a secret suspected terrorist list, you can't strip American citizens of their Constitutional rights using a secret and arbitrary list that does not require any kind of formal or legal accusation, prosecution or conviction, which you can't know you're on nor fight in court to get yourself taken off of even if you did. But most Americans are TOO FUCKING STUPID to realize the great danger in EVER allowing that.

I have a wild idea; what if we started seeing this as another "red line" he's drawing, with no credible plan to back it. Certain states are already having success with nullification of gun laws and drug laws, and Texas is fighting harder than most on the forced Syrian migration, and on gold repatriation. Wouldn't it be wild if 20+ states decided to simply not enforce gun control law?
