Cuomo, Schumer Unveil Cunning "No Guns For Dangerous Terrorists" Plan

Tyler Durden's picture

In what is possibly the most inane political statement ever, U.S. Senator Charles Schumer and Governor Andrew M. Cuomo today announced a push to prevent known or suspected terrorists from purchasing guns in New York State. Schumer and Cuomo areasking the federal government to officially add the U.S. Terror Watch List to the criteria it uses for federal background checks in New York State, exclaiming "we need to move to close the Terror Gap once and for all."

The Statement...

States – Like New York – Cannot, On Their Own, Block Sales of Guns to Those on Terror Watch List Because Watch List Is Restricted; Schumer & Cuomo's Efforts Come On Heels of Federal Failure to Close Terror Gap

U.S. Senator Charles Schumer and Governor Andrew M. Cuomo today announced a push to prevent known or suspected terrorists from purchasing guns in New York State.

Schumer and Cuomo are asking the federal government to officially add the U.S. Terror Watch List to the criteria it uses for federal background checks in New York State. This would prevent known or suspected terrorists from legally purchasing guns and would cross-check the terror watch list with a National Instant Criminal Background Check System (NICS) request, effectively closing the Terror Gap within the state and barring individuals on federal terror watch lists from legally arming themselves.

Schumer noted that the terror watch list is restricted by the federal government. Cuomo said that, if the federal government won't use the terrorist watch list in conducting background checks to restrict guns to known or suspected terrorists, Congress must develop a mechanism to grant states ‎access to the list and allow them to keep their residents safe.

Schumer and Cuomo say there is urgency to stop terror suspects from gaining legal access to weapons of war, something Congress has failed to prevent on the national level.

Senator Schumer said: We need to move to close the Terror Gap once and for all. We will continue to push again and again at the national level to put into practice this common sense provision that would do so much to protect the American public, but until we do, today’s push with Governor Cuomo will add momentum to this larger effort. Railing to close the Terror Gap in New York State will send a message to other states – and Congress – to act. The federal government has always been there for New York when it comes to giving us the tools we need to fight terrorism and I remain hopeful that they’ll work with us on preventing terror suspects from passing gun background checks. The feds should move ASAP on this request and I will fight tooth and nail to see that they meet the mark.”

Governor Cuomo said: “The fact that known or suspected terrorists continue to legally buy guns is mindboggling and we cannot allow gridlock, dysfunction and the NRA's stranglehold on Washington ‎to continue to place the safety of New Yorkers at risk. If Congress refuses to act, the federal government needs to step up and either take proactive action to right this wrong once and for all, or allow states to do so. I thank Senator Schumer for his strong and consistent leadership on this critically important issue, and am proud to fight with him to close the Terror Gap.”

In the aftermath of the terrorist attacks that struck Paris in November, Senator Schumer has led a renewed push in Congress for passage of the “Denying Firearms and Explosives to Dangerous Terrorists Act of 2015,” which would give the Department of Justice authority to prevent a known or suspected terrorist from buying firearms or explosives nationwide. Governor Cuomo has also been vocal in calling on members of Congress to stand with Senator Schumer and pass this common-sense legislation.

Sound like a no-brainer … stopping terrorists from having guns? But as Daily Beast points out, in an article called “My Fellow LIBERALS, DON’T Support Obama’s Terror Watch List Gun Ban“:

As Americans we understand well how important due process is. No one, for instance, should be thrown in jail just on the say-so of some government official who declares they deserve it. Such is the behavior of tyrants, the Founding Fathers understood, and so we enshrined in our Constitution the right to counsel, the right against being compelled to testify against oneself, the right to trial by jury, etc.All of these rights are checks to ensure the government can’t simply pluck innocent people out of their lives and strip them of their life, liberty, or property. Only after fairly testing the charges against them can the government punish people with such deprivation.

But none of these hurdles must be overcome for the government to put someone on a list, especially not a list like this, which is a watch list. It is a list of people that for whatever reason (a reason that no one outside the government knows) the government has decided deserve closer scrutiny of their actions.

Is the government right to be concerned about these people? Maybe yes, but maybe not, and there is no way for ordinary citizens to know. Which means there is also no way for ordinary citizens to know whether any of them, even people who in no way intend to commit acts of terrorism, are also on that list.

In other words, there is no way to know whether you are on that list. Nor is there any way to know how to get off it.

That there is any list at all should give us all pause. It has not historically been the hallmark of a healthy democracy when governments have kept lists of people they didn’t like. It is hard to be a government of the people, by the people, and for the people when the government keeps track of the people, including those dissidents who would challenge it (which is something that in a democracy they are allowed, and even supposed, to do).

***

What this proposal calls for is the government using the list as a basis to deny the people on it a right to which they were otherwise entitled.

***

Based on the plain text of the Second Amendment and subsequent jurisprudence it is clear that some right is in there somewhere, and what this proposal calls for is for the government to arbitrarily and un-transparently deny this right to certain people without any sort of the due process ordinarily required. And that’s a problem.

***

With this proposal we would be authorizing the government to act capriciously and unaccountably for any reason, including—and this point cannot be emphasized enough—bad reasons or no reasons at all, and against anyone, including—and this point cannot be emphasized enough, either—people just like you. There would also be no reason why, if the government could take away this right this way today, it couldn’t take away other rights you depend on having tomorrow the same way.

As we concluded previously, we've got to stop mass shootings ... but using a Kafkaesque, fatally flawed watchlist system is not the way. A top liberal Constitutional law expert explains:

Like many academics, I was happy to blissfully ignore the Second Amendment. It did not fit neatly into my socially liberal agenda.

***

It is hard to read the Second Amendment and not honestly conclude that the Framers intended gun ownership to be an individual right. It is true that the amendment begins with a reference to militias: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” Accordingly, it is argued, this amendment protects the right of the militia to bear arms, not the individual.

Yet, if true, the Second Amendment would be effectively declared a defunct provision. The National Guard is not a true militia in the sense of the Second Amendment and, since the District and others believe governments can ban guns entirely, the Second Amendment would be read out of existence.

***

More important, the mere reference to a purpose of the Second Amendment does not alter the fact that an individual right is created. The right of the people to keep and bear arms is stated in the same way as the right to free speech or free press. The statement of a purpose was intended to reaffirm the power of the states and the people against the central government. At the time, many feared the federal government and its national army. Gun ownership was viewed as a deterrent against abuse by the government, which would be less likely to mess with a well-armed populace.

Considering the Framers and their own traditions of hunting and self-defense, it is clear that they would have viewed such ownership as an individual right — consistent with the plain meaning of the amendment.

None of this is easy for someone raised to believe that the Second Amendment was the dividing line between the enlightenment and the dark ages of American culture. Yet, it is time to honestly reconsider this amendment and admit that … here’s the really hard part … the NRA may have been right. This does not mean that Charlton Heston is the new Rosa Parks or that no restrictions can be placed on gun ownership. But it does appear that gun ownership was made a protected right by the Framers and, while we might not celebrate it, it is time that we recognize it.

And liberal icons Gandhi and the Dalai Lama accept gun ownership as moral.

But would this have prevented the San Bernadino attacks? Would this have prevented any of the attacks?

And what about cell phones and propane tanks? Knives? Hammers? They going to ban those too?

The "cure" doesn't fit the disease. I'm all for keeping safe but this is kabuki, and even worse a back-door to larger gun control.. for law-abiding US citizens.

"I'm sorry, shitizen, but you have failed your NICS check. I am required to inform you that you may respond by filing ATF Form 16-138-B and DOJ Form 38-540. These forms must be filled out on paper and mailed to the respective addresses indicated, as there is currently no online process authorized. The Paperwork Reduction Act of 1995 guarantees you will receive an Acknowledgement Of Receipt within thirty (30) calendar days of postmark date. Once you receive your Acknowledgement Of Receipt, based on current resource allocations, you can expect a 6 to 9 month wait for a Preliminary Adjudication Advisement. Once this Advisement is issued, a Form 38 Background Check will be initiated; this is a thorough vetting process that typically takes from 36 to 54 months to complete. Once the Form 38 Background check has been completed and reviewed, a Final Adjudication will be delivered. Final Adjudication generates a Pass/No Pass judgment; for national security reasons, no additional elaboration can be delivered. Once the Final Adjudication is issued, there is at this time no further appeal process authorized. Have a nice day."

So even if you believe that the "terror" attacks with guns are actual terror attacks, how many dead are we talking about in a country of 300 million? A few hundred in a generation?

It's flyspeck.  Each shooting should be a one day news item, and that's all.  It should be handled just like the endless black on black shootings in Chicago.

But the media and the political class keep beating the drum on this while more important issues get ignored.

Why?

The competition is tough but Senator Charles Schumer and Governor Andrew M. Cuomo are tied for number one as the worst POS politicians in the United States.  The few times a federal prosecutor has looked at New York State officials, they are found crooked and go to jail.  Cuomo was in charge of the moveout of state offices from the World Trade Center in the 1980s as a $1 a day special assistant working for then Governor Mario Cuomo.  Those moves increased state office rental costs by at least $100 million over 5 years, money that went to grafters like Mike Lazar, a developer who was collecting office rent from a state agency while he was serving time for his involvement in the Parking Violation Bureau corruption.  Maybe Schumer should concentrate on the tons of heroin, cocaine and pot illegally being smuggled into New York by the Sinaloa cartel.  Schumer wouldn't do that, the Sinaloa cartel is connected, it owns him as well as the DEA.

Cuomo personally shut down the NY State investigations that he himslef launched that should/would have resulted in Silber and Skelos and others going to prison as soon as it started to go places that were politically problematic for Cuomo.

The Feds had to come in and take the evidence/cases to conclusion in order to extract these criminal scumbags from their fiefdoms of powermongering, expropriation and extortion.

Cuomo has not had to answer for this reversal.

IMHO, this indicates quite clearly that Cuomo ( and the traitorous Schumer ) would also be going to prison for criminal/corrupt activities if they were investigated dispassionately..

National Security

--------------------------- THERE IS NO VETTING PROCESS ---------------------------

Of course, the American know-nothing response is vetting, but there IS NO VETTING PROCESS --- yes, I know many liars and know-nothings claim there is, and one would certainly have thought after 9/11 there would be such a process, but still, none is in place.

The F-1 student visa --- severely abused by the U.S. government (they refuse to uphold any laws) --- actually invalid since they were expired --- appears at the first WTC bombing in 1993, again at on 9/11, and the Times Square bomber (he was illegally working at a hedge fund in Connecticut on an expired F-1 visa????) and the Boston Marathon terrorist attack.

So, with all those billions to the CIA, State Department, DIA, NSA, etc. --- is there a central database for tracking those visas, expired or not?

Negative, of course not as there is NO National Security in the US of A!

Could those agencies be audited to see what the hell they do with all those billions of dollars?

Well, the last person (President John F. Kennedy) who moved for a complete audit of the CIA had his brains blown out by professional assassins, and said audit dissolved into the ether, most inexplicably???

There was an audit back in 1999-2000 of the Department of Defense, and the DIA's auditing team found $2.3 trillion in unaccounted for (missing) funds --- announced officially on 9/10/01.

Then at 2:00 AM on 9/11/01 a group email was sent to that auditing team to meet in the Pentagon's west wall conference room at 9:00 AM that very morning and a few minutes past that time Flight 77 flew dead center into the Pentagon's west wall, killing or seriously injuring almost every member of the team.

Since that day, we've heard nothing official again about said DoD audit???

The head head-chopper of Saudi Arabia just came out the other day against Donald Trump.

OK, that's Saudi Arabia, the country where that jihadi match-making service arranged the marriage of the jihadi pharmacology grad from Pakistan, Malik the mass murderer, with the jihadi food safety inspector from California, Farook the mass murderer, right?

OK, and the five U.S. government agencies vetted Malik the mass murderer for a visa to enter the USA with her husband, the food safety inspector, after their arranged marriage in Saudi Arabia (did I mention she was a pharmacology grad?) --- nothing remotely interesting or red-flagging about this so far, right?????

Now 57% of the American public, assuming those polls are remotely accurate, are OK with Syrian refugees admitted to the USA, as long as they are vetted --- presumably by those five agencies which vetted mass murderer, Malik, the pharmacology grad who married the food safety inspector in Saudi Arabia?

Regardless that ISIL has captured at least three Syrian government special passport printing machines and already has been churning out false passports, there is nothing at all to be wary about or suspicious of, right???

Am I missing something here, or should specific questions be asked of all those douchetards in the FBI, CIA, DIA, State Department, etc., who appear to be too busy embezzling taxpayer funds to note the marriage of a pharmacology grad from Pakistan and a food safety inspector from California in Saudi Arabia??????

So, again, we are told Malik was vetted by no less than 5 government agencies, yet not a one found anything, and there was much to find, not the least of the situation of a pharmacology grad from Pakistan, was marrying a food safety inspector in Saudi Arabia, both of them being Sunnis, and Saudi Arabia being Jihadi Central, and its textbooks used in that country are the same exact textbooks used in schools run by ISIS!

(Like, just how many other Sunni food inspectors, public health employees are there around the country, and how many are married to Sunni jihadi pharmacology grads, etc.?????)

How about banning thermite/thermate from the CIA/Mossad?

Ex-Italian President: Intel Agencies Know 9/11 An Inside Job

Man who blew the whistle on Gladio tells Italy's largest newspaper attacks were run by CIA, Mossad

Former Italian President and the man who revealed the existence of Operation Gladio, Francesco Cossiga, has gone public on 9/11, telling Italy’s most respected newspaper that the attacks were run by the CIA and Mossad and that this was common knowledge amongst global intelligence agencies.

Cossiga was elected President of Italian Senate in July 1983 before being winning a landslide 1985 election to become President of the country in 1985.

Cossiga gained respect from opposition parties as one of a rare breed – an honest politician – and led the country for seven years until April 1992.

Paul Craig Roberts explains:

The "war on terror" is, in fact, a war to create terror

These are the same bloodthirsty war criminals who have destroyed seven countries, murdered, maimed, and displaced millions of Muslim peoples, and sent millions of refugees from the neocon wars into Europe. None of these war criminals are protected from terrorist attack. If the alleged "Muslim threat" was real, every one of the war criminals would be dead by now, not the innocent people sitting in Paris cafes or attending parties in California.

Neocons are the unhumans who created on purpose the "war against terror" in order to gain a weapon against Russia and China. You can witness these unhumans every day on talk TV and read them in the Weekly Standard, National Review, the Wall Street Journal, the New York Times, the British, German, Australian, Canadian, and endless Western newspapers.

+1 That's so weird. I hadn't watched a 9/11 documentary for years and I just came across and watched an Italian (I think - Telemaco) documentary which went into some detail about your first paragraph on thermate, the military version of thermite with barium: The Best 9/11 Documentary (Not my opinion, just how it is titled on youtube).

As for the article, what they really need to do is close the gaping "loophole" in the US State Dept, the CIA and the Pentagon that creates, funds, trains and supplies terrorist nutjobs all over the world. That allows a foreign entity, Israel foremost, to dictate domestic and foreign policies to the detriment of the American public via lobbyists and think tank groups like AIPAC and the American Enterprise Institute, the Center for Security Policy, the Foreign Policy Research Institute, the Heritage Foundation, the Hudson Institute, the Institute for Foreign Policy Analysis, Brookings Institute and the Jewish Institute for National Security Affairs. (To name but a few). It's ridiculous how ingrained and pernicious the infiltration of Washington's institutions and agencies are, by Israel.

This is an important concept that everybody should incorporate into their worldview.

Schumer has been a career politician since the early 1980's.   He's as clever and cunning as they get.   He's also just one of a long line of Trotsky-ites who would sell his mother out to the Cheka if it meant anything getting in the way of his advancement or agenda.

Gun control has absolutely nothing to do with preventing either mass shootings or terrorism or violent crime. Gun control is an Unconstitutional program to disarm the American People to further of the growth of the totalitarian police state. Gun control is one aspect of Sunni Muslim President Barrack Hussein Obama's plan to destroy the United States of America from within.

I wonder what part of "unconstitutional," "due process," and "prior restraint" do these jackasses not understand?

The no-fly list is 40% false positives according to Lindsey Graham.

Just a reminder:

“An unconstitutional act is not law; it confers no rights; it imposes no duties; affords no protection; it creates no office; it is in legal contemplation, as inoperative as though it had never been passed.” Norton v. Shelby County, 118 U.S. 425 (1886)

Maybe New York should ban cell phones as they are far more dangerous than firearms from a sheer terrorism enabling perspective.

. . . what this proposal calls for is for the government to arbitrarily and un-transparently deny this right to certain people without any sort of the due process ordinarily required.

If this kind of "law" is enacted then the government will be able to arbitrarily deny the constitutional rights of basically anyone they don't like or see as a threat, including people that post views opposing the government's actions on the internet.

With past evidence of the government classifying people like fundamental Christians, Ron Paul supporters, constitutionalists, "sovereign citizens", etc. "terrorists" I can see a point where they would be able to secretly deny the right to buy firearms to just about anyone.  This whole plan smacks of total tyranny by the government and should be opposed by the People by ANY means possible.

“kill them… arrest them… all of them”

So say quite a few who comment on this site.

Of course, it’s probably the worst thing to do – if their cause is the rights of man, that is.

On the other hand, if their cause is the imposition of tyranny, “kill them” is probably the best “correction” possible; for, it gives Judeo-Bolsheviks (JB’s) an acceptable excuse to impose martial law… and smear the cause of man.  What else should we expect from JB’s?  They have been destroying civilizations for at least 5,000 years.  For them, using slow-witted dupes is another specialty they have developed to a high art form.

In other words, he who proposes executing government-protected assassins and thieves is doing the work of Judeo-Bolsheviks.

It doesn’t matter whether he is an unwitting dupe or a conscious counter-intelligence operative – the result is always the same: an excuse for more tyranny; some call it “martial law”.

It happens repeatedly: JB’s 1) lead slow-witted and angry peasants onto streets, block traffic (that is, violate rights of non-protesters); 2) incite peasants to more violence; 3) when police begin shooting, JB’s disappear; 4) peasants take bullets (Did I say, ‘slow-witted’?); and 5) martial law, or soldiers, follow.

No, if our cause is liberty, we don’t want to execute them – and we don’t want to arrest them.

There are at least five reasons.

One: we don’t want to become like them: execution without due process.

Two: it would put them out of their misery too quickly; it is more pleasing to prolong it as long as possible.

Three: instead of “slitting their throats”, we should recover the booty they took and return it to those from whom it was wrongly taken: for example, taxes wrongly imposed or collected (one); the neglect and abuse of children compelled by such taxes (two); among many others.  There are tens of trillions floating around the world (three) in various forms – bank accounts, stocks, bonds, real property – available for recovery.

Four: it would be a pleasure to watch JB’s and their useful idiots scatter as cornered rats as we make them accountable for what they did.

Five: it would lay the foundation for an unprecedented experiment in liberty; for, none other attempted to make tyrants accountable – only to escape them.

We will be the first in this regard; for, we have resources available to us that no one else in prior ages had: a) a heavily armed population (altho greatly hobbled by medication, see this for cure,) b) instant communication, and c) lessons of prior ages to guide us.

Unfortunately, while most Americans are aware of resources a) and b), hardly any are aware of the last… or how to cure a medicated lethargy.

And without this last resource, all will be for naught, actually worse… much worse; for, how can you play the game if you don’t know the rules (law and procedures of redress)?

It all comes to one question: “Will we strive for redress… or leave the task for our children?”

Sun, 12/13/2015 - 18:00 | 6918903 Dickweed Wang
Dickweed Wang's picture

. . . . we should recover the booty they took and return it to those from whom it was wrongly taken . .

And you think "they" are just going to give their ill-gotten gains up without a fight?  Get real man!  History has shown repeatedly when a tyrannical government arises the ONLY way that things will change is for the People to rise up and resist using force of arms.  And for those that think the People wouldn't stand a chance against the government in a fight for freedom just look what people like the Vietnamese and the Iraqis were able to do against the mighty military machine of the USA.  I would say there a lot of much more capable Patriots in the USA than either of those countries.

Their proposal isn’t about terrorists. It’s another attempted gun grab. When these politicians use the “terror watch list” synonymously with terrorists it’s entirely fair to point out they’re either not really talking about terrorists, or if they are their priorities are wacked. The concerns you mention are the reasons we don’t wish to be disarmed by lying government officials.
