CISA Is Now The Law: How Congress Quietly Passed The Second Patriot Act

Update: CISA is now the law: OBAMA SIGNS SPENDING, TAX BILL THAT REPEALS OIL EXPORT BAN

Back in 2014, civil liberties and privacy advocates were up in arms when the government tried to quietly push through the Cybersecurity Information Sharing Act, or CISA, a law which would allow federal agencies - including the NSA - to share cybersecurity, and really any information with private corporations "notwithstanding any other provision of law." The most vocal complaint involved CISA’s information-sharing channel, which was ostensibly created for responding quickly to hacks and breaches, and which provided a loophole in privacy laws that enabled intelligence and law enforcement surveillance without a warrant.

Ironically, in its earlier version, CISA had drawn the opposition of tech firms including Apple, Twitter, Reddit, as well as the Business Software Alliance, the Computer and Communications Industry Association and many others including countless politicians and, most amusingly, the White House itself.

In April, a coalition of 55 civil liberties groups and security experts signed onto an open letter opposing it. In July, the Department of Homeland Security itself warned that the bill could overwhelm the agency with data of “dubious value” at the same time as it “sweep[s] away privacy protections.” Most notably, the biggest aggregator of online private content, Facebook, vehemently opposed the legislation however a month ago it was "surprisingly" revealed that Zuckerberg had been quietly on the side of the NSA all along as we reported in "Facebook Caught Secretly Lobbying For Privacy-Destroying "Cyber-Security" Bill." 

Even Snowden chimed in:

Following the blitz response, the push to pass CISA was tabled following a White House threat to veto similar legislation. Then, quietly, CISA reemerged after the same White House mysteriously flip-flopped, expressed its support for precisely the same bill in August.

And then the masks fell off, when it became obvious that not only are corporations eager to pass CISA despite their previous outcry, but that they have both the White House and Congress in their pocket.

As Wired reminds us, when the Senate passed the Cybersecurity Information Sharing Act by a vote of 74 to 21 in October, privacy advocates were again "aghast" that the key portions of the law were left intact which they said make it more amenable to surveillance than actual security, claiming that Congress has quietly stripped out "even more of its remaining privacy protections."

"They took a bad bill, and they made it worse," says Robyn Greene, policy counsel for the Open Technology Institute.

But while Congress was preparing a second assault on privacy, it needed a Trojan Horse with which to enact the proposed legislation into law without the public having the ability to reject it.

It found just that by attaching it to the Omnibus $1.1 trillion Spending Bill, which passed the House early this morning, passed the Senate moments ago and will be signed into law by the president in the coming hours. 

This is how it happened, again courtesy of Wired:

In a late-night session of Congress, House Speaker Paul Ryan announced a new version of the “omnibus” bill, a massive piece of legislation that deals with much of the federal government’s funding. It now includes a version of CISA as well. Lumping CISA in with the omnibus bill further reduces any chance for debate over its surveillance-friendly provisions, or a White House veto. And the latest version actually chips away even further at the remaining personal information protections that privacy advocates had fought for in the version of the bill that passed the Senate.

It gets: it appears that while CISA was on hiatus, US lawmakers - working under the direction of corporations adnt the NSA - were seeking to weaponize the revised legislation, and as Wired says, the latest version of the bill appended to the omnibus legislation seems to exacerbate the problem of personal information protections.

It creates the ability for the president to set up “portals” for agencies like the FBI and the Office of the Director of National Intelligence, so that companies hand information directly to law enforcement and intelligence agencies instead of to the Department of Homeland Security. And it also changes when information shared for cybersecurity reasons can be used for law enforcement investigations. The earlier bill had only allowed that backchannel use of the data for law enforcement in cases of “imminent threats,” while the new bill requires just a “specific threat,” potentially allowing the search of the data for any specific terms regardless of timeliness.

Some, like Senator Ron Wyden, spoke out out against the changes to the bill in a press statement, writing they’d worsened a bill he already opposed as a surveillance bill in the guise of cybersecurity protections.

Senator Richard Burr, who had introduced the earlier version of bill, didn’t immediately respond to a request for comment.

"Americans deserve policies that protect both their security and their liberty," he wrote. "This bill fails on both counts."

Why was the CISA included in the omnibus package, which just passed both the House and the Senate? Because any "nay" votes  - or an Obama - would also threaten the entire budget of the federal government. In other words, it was a question of either Americans keeping their privacy or halting the funding of the US government, in effect bankrupting the nation.

And best of all, the rushed bill means there will be no debate.

The bottom line as OTI's Robyn Green said, "They’ve got this bill that’s kicked around for years and had been too controversial to pass, so they’ve seen an opportunity to push it through without debate. And they’re taking that opportunity."

The punchline: "They’re kind of pulling a Patriot Act."

And when Obama signs the $1.1 trillion Spending Bill in a few hours, as he will, it will be official: the second Patriot Act will be the law, and with it what little online privacy US citizens may enjoy, will be gone.

Be serious. We need simple interpretations of history like we need a hole in the head.  Nobody of rational mind goes for the 'Jewish Identity' modle of diving forces of history any more, it is too simple.

Jews are far too diverse, just among the Jews I know there is a range from hard Likud to fluffy Progressive who loves bunnies and thinks everything is fluffy and full of love.

'Zionism', now that starts to differentiate people enough, but given the large number of Christians who were Zionist (forgotten history, go look it up), how wide the support of Israel among modern Christians, and how few thought that should be translated into a military quest for world domination by a people whose understanding of foreign policy was formed in the Warsaw Ghetto makes this grouping too broad also.  Surely Zionists of any era wouldn't propose such goals, many were above average in intelligence.

Modern inhabitants of Israel are not responsible for the things done to make Israel happen, just as we are not responsible for what was done to the Indians, etc.  I don't even think we owe compensation, giving the power to correct past wrongs to any entity is asking for trouble.

But we are all responsible for the continuing badness.  Some of those advocating and doing are Jewish, some aren't.  Likhud is too narrow, there are parties around them with overlapping goals and policies.  And no doubt some Likhuds who think the course they have set Israel on is insane, it would be cheaper to buy every non-Jew out of Greater Israel than throw them out with military force.  That turns out to be true in every war.

Anyway, we are responsible for our country's behavior, Israei citizens are responsible for theirs.

Of our citizens, we have a clearly-delineated group that are driving all this, 'the neocons'.  So 'Israeli-Neocons'.  They are the enemy we need to concern ourselves with.

Please use clear terms so we can all think.  Otherwise we suspect you are hasbara.

I have linux machines and even a ubuntu phone. I love linux but for my profession there is alot of software that runs best on Windows. I actually do like alot of things about windows. You know what they say, dont throw the baby out with the bathwater. Its best to be "omni" and comfortable on may platforms. Your ability to solve problems with creative solutions expands exponentially. Except apple, fuck that shit, I never use it and want to shoot myself when I see bouncing icons.

I was gonna post the same thing further up the thread.

Then it occured to me that it has been suggest hundreds of times over the years but some people never learn (or don't want to).

It's all good and well to crap on about loss of freedoms left right and centre yet a majority of the people complaining about it never do anything to solve it (or at least improve their own situation). Instead they stay on an OS that tracks their every move (and no people - you can *never* fully stop M$ inspecting your system if they want, let alone the NSA back door (check out the windoze source code leaks from over a decade ago). Steaming pile of shit OS it is. But hey - keep using it because switching OS's might involve a tinsy winsy bit of learning.

You don't really think it's possible to even KNOW what all the spyware is, do you?  Beyond what they admit to, there are programs that track your computer to 'recover it' if it's ever stollen.  And, since the code is all closed-source, you have no way of knowing what is embeded in the rest of it.  Uncle Sam says 'Install this' and, being an American company, they have no choice.

But it's not just Microsoft.  Apple is in the same boat. If you want your freedom, you MUST go all open-source.  At least then someone has a chance at finding out what's in the code you run.  Anything else is and the NSA owns you.

I had a good friend I grew up with who jumped company to company, he said it was the only way to get a raise, almost got him blacklisted in the IT field, Well finally now he got his dream job, he works for Microsoft as an executive, flying around the world and enjoying the high life, I have since moved countries and we kinda stopped talking, he was too busy with his life. Being a rich fuck in other words.

So after 6 or so years he found me again on Skype and started talking, I guess his money aint buying him real friends, so he says he will come visit, catch a train from Paris, blah, blah, blah.

Then he tells me he works for Microsoft, and I told him I was aware of this, I said the dreaded thing to him: " So you enjoy working for Satan inc. ? ", him being a Catholic of course, this did not go down well, his wife is very religious and she is a psychologist. 

That was about a year ago, never heard anything since.

I was at Best Buy, and could not find a single brand of computers (laptops, desktops or pads) that did not have either Apple or MS as their OS/SW.  Not one!

You now have to go to a custom-PC shop, to have one made for you, that runs some other system (e.g. Linux), it seems.

 

p.s. EVERYTHING from Windows 8 and up truly sucks, Sucks, SUCKS.  Horrible layout, and counter-intuitive!  Was this due to the influence of the Indian CEO and his cohorts at MS?

There is a fix to WIN8 and win10  (Though you are correct they suck) which will at least make them appear more like win7.

 

Called START8 or START10 from STardock Software.  Go to the MSSTore crap that comes preinstalled now and pay $5.  At least they allow you to install it multiple times if you have multiple copies running.

Not true at all.  All you have to do is go to http://www.ubuntu.com/, download a free copy of their software, and install it yourself.  It's easy.  Install it in dual-boot mode so you can use both Windows and Ubuntu while you learn the latter.

No one will save you here.  You are on your own.  If you want freedom for yourself or your children you have to act ON YOUR OWN.  Start learning a linux system NOW.  Ditch Microsoft as soon as you understand it.  Then repeat the process, transitioning to a safer Linux distribution as soon as you can.

Stingrays are old news. I have had one 3 blocks from me near my train station for just over a year now. The local police have been involved in lawsuits over their use on ordinary hard working, tax paying American citizens.   

Your cell phone is tricked into thinking its communicating with a cell tower. The stingray can get anything on your phone. Phone calls, messages, email, GPS and even nude pictures of your wife if you have them.

If it pleases the Court... If this alleged 'Peter' is 65, he would have been a Commander of a Soviet Destroyer at a tender age of 12 (2015-1962=53).  Even if the story had a 'fat-finger' typo and he is "75", he'd still be way too young to have been a Soviet Commander at age 22.  At 42, yes.  At 22, no.  So he'd have to be 95 now, if still alive.  Something stinks.

Therefore... as entertaining and fascinating this story seems, it sounds like a self-perpetuating Urban Legend.  Good yarn though.  :-)

Having lived under communism as a child and actually remembering that era (Cuban Missile Crisis, JFK assasination), I will agree 100% on the part where I don't need or want the Western MSM to shovel me their brand of Neo-Con Bullshit.  Having lived in a commie system, I recognize and can smell it from a mile off.  Most 'Merikans, alas, cannot.  I pity them that way.

I am trying to disguise Peter. Not his real name. He died of a heart attack in 2003 in his early 70's. He was an officer on that destroyer in Cuba and years later a commander of a Typhoon Class sub.  When he died he worked at the Sevmash plant.

I could say much more but I will NOT reveal his real name or any more information than what I will now say. The only thing important is the reason why he went back home.

According to Peter, the US government gave him $3 million dollars and bought him a huge home in Virginia. All of which he gave back. He said he realized he had made a mistake agreeing to work for the US navy anyway shortly after he moved here. Peter said he worked in rooms full of US Naval officers that did nothing but talk down to him,  talk down and criticize the Russian Navy and they expected him to betray Russia and to give them vital information that would harm the Russian Federation. Of which he said that he never would do, never did and never intended to do.    

He gave me an online photo album of him going back to 1961. Pictures of him young in Cuba, at Sevmash where he worked before he died, other pictures taken at sea, and even sub pics at the Northern Fleet headquarters, along with his personal family photos of wife and family. I even have pictures of his eldest child's wedding in a St. Petersburg Orthodox Church, and in the church stood Vladimir Putin and his now ex-wife.

He gave up the money, the cushy job and the big home in Virginia the US gave him to betray Russia. He was going to live like an ordinary American because his wife really liked it here. He didn't mind any of this until after 911 occurred.  

Six months after 911 and after he read the Patriot Act he left the US to go back home to Russia.   

Peter said, "I moved back to Russia because I lived through all this bullshit already and I'm not going to live through it again!" 

I personally don't care what math skills you possess, nor do I care what you think or believe. Good yarn..you can GFY...

I think you are an arrogant and argumentative jack ass. A know it all. We all know people like you. The story was not false. I  did not want to disclose any information about my friend whose wife and children now reside in the US. Instead of commenting about CISA and the Patriot Act, at the heart of my story, you felt compelled to criticize and accuse me of telling lies, or yarns as you stated. Then after you fully agitate me you end up calling me trailer trash. All I can say is I am very glad you didn't say that to my face. From this day forward I am simply going to ignore you and your know-it-all comments. Say what you will, I will no longer take the bait.
