California Law Allowing Government To Seize Legal Guns Goes Into Effect January 1st

Beginning January 1, gun regulations in California will give authorities the right to seize a person’s weapons for 21 days if a judge determines the potential for violence exists.

After a shooting rampage perpetrated by Elliot Rodger in May 2014, the bill was proposed as an “emergency restraining order” option for families concerned their loved ones may act out violent urges — if they persuade a judge that loved one’s possession of a firearm “poses an immediate and present danger of causing a personal injury to himself, herself, or another by having it in his or her custody or control.”

In other words, the “law gives us a vehicle to cause the person to surrender their weapons, to have a time out, if you will,” Los Angeles Police Department Assistant Chief Michael Moore told a local NPR affiliate.

You read that right - a government-imposed time out. Now go sit in the corner, and think about what you did.

“It’s a short duration and it allows for due process,” Moore continued. “It’s an opportunity for mental health professionals to provide an analysis of a person’s mental state.” Because, as everyone knows, mental health professionals - like police - are infallible.

Rodger was 22-years-old when he launched a series of attacks around Isla Vista near the campus of University of California, Santa Barbara that left six people dead and 14 injured before he turned one of his guns on himself. All the weapons he used — three handguns and two knives — had been legally purchased. Mere minutes before carrying out his plan, Rodger uploaded a video to YouTube and circulated a 107,000-word manifesto.

How this law answers that attack on Isla Vista - with the attacker offering nothing in the way of an advance red flag about the carnage that was about to unfold - is anyone’s guess.

Even UC president, Janet Napolitano, said at the time, “This is almost the kind of event that’s impossible to prevent and almost impossible to predict.”

Seeming to ignore this major factor completely, San Diego State University professor and attorney, Dr. Wendy Patrick, told a local CBS affiliate, “[I]t’s the family members, it’s the people closest to the perpetrator who are in the best position to notice red flags.”

Second Amendment and constitutional advocates have been understandably upset by the coming law, saying further rules in a state already rife with restrictive gun laws will only serve to punish law-abiding gun owners.

“We don’t need another law to solve this problem,” asserted Sam Paredes, executive director of Gun Owners of California, to the Associated Press, as reported by the Washington Times. “We think this just misses the mark and may create a situation where law-abiding gun owners are put in jeopardy.”

What could possibly go wrong?

The target doesn't "surrender" his weapons, the order is in the form of a search warrant so the police get to search everything he owns.

The order can be renewed for a year after a hearing. Repeated forever.

They don't give a rat's ass whether you have the tools to defend yourself or your family against whatever threat. The true evil behind the CA gun-grabbers is that they expect it will be only a short time before such a law gets rolled out nationally.  Back when the rule of law more-or-less functioned, SCOTUS regularly overruled the moonbat shit coming from the 9th Circuit (CA).  Gun grabbing has the potential to set off a war here in the US.  A number of Americans will stand for the right to keep and bear arms, and for liberty.

If you allow them to get away with it then you give your consent. If they do this without a sworn statement and summons or warrant being issued they are prohibited by Law and their oaths of office. You must immediately go to the court and file a complaint against the individual that stole your property illegally. If they violated any of the rules of due process you can go after them.

You must be aware there are two systems of law at play here. One is the de jure law of the constitution and the other is statutory de facto law of the state. Unless you are a statutory state citizen at the time of theft by state actors they are forbidden by the state and national constitutions from taking that kind of action against a private person.Statutory law is only for public officials and people who contract with the state.

A Bar Attorney will not defend you on Constitutional grounds. You must do it yourself or find a Private Attorney General to help you do this. Go the same or next day to the local court in the jurisdiction your rights were taken and if no sworn statement and summons or warrant was issued, file a claim of injury against the police that did this.

Just my opinion as I am still learning. I did win in a criminal accusation against me by police who stopped me in my automobile without my consent when there was no evidence of unlawful behavior, only statutory code violation. I fumbled around quite a bit because I did not fully understand how to defeat the charges but I eventually won. I cost the court thousands in expenses. If 5% of us did that they would stop.

The American Constitution is not self activating. Government will not do it nor will the lower courts recognize the Constitutions. You must force them under their own rules which forbids what they do. Ignorance is not bliss. Turn off your TVs and learn how to protect your rights. Stop submitting to unlawful authorities.

This is just another indication that the State is worried that people will seek vengeance on the criminals in government. Whether you are talking about a bunch of kids with a leader, a family, an organization, or government the same dynamic psychology holds true. When there is resistance to control, the controllers try to stomp or contain the resistance.

There are roughly 39 million people in California.  If you're assuming in this liberal mecca that nearly every person in the state owns a gun, then I'm not the Grade A moron here.  More likely, those 30 million guns are owned by well under ten percent of the population.  That less than 10 percent should move.  The 90+ percent of people remaining would as soon piss on your ammo than give a shit about your gun rights.

I am 4th generation Californian and have noted the decline over the decades as the trash moved in and continued the takeover of our voting base and political officials.

The end of WWII it really picked up as draftees from every godforsaken area everywhere else in the US got discharged here and stayed. Their kids, raised with and incorporating their parents attitudes, flooded the school system in the 50s, the illegal aliens contributing their value & belief systems later and the rest, as is said, is history.

The good news is that we still have some elected Sheriffs who will issue CCWs without any BS. Just complete the required course and fill out the paperwork.

So yes, CA is fucked. But the major source of this is not internal. Its the shitheads from elsewhere and DC that are primarily responsible.

A signif percent of that water which Kommiefornia uses for agriculture comes from out of state.  Parts of SoCal SHOULD be desert. . .  Great for growing edibles, IF you have lots of cheap water.  

Those edibles can grow elsewhere, from Texas to Florida to SC.

I've started picking up non-Kommifornia fruit and veggies at the store.  I buy Mexican before I buy Cali.  That's how pissed off I am at those tyrants.

Since this is a legal issue, I'd reframe your point thus:

Use the trick that every trial lawyer uses -- If you can't win on Principle, then you seek to win on Procedure.  In this case... 

If they can't win on Principle (2nd Amendment), they are seeking starting with the "21 day ban".  

And just like Income Tax that started at 1%, so to the 21 day rule will keep getting extended, and the definitions of "unstable or dangerous" will be played fast and loose, to suit the master agenda of disarming ever more men.  Especially those who have the skills to form or present true Resistance to the tyranny and TPTB.
