Is There Ample Evidence To Indict Hillary? This Judge Thinks So

After the latest State Department announcement that Hillary Clinton violated government rules, Judge Andrew Napolitano definitively says there is now ample evidence to indict. Sadly, he is much less certain on whether or not the indictment will actually come.

Here is Napolitano's case as he laid it out to Bill O'reilly:

"Today is a big deal for a couple of reasons. First, it directly refutes a statement she has made dozens of times, 'it was allowed', we now know that it was not allowed. She never even asked."

 

"She signed a two page statement under oath on her first day on the job which was given after she had a two hour tutorial by two FBI agents telling her about the proper care and legal obligations for state secrets. In that oath she swore that she had the obligation to know how to care for state secrets and to recognize them."

 

"Here is what's new in the report today. Her server in her house went down a couple of times, and when it went down the blackberry wouldn't work. The state department IT people said 'here use a state department blackberry', and she said through her assistant Huma Abedin 'no because we are concerned with the Freedom of Information Act', so she went dark and she had documents verbally read to her rather than transmitted to her through the state department email system."

When Bill O'reilly was surprised to hear about the fact that Clinton was concerned about having documents subject to FOIA, Napolitano hammers home the the point that now the FBI has intent.

"Now what does this tell the FBI? This shows intent. You don't have to prove intent when you're talking about espionage, you can prove it by gross negligence, there's ample evidence of gross negligence. But avoiding the transparency laws shows a consciousness of evading the requirements."

On whether or not Napolitano believes, after all of the above, that Clinton will actually be indicted, the judge wasn't so sure.

"I believe there's ample evidence to indict her and the only way she wouldn't be is if the president or the attorney general makes a political decision."

And just as we said long ago, Napolitano also believes that one way or another, the FBI will get the evidence out to the public.

"Whether she's indicted or not I believe we'll learn what it is. I believe it'll happen before the Democratic National Convention in Philadelphia, that's two months."

Well then, based on Obama's guarantee that there will be absolutely no political influence in the decision on whether or not the DOJ decides to indict, we should expect the indictment in the coming months... right?

I think this time, there is no more political will to save her.  It's been a long time coming, but she is now toast.

All will unravel, including Clinton Foundation shenanigans. We'll see how the California Primary plays out. 

I even doubt Obama will offer a pardon.

My take on Hillary getting a solid tongue lashing from the State Department's internal investigation earlier this week:

If they knew the DOJ was likely to indict they would have kept their mouths shut.  Or at least soft-peddled it in order to keep from getting in the way or inserting themselves in the way of that process.  I think it might have been harsh because they're setting up for one of those "she's already been punished enough" cop-out excuses by the DOJ to drop the whole thing.

I still don't see her getting indicted.  Not because she isn't guilty as sin, but because laws about piddly shit like federal records just aren't going to be used against a Clinton who is the presumed D presidential nominee (especially while there is a D in the white house).

The dynamics are encouraging.

1.  The Trump Machine is emboldening some entrenched bureaucrats to rebel against the status quo.  It only takes a few well placed operatives to make a big difference. Loretta Lynch knows her time is coming. My bet is that she’s going to stall until she’s out of office. So then it’s left to Barry.

2.  The Bern is helping a lot. The left wingers throw a violent tantrum when they don’t get their way and the Progressive Establishment knows it. They trained the Free Shit Army. They have nobody else but the Bern to turn to. Are they going to make it easy for him or try to draft Biden?
Will the Free Shit Army allow it?

At some point Barry is going to pardon both Clintons. The only question I have is how much is he getting paid to do it?

IF I am wrong and she is indicted, I'm renting a bar and footing the night's tab for EVERY ZH MEMBER.  Free beer on me.  Sure, it'll cost me thousands, but at that point I won't care.  I'll be singing "Ding, dong the wicked witch is dead!" all the way to the ATM machine (before they outlaw cash).

The FBI could not give any less of a fuck about justice. Like all federal LE, it is a political weapon meant to be wielded against the little people with a vengance while the connected skate. There are a shitload of big names who would be in prison now, and a shitload of little people who would be free if the FBI were actually concerned with justice.

Shitlery will only be indicted when O'bomb-a directs Loretta Lynch to OK it. If that happens, she'll either fry for political expediency, or be pardoned on O'bomb-a's last day in office. Most likely the latter. Leftists of a feather and all that.

What's concerning is that with this making the front page news of the MSM, they are now backed into a corner and it will be quite difficult to let her slide without prosecution. But there is a way to make this whole issue less significant and that would be a huge terror attack in a major US city. That would immediately take HRC off the front page news and allow BO and LL to give Hitlery a pass with little ramification.

My guess ids that the tongue-lashing delivered by the SOS OIG was a CYA move on their part and suggests that they believe HRC22 will be indicted, because if they think she has committed wrong-doing and is about to be nailed for it, SOS OIG would look very bad for not having delivered at least the tongue-lashing.

If it even LOOKS like she will be indicted, Obama will pardon her under PRESSURE from BOTH sides of the aisle, simply because she has fucking dirt on every pedo, scammer + thief in both houses, which is basically all of DC.  30+ years she's been getting shit on EVERYONE in DC.  Think about that.  She will never go to jail.  Ever.

I agree with your premise that Obama will pardon her because of the dirt.  But Clinton is such an asshole, do you think she might refuse the pardon and instead try to fight it out?  I mean that seriously.  I think she has enough arrogance in her to feel that she could beat the rap, even if she's indicted.

Of course, on the other hand, she's also enough of a bitch that even if she does get and accepts a pardon, she might just rat out the whole snake pit, just to get even.

It's going to be very interesting in the next few months.

Perhaps if the Feds find wrongdoing (will not be too difficult) with respect to the Clinton Foundation, they can freeze the assets and perhaps their personal assets which will make paying people off in order to wriggle out of the mess nearly impossible.

Transcripts can be doctored. Family court does it all the time. The hearings are private, no witnesses and if they slip up, they doctor the transcript so you lose the appeal.

U.S. District Judge Emmet G. Sullivan (C Mills deposition, no video will be released) was appointed by Bill Clinton of course.  The cockroaches still don't want the lights on.
