Trump Threatens Flag-Burning Americans With Loss Of Citizenship Or Jail

With snowflakes everywhere across America seemingly content to burn the Stars & Stripes to protest democracy's decision to elect what they have been told is a racist, homophobic, anti-semitic, sexist, tax-fraud as president...

... President-elect Donald Trump has put his foot down in this seemingly most unpatriotic of endeavors:

Of course, there is the small issue of changing the Constitution as flag burning remains protected speech by the First Amendment.

The catalyst for Trump's 7 a.m. tweet is unclear. Fox News reported earlier this month that Hampshire College in Massachusetts would stop flying all flags on campus after an American flag was burned following Trump’s win.

"We hope this will enable us to instead focus our efforts on addressing racist, misogynistic, Islamophobic, anti-immigrant, anti-Semitic and anti-LGBTQ rhetoric and behaviors," Hampshire's president, Jonathan Lash, said in a statement at the time. 

Rep. Sean Duffy (R-Wis.) pushed back on Trump’s proposal during an early morning interview. "I don't think we want to make this a legal issue," Duffy told CNN on Tuesday.

And before the liberal media gets hold of this tweet and claims Trump's fascist tyranny is peaking through against constitutionally protected rights to do whatever a citizen wants, don't forget that none other than the Hillary Clinton herself sponsored exactly this punishment in The Flag Protection Act of 2005

The Flag Protection Act of 2005 was a proposed United States federal law introduced by Senators Hillary Clinton and Robert Bennett. The law would have outlawed flag burning, and called for a punishment of one year in jail and a fine of $100,000. According to the nonpartisan Congressional Research Service, the act was summarized as such:

Amends the federal criminal code to revise provisions regarding desecration of the flag to prohibit: (1) destroying or damaging a U.S. flag with the primary purpose and intent to incite or produce imminent violence or a breach of the peace; or (2) stealing or knowingly converting the use of a U.S. flag either belonging to the United States or on lands reserved for the United States and intentionally destroying or damaging that flag.

Early in his presidential campaign, Trump said that he supported revoking the citizenship of babies born to undocumented immigrants, but this appears to be the first time since then that he’s proposed revoking citizenship as a punishment.

If all you need to do to lose your US citizenship is to burn a flag expect millions to do it. A US passport is a burden for all who live abroad and don't want to sponsor drones & war. To forgo their citizenship Americans have to pay an "exit tax" and be sure to be audited by the IRS. The US is the only country in the world (together with some banana republic somewhere I forget) to tax its citizens living/earning abroad.

If Trump does this it would be a get-out-of-jail-free card. So he won't do it for that exact reason.

you got that right.  i only hope this is obfuscation until he is president.  this is settled law and protected speech.  we do not need more bossy government, we need less.

the shitty governments we have had, certainly under bush and obama, have used and abused the flag as a symbol of their aggression and murder.  that flag deserves burning.

rather than waste time on unconstitutional enfringements of individual liberty, when he becomes president trump, he should work on making the u.s. government something people don't want to burn down.

What about if the flag is really old and worn out and, face it, isn't even good for washing the car and needs to be thrown in the bin?  Can we burn it then? 
And don't you already have laws against starting fires in public or something?
Were the flags stolen or legally obtained?  I mean, I wouldn't like to rob a patriotic flag manufacturer / retailer of a well-deserved income.  Here, burn as many as you like, would you like a fire extinguisher with that?

But seriously, what are these flag burners actually trying to say?
"I hate my own people because the wrong crook is in power"?  (Even though he hasn't even had a chance to make even one decision yet so how could you possibly know what he is really like?)
"I hate living in a country that values my right to burn flags"?
Perhaps the burning of the flag really does imply deportation is the solution - and send them the bill.  I mean, if they truly, sincerely hate the US so much that they are willing to burn the flag then they should be willing to go.  "You don't like it here?  Burning flags is cheap.  Prove it."

Perhaps the flag burners would be better off being a little more concise with the message they are trying to convey.

I believe that other banana republic you're referring to is The Nederlands..... and people don't believe me when I tell that that in the eyes of government the people are seen as property. I think this serves to illustrate that point. You get extorted by your overlords as long as you agree to remain their property, i.e. retaining US citizenship.

As for the name, technically its their name, your parents gave them the right to turn it into a legal fiction or legal personality when they put it on a birth certificate, so they allow you to use what is in a technical and correct sense their name. In fact they are counting on it. However one can separate oneself from the legal name at any time, as names are property in law (ever owned a business, its all about the name) and if you don't own one, which you don't, then you're not responsible for it, and none can compel you to accept the name. However this means they can revoke your entitlement to use it, which means no passport and if you're fond of traveling and don't know how to sail, it could be a bit of a hindrance.

 

Have fun at passport control next time when asked by an immigration official if its your passport. Respond with a No, as it always remains the property of the issuer, generally the minister for foreign affairs of the issuing country, and on many passports it explicitly states this on the terms and conditions. A passport is never your property, you're only the holder, the name belongs to them and when one attaches oneself to the name then one attaches oneself to the state.....

Today it costs a US expat $2400 to drop his/her/its citizenship.  There is also an exit tax due to the deemed sale of all that you own at the time of your expatriation.  This would include all capital gains on all foreign property denominated in dollars.

My guess is that if Trump follows through on this threat to withdraw citizenship, thousands upon thousands of expats will suddenly appear on youtube burning the american flag.  priceless.

Then you are trapped and you can't leave without a passport, legally anyway.  Something tells me the IRS is still going to come after you from a tax standpoint, and I am sure Trump doesn't mean all taxes are forgiven, mainly exit and death taxes.  What he is saying is completely fucked up.  He shouldn't be saying stuff like this.  It makes me think he is a fucking moron.  You are protected under the bill of rights, amendment 1, to burn your own flag, period.

Incorrect. The US Constitution and Bill of Rights state the explicit powers of the US Feds. It is a document which applies specifically to the government it creates. Nowhere does it makes distinctions on who or where these rules are applicable to.

All these so called "rights" end up with nobody having any rights in the end.

I don't disagree with the jail, but you can't strip Americans of their citizenship they have no place to go.

This and other manifestations to date are like archaic theatrics, when (if ever) will President elect Trump get serious and start looking at the realities at home and abroad that are at the root of the divide and stop pandering to the superficial manifestations of the social chasms  which are only the outward symptom. Hell, he's won the election, why continue to pander to crass populism, reversing agreements and dictating internal politics in Cuba? It's high time to get "Presidential".

If what the flag once represented is going to have any relevance in the worlds future, he better stop wasting breath on these symbolic sound bites and start dealing with root of the rot.

And no, I don't see your country as divided into simplistic camps of liberals and conservatives, the problems go much deeper. It may well turn out to be a perfect storm, economic, financial, social, political, cultural, or the country can try to unite behind a leader to identify and face the real problems and deal with the surgical reforms needed to remove the many cancers that are now metastasizing, and killing it. I'm against flag burning, but I'm also against anti-flag burning laws. If I disagree with you, I'm still fairly likely to defend your right to be wrong, so long as y'all keep from harming others.
