"Fake News" Site Threatens Washington Post With Defamation Suit, Demands Retraction

Tyler Durden's picture

As the "fake news" narrative grows, and The House quietly passes a bill to "counter Russian propoganda" websites, one alleged 'fake' news wesbite - as defined by the farcical PropOrNot organization - has struck back. Naked Capitalism's Yves Smith has threatened The Washington Post with a defamation suit and demanded a retraction.

As the lawyers like to say, res ipsa loquitur. Please tweet and circulate this letter widely. You will notice that our attorney Jim Moody is a seasoned litigator who has won cases before the Supreme Court. He has considerable experience in First Amendment and defamation actions. Past high profile representations include Westomoreland v. CBS and defending Linda Tripp.

I also hope, particularly for those of you who don’t regularly visit Naked Capitalism, that you’ll check out our related pieces that give more color to how the fact the Washington Post was taken for a ride by inept propagandists, particularly our introduction to our spoof PropOrNot.org site, which uses the PropOrNot project as an example of sorely deficient propaganda and shows where it went wrong, or the humor site itself. Be sure not to miss its FAQ.

We have another post today that describes how the few things that are verifiable on the PropOrNot site don’t pan out, as in the organization is not simply a group of inept propagandists but also appears to deal solely in fabrications.

If the site is flagrantly false with respect to things that can be checked, why pray tell did the Washington Post and its fellow useful idiots in the mainstream media validate and amplify its message? Strong claims demand strong proofs, yet the Post appeared content to give a megaphone to people who make stuff up with abandon. No wonder the members of PropOrNot hide as much as they can about what they are up to; more transparency would expose their work to be a tissue of lies.

We fully endorse Yves Smith's efforts.

Additionally, we note that the only reason we haven't followed up with a similar action is because i) the allegations were beyond laughable - we have rejected all of them on the record, and ii) there are simply too much other events taking place in what should otherwise be a quiet end to the year taking place to focus on what may be a lenghty, if gratifying, legal process.

Assuming the legislation was on the books pre-election as part of Hillary's "pesky Russians" deflection (she threw shit in every fucking direction), and the outcome wasn't quite what was expected, while also factoring in  that Breitbart is listed by WaPo, and that Steve Bannon is Trump's closest advisor...

I would be suspicious if ZH isn't suing 'cos it would also help with the publicity. Besides, the readers' reputation is at stake.

They haven't "gone crazy." Their oligarchic patrons are simply losing $$$$$$ because we've wised up to their fraud and fakery.

Indeed.  And this attorney already has a Jonny Cochrane-like rep in that specialized area of the law.  But only 199 unsigned clients who, whether they join or not, will deinitely be pumping the story.

He could be our next . . . uh, well, President, maybe.

Gotta envy that guy.

And I can't wait to see the discovery motions, suppoenas, orders, documents, etc.  This will be interesting.

I'm guessing propornot will have to fold . . . like the goobermint did in N. Dakota the day before over 2000 vets showed up to deliver a public relations nightmare.

Btw, it IS a case of WP defamation against the news sites and indirectly, the readers (because we share/recommend articles to friends).

Should have been a class-action one. Let WP prove the ties to Russia one case at at time. By the time they are done, they will have no news outlet to run.

I can attest that Yves Smith is the best.  She wrote 'E-Conned' which was a bestseller in non-fiction for a while, about the corrupt and nonsensical nature of the mainstream economics profession and its ties to the financial crisis.

She and I corresponded about the horrible things done to the main bank accounts of the Presbyterian Church by Wachovia Bank and subs, stuffing it with high risk crap bonds and such. THAT was not fake.  Devastating a major US church denomination.

'Naked Capitalism' USED to be in the Zero Hedge Reads link list.  I don't know which party removed it but I suspect that Yves did, due to our rowdy, racist and nasty behavior over here.

PT's picture

Seriously, that video is shit.  The guy who made it needs to edit it and make it a lot tighter.  Four minutes before he says anything of substance in a nine minute video.  Too many pauses, umming and aaaahing.  This is all really basic video editing stuff.  Plan your words, plan your pics, bring out a simple, cohesive message and back it up with facts.  Time is money.  Not everyone has broadband.  Out of those who have broadband, many still get pre-56k speeds.  There's no prizes for a long, drawnout video.  There's a prize for cutting the crap and getting to the point.

Watch and learn.  BEST edited Youtube video EVER:

26 seconds and he's made his main point, further investigation for the rest of the two minutes.  ALL crap removed.  Viewing pleasure.
Okay, your posted video had a bigger point to make, perhaps more evidence to present.  Doesn't matter.  Cut the pauses.  Cut the crap.  Edit tighter.

Yeah, Jim.

Because fuck my 1st A rights. So long as Naked Capitalism has theirs, we should be fine, right?

I don't think so.

Use it or loose it. If Yves has bought into PC, she's only halfway enlightened. I spit out the lukewarm.

I don't know the story, I suppose I can ask her.

I've long had a certain idle curiousity about the financial dealings of the Presbyterian Church, and a particular interest in knowing who endows them.

At the outset of the Iraq War, the Presbyterian Church as a corporate entity officially took the position of supporting the war. Our local Presbyterian Church, like other mainstream denominations I have encoutered, is a strong supporter of lefist ideologies. I have tended to assume that its positions are decreed by "corporate." Hence, the local leadership of that particular church is made up of wealthier and politically powerful local people who find leftist ideologies congenial, and their membership is drawn from its supporters.

The shift in mainstream churches to embrace NWO ideologies, and fundie churches' strong embrace of the pro-Israel position, raises a lot of questions about who is funding them, who is endowing their seminaries, and what other means of control are being applied.

Socratic Dog's picture

Why is it I read your comment with a total lack of surprise?  I have no knowledge about it whatsoever, but I hear that the Zios are funding and politically redirecting all organized religion in the US, and all I think is "well yeah, they would".  This world is truly fucked up.

Of note, Islam is not an "organized" religion.  No hierarchy.  Thus difficult to hijack.  I might see that as  bit awkward, were I a Zio.  Might be looking for other ways to take them out.  Hmm.

I hear the magi gave him a bunch of Gold, along with Frankincense and Myrrh.

That gave him the freedom to pursue his philosophy.

"And when they were come into the house, they saw the young child with Mary his mother, and fell down, and worshipped him: and when they had opened their treasures, they presented unto him gifts; gold, and frankincense, and myrrh" (Matthew 2:11).

But do we know the whole story?

An ancient set of lead tablets showing the earliest portrait of Jesus Christ have proved to be around 2,000 years old, according to experts.

The metal 'pages', held together like a ring binder, were found in Jordan in around 2008 by an Israeli Bedouin and make reference to Christ and his disciples.

The lead has been analysed and the words and symbols translated and experts say the tablets date from within a few years of Jesus' ministry.

Who knows, but better to go see for ourselves like all other questionable news these days.

The Presbyterian Church is by and large a bottom-up affair, much less heirarchical than Catholic or even Lutheran.  For example, the congregation 'calls' its pastors to service and can effectively fire them, they are not simply assigned by the bishops (although the candidates are selected and offered to the congregation through the synod).  Individual churches shape the overall denomination only gradually and via fairly ridiculously drawn-out discussions, meetings, votes in many cases.  There is a lot of regionality to the political overlay, and in general I find the Midwest to be not especially political, but when pushed, kind of a 'peace n love n libertarianism' kind of flavor.  Now, there are some pretty old school, semi-older money elements, that is certainly true, like say in Indiana, and their influence is disproportionate with the 'national Church' in terms of official positions.  But to be frank, very few people actually care what 'The Presbyterian Church USA' as a corporate entity thinks about wars and things like that.  Not even the members of the church.  I believe that is how the national accounts got so fouled up in the first place, not many people were concerned and those who were were easily led, if they even bothered to follow what the investment advisors (Evergreen) were up to.

As an elder or deacon in a local congregation, you can have a lot to say about where YOUR church community is.  Ours is an extremely idiosyncratic, colorful and maverick bunch, including even some ex-Baptists and quite a few vets.  Other than loving peace and practicing charity, and affirming that God's grace is infinite, I think you'd find a wide range of thoughtful, if not always well-informed views.  But that is just my experience.  Presbyterians are a much harder church to 'herd' than others.  Also more broke :*)

I can attest to the report as well.  It was gone for a very long time.  Very long.  Like several years at least, it seems to me.

I agree and read her stuff.

Yves and Lambert are leftward oriented, and are biased at times, but they mostly make a good faith effort on the cognitive dissonance stuff once they get over the shock that it is coming from their traditional party. I troll and prod them at times Why? I would rather have political discourse with them and avoid a civil war. She has Michael Hudson listed on her site, so thats a plus. There is hope for us all through education and discussion. Diliberation.

One thing about this fake news fiasco is where it's roots lie. The lack of truth means a lack of trust which in turn damages legitimacy. In 2013, the NDAA was passed and in that unamerican bill was the repeal called "modernization" of the Smith–Mundt Act. In effect they "legalized" propaganda. A legal code does not make it lawfiul. Who sponsored it?
