Maryland Considers Teaching Kids That Boys Are Presumed Guilty In Rape Accusations

“Affirmative consent” is a fuzzy concept even for adults, which is why one of them taught 10th graders in California that they must say “yes” every 10 minutes during sex or it becomes rape.

The concept was enshrined in state law in October 2015, and since then California has remained the only state to legally require “yes means yes” be taught in public schools.

Maryland could soon be the second.

The Washington Post reports that a House of Delegates committee is considering a bill today (HB 365) that would set up a pilot program in Montgomery County, just outside Washington, D.C.

It would “provide instruction on affirmative consent as part of a specified curriculum in specified grades in public schools in the county beginning in the 2017-2018 school year.”

But that’s just the start for the sponsors, Montgomery County Democratic Dels. Ariana Kelly and Marice Morales, according to the Post:

The two lawmakers say they are drafting a companion piece of legislation that would extend the mandate statewide.


Both measures would define consent as “clear, unambiguous, knowing, informed and voluntary agreement between all participants to engage in each act within the course of sexual activity.”


Local education officials would be required to teach the concept in both seventh and 10th grades, but individual districts would be able to decide how to tailor the lessons in an age-appropriate way.

The Post report fails to note that affirmative consent essentially shifts the burden of proof onto the accused student, which in the vast majority of cases is a male being accused by a female.

It inexplicably cites the National Coalition for Men, whose president said affirmative consent is driven by “people who don’t like men that much,” as the face of the opposition.

But the consent standard has better known and less polarizing critics who cite the lack of due process inherent in affirmative consent, including the Foundation for Individual Rights in Education and the Maryland-based female-led advocacy group Stop Abusive and Violent Environments.

FIRE in particular has warned that affirmative-consent provisions do not put students on notice of what behavior can get them punished. Tracking the language of other bills and campus codes, the Maryland measure requires consent for “each act within the course of sexual activity” – which could mean anything from changing positions during intercourse to each kiss and touch preceding intercourse.

The bill also does not define “sexual activity,” a problem it shares with a college-specific bill signed into law in Connecticut last summer.

One Republican lawmaker on the committee hearing the bill, Del. Kevin B. Hornberger of Cecil County, makes a federalism argument rather than a due-process argument to keep the county-level pilot from going statewide, the Post says:

“What works best for Montgomery County doesn’t necessarily work best for Cecil or any of the other jurisdictions in this state,” Hornberger said. “The positive from this experiment is that it puts the conversation out there and raises awareness of affirmative consent.”

Hornberger was also a “peer educator” in college who taught affirmative consent. Chances are he was never accused of rape months after a sexual encounter because the consent did not consist of a continuous stream of “yes” statements.

Hmm--if they're aiming this at "kids", meaning junior high and high school (even college age), if memory serves me--and this has been a long time and I was not sexually active until college--I don't think you get a full ten minutes if you know what I mean.  You may get multiple ten minuteses, but it's more of a quantity vs quality deal until there's some experience involved.

Your comment is meant as a joke (I think), but in Europe it is the bitter reality of immigration. "Our population is shrinking!", shriek our politicians. "We need immigration to make up our numbers!" they wail. "It must be illiterate muslims, they are the only ones virile and attractive enough to replace our pale, ugly men!" they think in the dark recesses of their minds.

Their problem is that they see a momentary trend, and immediately extrapolate to a far-off future where not a single European is left alive - we all died out because we stopped making babies. So, yeah, you need to fill all that empty land with somebody, after all. Preferably while the original inhabitants are still alive so they can pay for the whole operation.

And of course they are conveniently quiet about their own role in the whole thing: forcing women out of the house and into the economy, so they simply don't have time to bear and raise children anymore...

Only partially a joke.  You're correct - Europe and the U.S. are dying becasue we are not reproducing.  The left are thrilled with that because "diversity is our strength" (they hate whitey).  Things like this law forcing the male to require the female to announce that he can continue every 10 minutes is just another way of getting males to stay away from women - or potentially go to jail.

During the trial two months ago, Duke's dean of students, Sue Wasiolek, was asked whether she would characterize a situation in which two students "got drunk to the point of incapacity, and then had sex" as their having raped each other. No, she said. Rather, "Assuming it is a male and female, it is the responsibility in the case of the male to gain consent before proceeding with sex."

Tl;Dr - the Dean of Duke stated clearly in court that males and females are not equal because the male of the species is expected to retain his faculties while incapacitated.

This is the one that always bothered me.  In so many of these cases, it's at a party where everyone is drinking and no one seems to suggest the male is sober.  Yet it doesn't ever seem to come up, and that doesn't make sense.  (Temporary insanity: if one's consent doesn't count because they're considered incapable due to their mental state, then how is someone in the same state criminally culpable for accepting consent inappropriately?)

I'm glad that Ms. Wasiolek could clear that up for me: because they're all raging misandrists.  Great.  I'll inform everyone I know with male children exactly how Duke University feels about them.

Girls have been exploiting this for decades. 25 years ago I was accused of touching a girl by a girl that was hurt by the fact I was smarter than her. I was in the 4th grade. They believed her, it became a huge deal, parents were called, police were called, then I was interrogated and they realized that not only was I not there, but I wouldn't have had the first clue where to touch a girl.

Worse yet, about a decade later I realized I was asexual. There's no way anything like that would ever happen with me, yet I was accused and boys are guilty until proven innocent when it involves a girl.

Being asexual has been an extremely liberating experience for me. I spent 3 decades chasing tail, usually quite successfully, but it did it do more than waste lots of time and money. Now I know why the great yogis and masters were asexual. I do have a female partner, but the relationship is not based on dependency. If men do not have a sex drive either way, they have achieved a great liberation. And no, the planet will do just fine without a huge population. If you are a young man, know that sex with a woman is a huge trap. If you need to do it, employ a prostitute. It's far cheaper in the long run.

the first mote of common sense in the judiciary would suggest that once an initial consent is given, the onus then falls to one who wants to disengage (male or female) to clearly signal so.

Otherwise we now have  a legal situation where anyone can maliciously construe rape in hindsight to get revenge on a previous sexual partner for completely other reasons

Many, if not most, violent rapes are not prosecuted either.  In my late 20s, I was attacked as I was walking from my parking garage to my apartment.  That creep was never arrested.  He had been ejected from two local bars for bothering women and could have been identified, but nobody ever saw him in the neighborhood again.  I was traumatized for quite a while (PTSD), although the refusal to be a victim gave me the strength to improve my life--better my education, job, etc. so even though it was a horrible thing, I grew from it.  Make lemonade from lemons so to speak.  Violent rape and so-called date rape are much different things.  Feeling violated by someone you trust might be upsetting, but comparing it to the abject fear that a stranger holds your life in his hands and you don't know if he's going to kill you when he is finished with you is a whole other story.

Just last week, on my local news there was a report about hundreds of backlogged rape kits that have not been processed and are not scheduled for processing.  This is just one jurisdiction.  Around the country there are tens of thousands of these rape kits going unprocessed, which means either nobody is looking for the rapists or they aren't going to prosecute anyone because they won't have the evidence processed.  Most likely it is because there is no known suspect and until there is, why bother to process the kit?
