Gorsuch Casts First Major Tie-Breaking Vote Allowing Arkansas Executions To Proceed

In what will undoubtedly be a memorable first major tie-breaking vote as a Supreme Court Judge, Neil Gorsuch cast the deciding vote last night to allow Arkansas to begin executing a group of 8 death-row inmates.  The decision came after attorneys for the State of Arkansas sought an expedited process to allow for the executions to proceed before their lethal-injection drugs expire at the end of April.  Per Bloomberg:

In a series of orders Thursday night, the high court cleared the state to execute Ledell Lee, one of eight convicted murderers that Arkansas has been trying to put to death before one of its lethal-injection drugs expires at the end of the month. Associated Press later reported the execution had been carried out.


“Apparently the reason the state decided to proceed with these eight executions is that the ‘use by’ date of the state’s execution drug is about to expire," Breyer wrote. "That factor, when considered as a determining factor separating those who live from those who die, is close to random."


Justices Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan also voted to block the executions.

Shortly after the 5-4 decision, the Associated Press confirmed that the execution of Ledell Lee had been carried out and he was pronounced dead at 11:56pm.  The execution was the state's first in 12 years.

Lee was the first person in a group of what had been eight men Arkansas originally planned to execute in 11 days, the most of any state in as short a period since the U.S. Supreme Court reinstated the death penalty in 1976.



For his part, Lee was convicted of brutally beating a woman to death in 1993 with a tire iron according to Reuters...

Lee was convicted and sentenced to death for beating Debra Reese to death with a tire iron in 1993. Reese's relatives were at the Cummins Unit and told media Lee deserved to die for a crime that ripped their lives apart.


Lawyers for Lee, who had spent more than 20 years on death row, had filed numerous motions in various courts ahead of the lethal injection that had put the process on hold.

What gets me is that they are drugs being used for EXECUTION. So what happens ig they 'expire'? They suddenly more of a danger to the "user"?? Not that I dissagree with the majority rulling. These guys were convited and fully affermed dirtbags. Send them to their reservation in Hell and get it over with.

Executions can be done more efficiently (and without pain) by any number of drugs as used by vets to put down animals or by hospitals as general anathsetic. Or shoot them, or gas them, or hang them, or behead them or just drive a tank over them.

I'll support the death penalty on the condition that if is discovered exculpatory evidence was suppressed by the police or the DA, said police and/or DE are immediately arrested, jailed, and (yf the execution has occurred) executed.

That's just terrible and not acceptable in a civilized progressive society.  The real solution is just to ban tire irons.  Nobody except for tire shops NEED a tire iron.  The tire iron was the cause of this crime not this low IQ, subhuman, violence prone, wonderful African-American genius.  If you disagree then you are Literally Hitler!

The other problem is mass ignorance on how the nation was set up and supposed to be run. The federal government exists for the convenience of the states, not the other way around. It only seems as it does now thanks to a certain mass murderer form about a century and a half ago, and another thief and murderer from about 80 years ago.

Have you ever had the experience of seeing for just a moment in someone's eyes what they are thinking before the mask goes up.  I had that experience at San Quentin when I was sitting and talking with a lawer that was managing the appeal for one of our inmates on death row.

While we were waiting for his client to be brought in to the hearing room I asked him why he didn't just take his client's case at the trial level Pro Bono and avoid the conviction in the first place.  No conviction, no 20 years of appeal required.

In that brief moment the message that came through was something like: "where would the money be in that?"

California pays these guys up to a million dollars a year for each year the appeal drags on.  Last I checked there were 770 people on death row--and we are on the hook for those fees.

The last execution was in 2006.  Every one that has been scheduled since has been cancelled.  If there are not going to be any executions the state should just overturn the death penalty, if for no other reason than to save over half a billion dollars.

Of course, if the taxpayers voted to save the state that kind of money--it's frightening to think of what retarded purpose they would use it for instead.

Or you could just take them out to the nearest tree right after the sentence is handed down and get the job done with a $2 rope.



Plus this system would be a much better deterent to crime than waiting 20+ years between crime and punishment.
