Resist 45: NY And CA Attorneys General Sue Trump Admin Over Energy Efficiency Standards

Tyler Durden's picture

With the Trump-Russia collusion narrative suffering a setback from Comey's testimony last week, the 'Resist 45' movement is branching out, full steam, with a series of lawsuits from Attorneys General from all over the country this week.

Yesterday we noted that the attorneys general of Maryland and the District of Columbia filed a lawsuit alleging that foreign payments to President Trump's hotels from visiting world leaders violated the emoluments clause of the U.S. constitution (see "Maryland, D.C. Attorney Generals To File Lawsuit Against Trump").

Now, a coalition of 11 AGs' from around the country, led by the supremely impartial Eric Schneiderman of New York and Xavier Becerra of California, have filed yet another lawsuit alleging that the Trump administration violated the law by obstructing the implementation of energy efficiency standards that targeted consumer and commercial appliances.

New York AG Schneiderman posted the following message to his twitter account:

Attorneys General Eric Schneiderman and Becerra File Suit Against Trump Admnistration Over Energy Efficiency Standards

Coalition Of 11 AGs Argue That Trump Administration Violated The Law By Obstructing Implementation Of Energy Efficiency Standards For Common Consumer And Commercial Appliances

Over Time, Standards Would Save Consumers And Businesses Approximately $12 Billion, Provide Energy Savings Equivalent To The Annual Electricity Consumption Of Over 19 Million Households, Eliminate Millions Of Tons Of Air Pollution

Last Month, Trump Reversed Course On Another Efficiency Standard After AGs Sued

New York Attorney General Eric Schneiderman and California Attorney General Xavier Becerra, leading a coalition of 11 Attorneys General and the City of New York, today filed a lawsuit against the Trump administration's U.S. Department of Energy (DOE) over its failure to comply with federal law by delaying energy efficiency standards for several common consumer and commercial products.

The Trump administration failed to publish in the Federal Register final energy efficiency standards for five products: portable air conditioners, uninterruptible power supplies, air compressors, walk-in coolers and freezers and commercial packaged boilers.

These standards would save consumers and businesses an estimated $11.6 billion, reduce greenhouse gas emissions by more than 159 million tons, and conserve over 242 billion kilowatt-hours of electricity — the equivalent of the annual electricity consumption of more than 19.3 million households — over a 3o-year period. The coalition filed suit in the U.S. District Court for the households — over a 3o-year period. The coalition filed suit in the U.S. District Court for the Northern District of California.

Schneiderman followed up with the following:

If at first you fail, keep calm, change your narrative and continue to 'Resist 45'.

If the standards are so great, they don't need laws to enforce them.

DocMims's picture

The climate accord was "nonbinding", but would allow the same barristers to sue to hold us to the standard that none of the other nations would actually follow.

Learn to swim...Learn to swim...Learn to swim.

But AGs allowing Sanctuary Cities and not enforcing federal immigration law is just fine?  Okay, got it.

I am absolutely puzzled how people on this broad can say anything positive about Trump who is nothing more or less than the Zioninst Banking Mafia puppet and GS specifically.

Broads are 1000% behind the Trumpet.

These laws and standards were never intended to be subjected to the scrutiny of the general public or their elected representatives.

Who wants to bet that the "savings" that these new regs are purported to save will never materialize?

It's like the low flush toilets that get flushed 2 and 3 times instead of once.

These damn energy standards do more harm than good.

Let the market determine what to shoot for, not some pencil pushing jackass in DC.

Most of these rules fuck with the products. Like the CAFE standards and car companies dropping to a lighter weight oil to shave a couple tenths off gas mileage.  Sure your car might have an engine seize because they specify 0W20 but hey, it helps non-existent warming, right?

All just a crock of shit.

Pure Evil's picture

Plus the fact that you would need to run out and replace your current appliances with these new appliances to take advantage of any energy savings, if any.

So, your not really saving anything.

And, it seems to me that the utility companies just want to jack up rates to make up for losses in revenue as you use less electricity to run your appliances.

greenskeeper carl's picture

No shit. What a load of BS. Weren't these nonsense laws just dumped on us by unelected bureaucrats anyways? Or via executive fiat? Fuck all these people.

NoDebt's picture

As I feared, they are going to make Trump into what's called a "professional defendant".  Somebody who does nothing but defend themselves against lawsuits forever.

Hell, Rosenstein, out of his own AG's office hired Comey's best friend to be the special counsel on the 'Russiagate' thing.  And the guy promptly hires people who were Dem political operatives and Clinton Foundation employees to work on the investigation.  What could be more impartial than that?

I hate to say that Trump is toast, but the Deep State wants him gone like YESTERDAY.  They'll get him eventually, even if they have to assassinate him.

pods's picture

Yep, if he won't play ball with their worldview, they will just hound him until he leaves.

Might as well burn the whole thing down Kaiser Sousa style than try and find and exterminate every single cockroach in DC.

(((They))) have more than enough time and money to hound him until he resigns.

Pure Evil's picture

I think they'll be able to live with him for four years spending all that time making an example of him to future POTUS candidates.

And, then everybody wonders why only scumbags run for political office.

totenkopf88's picture

Until Trump is assassinated just assume he is a useful idiot of the Deep State

Pure Evil's picture

Your assertion is illogical.

If he's a useful idiot of the Deep State then why would they assassinate him?

Did they assassinate their other useful idiots like Obama, Bush, Clinton?

I’m as fond of Shakespeare as you are, but please don’t.  My son and daughter in law are fine people who happen to be attorneys.  My son ripped FRS a new one for taking a man’s daughter without telling him away from her alcoholic mother and putting her in a foster home where she was raped.

Trump should do what Hussein 'the Kenyan' Obama did when sued again and again by coalition of conservative patriotic American states and just let it role of fhi sback and tie them up in court.

Let California and NYS taxpayers have fun funding frivolous lawsuits.

Pure Evil's picture

No......he should head out and grab the covfefe!

What happened? What tripped you up on that? Was it the "millions of tons" part? That kind of got me, too. That, and the millions of deaths from 16 oz sodas. Millions and millions and millions, oh my! lol

What this will do will drain State coffers of money for more important issues.

If you can no longer rule by Executive fiat, because your side is no longer in power in the Executive or Legislative branches, you proceed to rule by fiat in the Judicial branch. With full backing from the Ministry of Propaganda (MSM).

 Air compressors? rotflmao

edit  What are they going to lower the operating pressure?

VWAndy's picture

So they can make everyone buy new compressors?

VWAndy's picture

So they have plans for a compressor thats a tiny bit more effiecent but it takes a dump after the warrenty is up. So any gains are lost by the energy used up replacing the old ones that might last 50 years or more.

See the thing about compressors is they are tools. So the most important thing with almost all tools is they must last at least as long as it takes for the tool to pay for itself. The old ones did that many times over making the compressors worth having and a great investment. Its called a productive asset. A thing lawyers and bankers hate.

VWAndy's picture

 Next up PU trucks.

Sparehead's picture

They're leftist lawyers. I'm sure they wouldn't know an air compressor if I drove by and threw one at their head. Hmmm?

VWAndy's picture

I would love to see the numbers. There is no FREE LUNCH.

rejected's picture

Kind of like the window A/C. They no longer drain the water but use slingers on the fan to sling it through the condenser. This helps cool the refrigerant and increases their efficiency numbers.

So here's what happens. The water is acidic, rots out the condenser fins and in a very short time the efficiency has reduced drastically. Eventually the pressure gets so high the poor compressor gives it up and you go back to Wally world to but a new A/C.

The manufacturer doesn't care, he sells more units. Same for the retailer. Its the customer that gets the shaft,,, as per usual.
