"Guantánamo Forever?" - Congress Passes $662 Billion Defense Bill, Aka The NDAA

Congress just passed the National Defense Authorization Act in a 283-to-136 vote. 190 Republicans and 93 Democrats voted for; 43 Republicans and 93 Democrats voted "against." Prepare to be arrested, without charge, simply because someone "up there" believes you engage in "terroristy" stuff. Good luck proving them wrong.

The U.S. House of Representatives approved a defense bill on Wednesday requiring the military to handle suspected militants linked to al Qaeda, acting not long after President Barack Obama removed a veto threat from the controversial legislation.

 

The bill is expected to pass the Senate this week and then go to Obama's desk for his signature into law.

 

Shortly before the House vote, the White House announced the president's advisers would not recommend a veto, although they said they still had concerns about the measure.

 

The measure also imposes new sanctions against Iran's central bank and pre-emptively freezes some aid to Pakistan.

And CNN:

The White House lifted a veto threat against a giant $662 billion defense authorization bill on Wednesday after legislators made changes in language involving detainees.

 

In particular, the legislators added language to make clear that nothing in the bill requiring military custody of al Qaeda suspects would interfere with the ability of civilian law enforcement to carry out terrorism investigations and interrogations in the United States.

 

A statement by White House Press Secretary Jay Carney said the changes mean that President Obama's advisers will not recommend a veto. The measure is expected to come up for votes in the House and Senate this week.

At issue was the president's authority in deciding whether people detained in terrorism investigations would be held in military or civilian custody.

 

Sen. John McCain of Arizona, the top Republican on the Senate Armed Services Committee, said the legislation includes a "national security waiver" that allows the president to transfer a suspect from military to civilian custody if he chooses.

Swell, in other words it won't be a colonel pulling your nails out... it will be some spook in a grey coat.

IN his inaugural address, President Obama called on us to “reject as false the choice between our safety and our ideals.” We agree. Now, to protect both, he must veto the National Defense Authorization Act that Congress is expected to pass this week.

This budget bill — which can be vetoed without cutting financing for our troops — is both misguided and unnecessary: the president already has the power and flexibility to effectively fight terrorism.

One provision would authorize the military to indefinitely detain without charge people suspected of involvement with terrorism, including United States citizens apprehended on American soil. Due process would be a thing of the past. Some claim that this provision would merely codify existing practice. Current law empowers the military to detain people caught on the battlefield, but this provision would expand the battlefield to include the United States — and hand Osama bin Laden an unearned victory long after his well-earned demise.

A second provision would mandate military custody for most terrorism suspects. It would force on the military responsibilities it hasn’t sought. This would violate not only the spirit of the post-Reconstruction act limiting the use of the armed forces for domestic law enforcement but also our trust with service members, who enlist believing that they will never be asked to turn their weapons on fellow Americans. It would sideline the work of the F.B.I. and local law enforcement agencies in domestic counterterrorism. These agencies have collected invaluable intelligence because the criminal justice system — unlike indefinite military detention — gives suspects incentives to cooperate.

Mandatory military custody would reduce, if not eliminate, the role of federal courts in terrorism cases. Since 9/11, the shaky, untested military commissions have convicted only six people on terror-related charges, compared with more than 400 in the civilian courts.

A third provision would further extend a ban on transfers from Guantánamo, ensuring that this morally and financially expensive symbol of detainee abuse will remain open well into the future. Not only would this bolster Al Qaeda’s recruiting efforts, it also would make it nearly impossible to transfer 88 men (of the 171 held there) who have been cleared for release. We should be moving to shut Guantánamo, not extend it.

Having served various administrations, we know that politicians of both parties love this country and want to keep it safe. But right now some in Congress are all too willing to undermine our ideals in the name of fighting terrorism. They should remember that American ideals are assets, not liabilities.

Someone recently wrote that the current conviction rate in federal court is 97%.  I guess now they don't even have to go through the formality of a trial.  They don't like you, you go away.  Seems like I remember the USSR was much the same, although I am pretty sure they at least gave you some sort or show trial in front of the party judges before they sent you to Siberia never to be heard from again.

Someone earlier brought up Richard Gage who, for those that don't know, is that architect that formed that group of architects and engineers (1700+ members from leading architectual and engineering firms) asking for an independent investigation of September 11th. Anyway, this group of perfectly sane people were officially listed as 'potential terrorists' by some of those in government that were in charge of briefing the Committee. His letter in reponse to this briefing is below. I read about this in a French newspaper, it said that the targets of the Homegrown & Radicalisation Act could include people like the architects in this organisation, I was really frightened.

That's because in Federal Court they can use RICO Conspiracy laws which mean that anyone that 'facilitated' an ongoing 'conspiracy' with one single act, by helping in any way shape or form; making a phone call, letting someone use their phone, car, computer, whatever, to commit a crime, they are as responsible, as the person or persons, who committed the crimes, and if convicted, have to do the time for the crimes of the entire conspiracy.

Furthermore, in Federal Court, one is penalized for going to trial. The amount of time that one could get if one chose to go to trial is far greater than one would get from a plea because of the way that the sentencing guidelines are set up, where you are charged with the crimes of all others in the conspiracy, racking up your sentence with years and years. These long 25+ sentences are not manageable for most people, so most plea, and 'cooperate' by becoming witnesses against others as part of the deal. It's set up to be a snitch factory.

That's why when law makers say that it would be so 'difficult' to criminally prosecute financial crimes. Bullshit. Not, if they used RICO. I mean, they could have indicted so many top level people for the Wells Fargo money laundering operation, for example. All the way to Warren Buffet if they wanted to.

It only takes one witness infront of a grand jury to get an 'indictment', and once an indictment is handed down, it's easy to get witnesses using the above tactics. All they would need to do is indict or threaten to indict the accountants, personal secretaries, or support staff with conspiracy wraps, they would have a million witnesses overnight.

That's how drug conspiracy cases/ trials work. 97% plea and cooperate.

Thanks for the clarification. The whole process sounds very political, in that we already seem to be at the point where if they want you, they get you.  That brings me to another comparison with pre-collapse USSR.  The communist government was quite adept at creating laws that could not easily be complied with during the task of ordinary life.  Everyone was living outside the law in some way or another, so that if you became a political nusance, you could be easily dealt with by selective enforcement of some vague statute.  That is the very essence of tyranny.  You may have "rights", but you exercise them at your own peril.

Not only was this done to the japanese-americans during WW2, this was offical policy during the Civil War in the north, then in the south during "reconstruction". In 1862, Louisville, Kentucky, a union officer placed a local woman in a meat cooler until she died on suspicion of being a confederate spy. No trial, no hearing, no attorney. She was arrested on the word of a neighbor. BTW, This song came out some forty years ago, and it is VERY descriptive of today:

i heard that a 12 year old kid was held for 6 weeks in a flour sack and finally confessed and was hung.several innocent nuns were tied up in a pastry shop and i dont think they ever got a trial but ended up having to make lunch for everyone...

this new law will make it hard for the restaurant industry in general.

It occurred to me that the outrage inspired by detaining US citizens on US soil seems to have effectively distracted people from the hundreds of billions of dollars of 'military Keynesianism' that lies at the true heart of this bill.  "I DON'T CARE WHAT YOU SPEND JUST GET THAT DAMN UNCONSTITUTIONAL DETAINING AMERICANS THING OUT OF IT!!!"  Well done, amazing misdirection that was cleverly executed.

There is a study looking at the ratio of negative to positive news articles about the various candidates. Guess who had the least negatives? The most positives?

You couldnt attack him without being called a racist. The last thing a progressive wants to do is get labeled as a racist.

Clinton's "fairy tale" comment had nothing to do with the preprosterousness of a black man running for president, yet obama and his followers jumped all over this as a racist outrage, effectively silencing any real criticism that he wasnt experienced or ready to be president.

I'd say that the threat of a social "stigma" carried by any attack towards Obama, being branded as anything near as racist, isn't the most important drive of the MSM agenda (except from Fox News).

I can relate.  I am one of those Christmas fanatics....my kids make fun of me b/c I love all aspects and activities of the holiday so much.  But this year it has been hard to feel celebratory.  I feel like I am living in parallel universes when I listen to Christmas music, which I usually love.  The worst moment came when I was driving and the song "Grown Up Christmas List" came on...I literally wept at the truth of it.  Listen to it sometime....it's the only song that's applicable this year.

But I am going to fight those feelings....I refuse to let the evilmongers take all that is sacred and good from me....they can't steal my soul, or my faith.  

Difficult times, for sure....try to keep your head up!  Don't give them the satisfaction!

Accounting fraud was carried out by mortgage bankers and affiliates of banks that weren't subject to governmental regulation. They issued what he called "liar's loans" that were guaranteed to provide huge bonuses for executives, while setting up home owners to certain failure when the real estate bubble burst, he detailed.

Many predatory mortgage brokers targeted poor people and minorities, inflating appraisals, and debt-to-income ratios in order to qualify them for the loans, he continued. By 2006, there were over two million cases of this type of fraud a year, and banks were selling their problematic loans to Wall St. under false pretenses, said Black, who added that we could be looking at an even more intensified financial crisis down the road because the way government has responded to the crisis (such as the bank bailout) has made matters worse.
