DOJ Says It Won't Prosecute DOJ Head Holder

How should we say this: we are shocked, shocked, that the DOJ won't prosecute itself.

The White House and the Justice Department made clear Friday what had been expected all along: Attorney General Eric Holder will not face criminal prosecution under the contempt of Congress citation passed by the U.S. House.


Legal experts noted this week in the runup to Thursday's House vote that President Barack Obama's assertion of executive privilege in the case would prevent a criminal prosecution under a practice dating to the Reagan administration.


The House also cited Holder for civil contempt to give it the option of filing a lawsuit compelling Holder to turn over documents sought by Oversight Committee investigators linked to the failed Operation Fast and Furious weapons crackdown. Such a case was expected to take years to complete.


A letter Friday from the Justice Department to House Oversight Committee Chairman Darrell Issa, who led the investigation that brought the contempt charge against Holder, explained that "across administrations of both political parties, the longstanding position of the Department of Justice has been and remains that we will not prosecute" in such a circumstance.


"The department will not bring the congressional contempt citation before a grand jury or take any other action to prosecute the Attorney General," concluded the letter from Deputy Attorney General James Cole.


White House spokesman Jay Carney said the same thing Friday, saying "it is an established principle, dating back to the administration of President Ronald Reagan, that the Justice Department does not pursue prosecution in a contempt case

A spokesman for Issa's committee and another top congressional Republican, veteran Sen. Charles Grassley of Iowa, complained Friday that the refusal to prosecute showed a lack of independence by the U.S. attorney who would handle the case.


"It is regrettable that the political leadership of the Justice Department is trying to intervene in an effort to prevent the U.S. attorney for the District of Columbia from making an independent decision about whether to prosecute this case," said Frederick Hill, the panel's director of communications.


Obama asserted executive privilege on some documents sought by Issa's committee in its investigation of Operation Fast and Furious. The executive privilege assertion prevented the documents from being turned over on the grounds that they include internal deliberations traditionally protected from outside eyes.


The Bureau of Alcohol, Tobacco, Firearms and Explosives launched Operation Fast and Furious out of Arizona to track weapons purchases by Mexican drug cartels. It followed similar programs started in the Bush administration.


However, Fast and Furious lost track of more than 1,000 firearms it was tracking, and two of the lost weapons turned up at the scene of the 2010 killing of U.S. Border Patrol agent Brian Terry.

Note some facts, bro:

African Americans played a major role in Vietnam and, in the process, changed the complexion of the U.S. Armed Forces. Contrary to popular impressions, a large proportion of African American servicemen were well-trained, highly motivated professionals; some 20 received the Medal of Honor, and several became general officers. Despite the likelihood of seeing hazardous duty, they reenlisted at substantially higher rates than whites. In 1964 blacks represented less than 9 percent of all U.S. Armed Forces; by 1976 they made up more than 15 percent of all men in arms. Although the percentage of African American officers doubled between 1964 and 1976, they still accounted for less than 4 percent of the total.

Note they REENLISTED AT A HIGHER RATE than white people. When you renenlist, you are no longer a draftee. Note they were underrepresented at the start of the war - overrepresented by 1976. However the draft ended in January, 1973. The draft was for two years, so the last draftee should have been gone or on the way out by January 1975. I was in then, and I remember many got early outs at 18 months. The idea that blacks were drafted in vastly disproportionate numbers is an urban myth. One fact that skewed the numbers a bit was that whites who had bad draft lottery numbers tended to enlist, so they didn't get drafted.

By the way, by 1975 the Modern Volunteer Army [MVA] was in full swing, the massive exodus of drafees was almost completed, and the Army started offering large bonuses to reenlist. I was a SP4 in June, 1975 and they offered me $10K to reenlist. That was huge money back then. I walked. Many black people I served with took the money. The war was over and the living was easy.

State and National Guards
The office of The President of The United States.

It does not require the DoJ to bring a criminal prosecution either.

Private Criminal prosecution.Still on the books but not used in the

US since 1906.Can be used against bankers as well if someone

provides the cash flow until conviction.

Not a oroblem for Issa though.

Used to be common practice,up until seventy or so years ago.

Anyone with standing(a member of the public) should go to the U.S. District Court for  D.C. and get a Writ of Mandamus against the United States Attorney for the District of Columbia, Ronald Machen.


It would make Machen prosecute the case against Holder and execute the duty he owes to the public in good faith, under penalty of contempt.

funny, i called out the obvious bread and circuses partisan ploy on this a week or so ago, and i got blasted here....too many "anti democrats" outraged with the notion that no politician really gives a shit about fast and furious.........not that hard to see they will do anything to galvanize the partisan sheep before elections and keep important information and matters, such as...oh...federal insolvency, away from the masses........perhaps now that tyler calls it what it is, some of our astute and critical commenters will see the light...................

doc--when i stated that "none of this matters", i meant the three ring circus that our govt was putting on... it doesnt matter as in nothing would ever be accomplished from it, not that it shouldnt matter....

and my point about the "tough republican" comment was that both sides are happily stripping away liberties, so if youre a partisan republican sheep, you are not seeing that the "outrage" posed by republicans over fast and furious is nothing more than smoke and mirrors...just a "crisis that should never go to waste"....

Hell no.   They want to force the House to appoint a special prosecutor, which they can pummel during the elections and make Holder a victim.   Of course, that could just backfire and gives the House a reason to appoint said special prosecutor, certainly a double edged sword that can cut both ways.
