Judge Katherine Forrest is a Modern American Hero
Sometimes, the greatest deeds are done by those who are just doing their jobs, like Judge Katherine Forrest who last week struck down the indefinite detention provision (§1021) of the National Defense Authorization Act (NDAA).
It would be all too easy in this age of ever-encroaching authoritarianism in America for a judge ruling on a matter like this to just go with the government line and throw water over the plaintiffs. After all, telling truth to power has consequences. Forrest was appointed by Obama, but after this ruling one wonders whether she is about to meet a career dead-end. Power — especially narcissistic power — does not like being told uncomfortable truths.
Everything about this case is shameful; it should be obvious to anyone who can read the Constitution that indefinite detention without trial (just like assassination without trial — something else that Obama and his goons have no problem practicing and defending) is hideously and cruelly unconstitutional. It defecates upon both the words and the spirit of the document.
It is directly and completely in contravention to the Fifth Amendment:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
It is shameful that this law was proposed, it is shameful that any legislator would vote for it, and it is shameful that the President would sign it into law, albeit with a flimsy signing-statement claiming that he would not use the indefinite detention provision against American citizens.
More shameful still is the fact that when this challenge was brought that the Obama administration tried to dismiss it on a technicality — they tried to make the case that because none of the plaintiffs were to be indefinitely detained that they could not challenge the law. Judge Forrest’s investigation of this claim was revealing. Naomi Wolf notes:
Forrest asked repeatedly, in a variety of different ways, for the government attorneys to give her some assurance that the wording of section 1021 could not be used to arrest and detain people like the plaintiffs. Finally she asked for assurance that it could not be used to sweep up a hypothetical peaceful best-selling nonfiction writer who had written a hypothetical book criticizing US foreign policy, along lines that the Taliban might agree with. Again and again the two lawyers said directly that they could not, or would not, give her those assurances. In other words, this back-and-forth confirmed what people such as Glenn Greenwald, the Bill of Rights Defense Committee, the ACLU and others have been shouting about since January: the section was knowingly written in order to give the president these powers; and his lawyers were sent into that courtroom precisely to defeat the effort to challenge them. Forrest concluded: ”At the hearing on this motion, the government was unwilling or unable to state that these plaintiffs would not be subject to indefinite detention under [section] 1021. Plaintiffs are therefore at risk of detention, of losing their liberty, potentially for many years.“
Very simply, it is now obvious that the NDAA was written not to deal with terrorists or potential terrorists. After all, if the government has evidence that an individual or group is planning to commit a terrorist attack then they do not need an indefinite detention provision; all they need is to arrest such individuals and prove beyond reasonable doubt before a jury of their peers that a crime has been committed. That is how justice works — if the evidence exists you can bring a successful prosecution. After all if they do not have the evidence to prove that a group or individual was planning to commit an act of terrorism then they have no business arresting them or charging them with any offense. Suspects — lest we forget — are innocent until proven guilty.
These new powers have nothing to with combatting terrorism. If the government has no evidence that can stand up in a court of law it has no business detaining anyone. No, this new power grab has an entirely different target — like the plaintiffs in this case: writers, investigative journalists, bloggers, philosophers, dissidents, human rights activists, libertarians, free-thinkers, tax protestors, critics of fractional-reserve banking, whistleblowers — people like Chris Hedges, Noam Chomsky, Daniel Ellsberg, Jennifer Bolen, and Birgitta Jonsdottir. People like Congressman Justin Amash and Congressman Adam Smith who tried to amend indefinite detention out of the bill. People like me — and to some degree, if you are reading this, people like you.
The fact that the Obama administration could not give assurances about those who simply criticise U.S. foreign policy indicates very strongly that this power grab is about shutting-up and frightening critics of the U.S. government and the Obama administration.
But — for now — §1021 of the NDAA, that implement of fascism, has been struck down and thrown out as “facially unconstitutional” as well as having a “chilling impact on First Amendment rights”.
We should thankful for this brave judge’s actions, and for the plaintiffs actions in standing up to tyranny, and vigilant against future incursions.
On the other hand, every politician involved in writing, legislating and authorising this hideous unconstitutional law should be reminded of the words of the Declaration of Independence — it is the right of the people to alter or abolish any government that becomes destructive to liberty.

Absolutely real and true, they have capacity for 25 million people. Many are setup to handle entire families while others are setup more like a prison. It should be clear what the intentions are just based on the bills passed and the executive orders signed by Obama recently. These are all in anticipation of massive civil unrest, they know what's coming and they also know there is no way to avoid it.
They've also built thousands of equipment maintenance centers for various transport and weaponized machinary. They built one about 2 miles fmor my house and I have never seen anything there but new equipment still wrapped in the plastic. Right now and for the last couple of weeks it is filled to the gills with tanks, personel transports, humvees with 50cal and jeeps. It went basically empty for the first two years but now it is full for a couple weeks.
I think some of this equiment will be used here, once the pending financial meltdown happens and martial law is implemented (along with bank holidats, capital controls, etc) they'll start to turn on some of these executive order capailities like confiscation of pretty much anything the President wants - homes, business, weapons, food, farms, anything! Let's not forget the 450 million hollow point bullets the DHS just purchased, guess they got a deal they couldnt pass up huh?
I expect that if they can't control the economic situation through the fall Obama (and congress) will announce a state of emergency and postpone the elections - believe dat! I think they now realize that they are losing control and are therefore stepping up preparations. The debut of their thinking was probably in Chitown at the NATO summit.
With martial law will come a knock at the door asking (telling) you for your weapons if you have any registered - nice. They have the ability under those orders to confiscate pretty much anything at all no matter how minor or major - a vehicle to an entire business! If we make it past late summer I'd be really surprised, seem possible things could meltdown as early as this week!

This is all political bullshit--the Bill of Rights has just been a piece of paper under some glass in Washington D.C. for several decades now. Law enforcement can do whatever it wants to do and there ain't jack shit you can do about it. Most people think if the cops arrested and beat the shit out of you, you must have done something wrong. As long as citizens think of government as friendly rather than corrupt by nature then government will have autonomous powers.

The House just passed another amdt to the NDAA where now you're not entitled to habeas corpus immediately but would have to wait 30 days. AND the NDAA allows them to ship you off to a foreign land. Example: They take you to Saudi Arabia and release you. Now the Saudi govt arrests you and you never do get that habeas corpus. The fact that they would pass this amdt after the judge struck down Section 1021 is a pretty sure sign Obama admin will appeal the judges ruling on Section 1021.

At some level I do take issue with be asked to thank a Judge for doing her job. The only thing more disgusting than the bill itself was that one of the authors is John McCain, a former POW. Really John?

Couldn't agree more Mr. Aziz and further, every legislator involved in bringing this bill up and voting in favor should at best be impeached and at least be voted out of office.
We the people should not stand for "representatives" who knowingly attempt to institute laws which make a mockery of our Constitution. I'm glad the judiciary did it's job and agree Ms Forrest is a hero, but what if she had buckled?
At this delicate time in our nation's history we cannot run the risk of letting crap like this go down without a fight.
Torture doesn't work, because everyone has a breaking point where they will just lie and admit they did something in order to stop the pain.
If I repeatdly rip your toes off one by one and I tell you that im not going to stop until you provide me information, you are going to lie and tell me what I want to hear just to get a moments rest from the pain.
Torture does not work unless you 100% know the guy is guilty to begin with, in which case its pointless because you already have the guilty party under custody.
What we need is laws that protect and make public such interogations so that the will of the people can determine a the fate of the accused instead of the will of the government (who rarely reflects the will of the people).
Everyone should have the right to make a public statement and be tried in a court before being mamed or otherwise imprisoned or harmed.
Without such basic laws, the Government could easily kidnap you just because you were running for president and blame it on someone else, a president could stay in power forever simply by illiminating his oposition.

I might only quibble with Aziz's phrasing, "and the Obama administration," toward the end. I haven't noticed I'llbombya's admin dismantling the Patriot Act or PD 51: This type of legislation is often around for years or decades, permanently transferring power to both parties, removing power from civilians. So I'd say it applies to critics of our government, period.
I can't understand, either, why so many people buy into the occultist dialectic (my phrase for the false left-right dichotomy pushed by the mm). I'm disgusted with it. A former friend of mine recently asked me "What rights have you lost?". Amazing. Of course, if a Repugnicunt admin had done this, he would be screaming bloody murder.
It's clear to me that one of the solutions is for people to stop watching television. Clearly, this is not going to happen, so the problem is just going to get worse. Most folks are programmed to a hopeless degree of helplessness. They are powerless to see the l/r false paradigm for what it is. They are incapable of admitting that a treasonous government of collaborators is behind this and instead heap the bulk of their frustration on one party or the other, in divisive fashion, just as programmed.
I am disappointed that people cannot see the government for what it is. But then I grew up listening to stuff like this. Maybe they should have. As Simonon asks in this tremendous skank,

It seems to be one of the classic, eternal questions, made all too frighteningly real by legislation like this. Aziz's analogy to the Taliban is apt. I don't know anything else about this judge, but I'm glad someone is saying something.
