Should Obama And Congress Be Arrested Under The NDAA?

Should President Obama (alongside Lindsay Graham and John McCain) be wearing an orange jumpsuit?

Welcome to the beautiful and surreal reality of life under American corporatism, under a Congress that churns out thousands  and thousands of pages of (often contradictory) legislation a year.

If providing material assistance to al-Qaeda is illegal under the National Defence Authorization Act (2012), and Obama and Congress are sending $25 million of aid to al-Qaeda-affiliated Syrian opposition, aren’t Congress and President Obama violating their own law? Should Obama (or at least the Justice Department) not be using “all necessary and appropriate force” including “the power to indefinitely detain” to prevent Obama and Congress from assisting al-Qaeda? Did anyone in Congress or the Obama administration even bother to read the law that they were signing? Do Federal laws no longer apply to lawmakers?

The only question left from this abrupt and absurd turnaround — from funding bin Laden’s mujahideen thirty years ago, to ten years ago declaring war on al-Qaeda, to today sending them material assistance — would appear to be whether or not Obama will pull a 1984 and claim that “we have always been at war with Eurasia“.

How do you define; Law?

Tue, 08/07/2012 - 18:06 | 2685950 blindman
blindman's picture

the fiction which is exempted from
scrutiny by the class of "people"
excluded from the privileges defining
the elite class, law-makers, but, who are
the target audience of said "law".
as artist define/articulate art, lawyers define/
articulate law.
not all fiction is law but all law is a
type of fiction. it has a beginning, a middle and an end that follows along a plot. the plot may
or may not have relevance or be understood by
the characters that comprise and sustain the plot.
the plot is usually a club to beat the life from
the weak and outlying for the comfort of the
comfortable.
.
law (n.) O.E. lagu (plural laga, comb. form lah-) "law, ordinance, rule, regulation; district governed by the same laws," from O.N. *lagu "law," collective plural of lag "layer, measure, stroke," lit. "something laid down or fixed," from P.Gmc. *lagan "put, lay" (see lay (v.)). Replaced O.E. æ and gesetnes, which had the same sense development as law. Cf. also statute, from L. statuere; Ger. Gesetz "law," from O.H.G. gisatzida; Lith. istatymas, from istatyti "set up, establish." In physics, from 1660s. Law and order have been coupled since 1796.
.
article (n.) c.1200, "separate parts of anything written" (e.g. the statements in the Apostles' Creed, the clauses of a statute or contract), from O.Fr. article (13c.), from L. articulus, dim. of artus "a joint" (from PIE *ar-tu-, from *ar- "to fit together;" (see arm (n.1)).

Meaning extended to "a small division," then generalized to "item, thing." Older sense preserved in Articles of War "military regulations" (1716) and Articles of Confederation (U.S. history). Meaning "literary composition in a journal, etc." (independent, but part of a larger work) first recorded 1712. Meaning "piece of property" (clothing, etc.) first attested 1796, originally in rogue's cant.
.
ordinance (n.) c.1300, "an authoritative direction, decree, or command" (narrower or more transitory than a law), from O.Fr. ordenance, from M.L. ordinantia, from L. ordinantem (nom. ordinans), prp. of ordinare "put in order" (see ordain). By early 14c. senses had emerged of "arrangement in ranks or rows" (especially in order of battle), also "warlike provisions, equipment" (a sense now in ordnance).maypole "high striped pole decorated with flowers and ribbons for May Day merrymakers to dance around," attested from 1550s but certainly much older, as the first mention of it is in an ordinance banning them, and there are references to such erections, though not by this name, from a mid-14c. Welsh poem. See May Day.

Should Obama And Congress Be Arrested Under The NDAA?

The answer is yes and no...no under NDAA (its hypocritical and un-constitutional) but yes for malfeasance in office for breaking their oath to the American people (by contract) to protect & defend the Constitution of the United States against all enemies, foreign and domestic.

Our contract reads in part...

"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, >>>when in actual service<<< in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

I move we convene our Grand Jury...do I have a second?

No they won't. They view it as another program in the matrix. An outlet for people of the libertarian mindset. Kind of like Rush is an outlet for conservatives and MSNBC is an outlet for liberals. It gives them that forum to say " fuck yeah" but then not actually do anything about it. What it really does is act as a controll mechanism so that liberals, conservatives, and libretarians don't talk to each other about just how we are all being raped by TPTB. If there was any real danger they would have shut it down long ago.

Agreed.

They are voyeuristic and have a vested interest in knowing what is being said about them and others. Manipulation has to have context or it can't be manipulated.

Pronouncements from elites and government that so-and-so was a public menace fall on deaf ears without seeing for themselves the original basis for the charge...seeing what was said, shows the stupidity of the charge itself.

The lid of Pandora's Box is wide open and its a beautiful thing ;-)

Sometimes I get the feeling that the cold war never ended.

The communists became capitalists, the capitalists became communists.

The proxy wars simply moved to a different country full of brown people.

The rebels are actually part of the empire, and the media tells us the real rebels are a violent dictatorship slaughtering its own people.

The brown people are sent to the slaughter, and I picture the monopoly man laughing as he bathes in a bathtub full of greenbacks.

If you don't wake up each day with a healthy dose of guilt and frustration at what is being done in your name, you aren't awake at all.

Al-KAY-Dah should go public. Get GS to do the IPO. Hypothecation bonanza.  A Derivative dream come true. What a waste of a good global BRAND NAME if they don't.  They should hire OBAMA as their new CEO and get Corzine (where is that dog anyway?) to sit as Chief Fucking Officer CFO. There is absolutely NO difference between Cheney, W and the War Pigs and Al-Qaeda. Then they can join the legitimate Corporations, with full rights as "human beings" in the eyes of the law.

Obama had better get it done, before he is locked away for TREASON violating his own NDAA law.

I am not a lawyer, but just saying...

This piece is distractionary, and attempts to make the situation "Ridiculous", somehow tradgic, yet, in some way humourous,  "He shook his head in bemused amazment as he watched his TV, what'll those jokers in Washington come up with next, with a wry smile of resignation on his face, he shrugged his shoulders giving the sign; there is nothing I can do about anythin anyway", back to my drudgury he thought,  wery quickly the entire incident was forgotten never to surface again.

Many posters have laid out their comfort phantasies whereby they imagine themself's invincible against the power of the State, these phantasies are precussers to serious mental illness in rare cases, usually the dreamer, simply dreams his dreams and harvests such peace of mind as such activity provides, they talk a brand of defiance in public but are actually good law abiding, anxious to join, and experience the sense of security only herd behavior can bestow upon it's members..

I am going to obey the law of the land to the best of my ability, and I recommend the same behavior to all of you, if you think things need adjusting, persuasion is your only realistic tool to effect change, modern people need the structure and stability of the state to function, we are not dark Age Peasents, we do not have their skills for taking their livelyhood directly from the World around them.

Thec ollaspe of Society:  the point where the economy no longer functions, and commerce comes to a standstill, Should we ever reach that place, it will signal the beginning of the darkest age civilized mankind has ever faced, I believe it possible that nine out of ten, or more, would perish in a relatively short time! This will include most of the survivalists, who, when faced with the challenge of making their dreams come true, discovered that they were, in fact,  inadequate to the task!  There is no shame in that it only could have been a reverie to lull yourself to sleep on, if it accomplished that it doesn't owe you anything.

Sorry Aziz,

That the administration staff deserve being hunted by their own drones, that the US "helping out" rebels in Syria is a cheap investment for the US to some long term projects, that Assad's fall helps out one of US's best allies is no reason to spout out lies that Al Qaeda is somehow involved in this in any signifiicant way or the underlying premise for my commentators here that the rebellion in Syria is totally fabricated is just too much BS for me to take.

I don't want to live in a world where you see genocides in progress and the only options available is either interventions by superpowers who have intentions other than ending the genocide, and who themselves created or help create the oppressors (Assad and King Abdullah of Jordan are faithful borderkeepers to Israel) or do-nothing views are hijacked by those who profit from the status quo. True humanitarian interventionist and true "they would make it on their own" non-interventionist views are lost in all this BS. I'm not saying I'm clearly situating myself on either side. The aforementioned confusion helps a lot. Thanks

Not being negative here but it is important to understand what is really going on.

This guy is right but doesn't have any understanding about the UCMJ.  They have the men taking two pledges or serving two masters.  They pledge to the Constitution but sign a contract to uphold the UCMJ.  If they want them to do something Unconstitutional, they could say "Soldier, you gave us your agreement when you joined and said you would follow orders per the UCMJ."

It was the Articles of War not the UCMJ that governed the Armed forces for many years.

A Declaration of War requires articles of war to be drawn up!

I guess you have seen the Pirates of the Caribeean and know who uses a book of 'code'.

They have the modern equivalent of press gangs recuriting young men into this constantly.

Road to hell is made up of good intentions?

Where do you think all those young men (militia) will be when the SHTF.

Diabolical stuff.

Go read what you signed at the bank last time you opened an account.  I bet you didn't read the oath at the bottom.

They never really swore you in when they did that huh?  I also saw no indication that they were a commisioned public officer capable of giving an oath.

I reserve my right to cancel, modify or amend agreements and everything else too.

Read the Declaration of Independence.  "Established an arbitrary government"  Good stuff in there!  Keep studying!

Mussolini described fascism, when the power of government and corporations merge. This is what we have got all over the western world. Democracy consists of two or three factions of the same party.

This is why the NWO wants to end the dictatorships of various countries so they can install their own dictatorship i.e., parties controlled by NWO corporations and governments.

Is it Ramadan yet?  El Presidente' will invite very special guests to the white hostel to serve them the 'Iftar' ceremonial dinner ending the fast of Ramadan...  Comrade Hillary will be there also, with the blood of christian and druze on her clever hands

How about all the off balance sheet debt which takes US debt from 16 trillion to closer to 100 trillion.

The system is now broken. We've strayed from the rules of the Founders and let government grow and grow and take away liberty and freedom in the process.

Absolutely not! They should not be arrested pursuant to that Unconstitutional piece of toilet paper.

On the other hand, they WILL BE ARRESTED EN MASSE pursuant to the Constitutionally legitimate documents referenced extensively here... http://tinyurl.com/cd5cyjo/

It's time to get a grip everyone. If you think tens of millions of American patriots, active-duty military, gun owners, veterans, reservists, police, federal marshalls, and many others who swore an oath to protect the Constitution are inconsequential and powerless, you need therapy. If you think something like "95% of military and police" are truly "on the side" of our illegitimate federal government, you are insane and never served a day in uniform. Yeah, police and federal agencies commit atrocities on behalf of the illegitimate federal government. Yeah, many of them know they are not following the Constitution. However, if you think the cops and the military a) love their paymasters and b) are about to disarm the most armed society ever to walk the earth and herd them into cattle cars for orderly disposal, you are truly off your rocker.

Is anyone paying attention to world events? The FED, the NWO (meaning the OWO), and the illegitimate U.S. federal government are losing power, becoming increasingly irrelevant, and being systematically defanged and defunded. About the only thing they still control is the fear-machine media, and even that is slipping. It's sad how many people believe these pinheads actually rule the world. They don't. It's an illusion and they are being undermined and hedged against at every turn by powerful forces inside and outside the U.S. The FED, the NWO, and the illegitimate U.S. federal government are, in fact, about to go the way of the dinosaur. Monumental changes are in store for mankind once the traitors to the Constitution and their lackeys are swept away. Mankind is about to be freed from the modern-day dark ages... the massive supression of life-saving, planet-saving technologies, the shackles of wage slavery and debt slavery, and from institutionalized fear and ignorance.  There is a golden age just around the corner. It won't be easy and things will be ugly in some spots. However, in the end, the traitors, the bad guys, and their institutions can and will be swept away.

Yeah right: 'hope and change', confederate style.

How often do you hear about any 'law enforecement officer' or military following their conscience, or oath to defend the Constitution? If these people had a clue, they would not have never signed away their conscience to 'follow orders', especially since this was the excuse all 'well intentioned' 'law abiding' Nazi officers gave at Nuremburg.

Can we learn from history or just repeat it, over and over again, hoping for a different result?

Dude, that too is addressed in detail in the interview. "I was just following orders" didn't cut it at Nuremburg and it won't cut it now. The oath keepers must and will be separated from the oath fakers... period... and they will be separated like it or not, because of how far things have gone. Soliders and LE do follow their conscience on occasion. The Pentagon papers, Serpico, and Bradley Manning come to mind. The military and LE are not some monolithic block of (illegal) order-following zombies. Most are red-blooded, government hating patriots that know there is an endgame coming.

TMFC,

I agree it appears that TPTB are losing control, and that the acts and orders of late appear to be out of desperation. I certainly hope you are right about the mass arrests. However, I cannot rest in that hope. The military and police may not love their masters, but how many will continue to follow orders that they may continue to feed their families? That being said, I do know that if we, the people, united we would be able to sweep aside the evil.

One last question: Is it possible that TPTB are feigning losing control to lure in an attempt like the one you describe? Similar to an Ali rope-a-dope?

But not under "Trading with the Enemy."

Trading with the Enemy Act is a stock short title used for legislation in the United Kingdom and the United States relating to trading with the enemy.

The Bill for an Act with this short title will have been known as a Trading with the Enemy Bill during its passage through theParliament of the United Kingdom or the United States Congress.

Trading with the enemy Acts is also a generic name for a class of legislation generally passed during or approaching a war that prohibit not just mercantile activities with foreign nationals, but also acts that might assist the enemy.[1] While originally limited to wartime, in the 20th century these Acts were applied in cases of national emergency as well. For example, in 1940, before the United States entry into World War II the president imposed broad prohibitions on the transfer of property in which Norway or Denmark, or any citizen or national of those countries, or any other person aiding those countries, had any interest, with the exception of transfers which were licensed under the regulations of the Department of the Treasury.[2]

If this is true, and they can not be prosecuted under Title 50, then that tells me the Central Bank, Federal reserve and the Treasury Department has placed full weight, funding and lethal force behind all these illegal wars. The Treasury Department is now the IMF managed by Golman Sachs so connect the dot's.

The USA and all its political subdivisions (STATES), and agencies are all private companies. You can verify this fact on Dun & Bradstreet and Manta as well as The Organic Act of 1871 & 28 USC 3002. These companies were designed and implemented to steal the property and wealth from its subjects/employees/slaves known as US citizens/persons/slaves. These companies have been in Chapter 11 bankruptsy since 1933 (Emergency Banking Act of 1933; House Joint Resolution 192). Since the USA did not have any assets of its own, they pledged the assets and property of the People to the international bankers in return for all the 'credit money' it needed. This is why you are bonded via birth registration and your property was stolen via the use of equitable title such as warranty deeds. deeds of trusts, certificates of registration, etc.

The Bretton Woods Agreement of 1944 deeded the District of Columbia to the IMF. In 1938 the USA Supreme Court changed the law from Common Law (if there is no flesh and blood victim, there is no crime) to commercial/maritime/admiralty law known as the UCC via Erie vs Thompkins. So now the STATE presumes to be the injured party and so can criminalize anything it chooses.

The Jekyl Island Treaty of 1910 established the funding (gold) for the formation of the Federal Reserve. No physical gold was delivered to the FED. What they got was a safe-keeping receipt for the physical gold which the FED used as collateral for the issuance of FRN$. The principals retained control and possesion of the physical gold. The debt incurred by the FED was the interest on this gold which I believe to be 4% annum.

The Jekyl Island Treaty expired in December of 2011. It was not renewed by the principals, and the funding and backing of the FED was withdrawn.

Patrick Henry had something to say about all of this. Lysander Spooner too.

Why are we still debating and proclaiming that the Emperor has no clothes; and the Constitution has no authority.

Maybe we could ask the native peoples of the Americas what they think about how well 'laws' protect our rights.

Can't we just accept that we have rights, which are not 'granted' or 'protected' by law (those are called 'privileges') and that states do not care about our rights?

I think it is time we accept the fact that power corrupts, and move beyond 'hope'.

No matter how much hope we can conjure up, water will always run downhill, and states run themselves, and their slaves, into the ground, time and time again. This is the natural course of human history.

Got water? clothing? food?

It is in your DNA to survive; all living creatures, smart or dumb, single or multi-celled know what hunger is. Fear of death is in all living creatures DNA. Fight that nature and you will lose. DNA determines that you will try to survive.

My mother feeds a chipmunk shelled peanuts. This chipmunk has enough peanuts to live the rest of its life and not know hunger. Stored under the neighbours wood deck, safe from the elements. It always comes back for more. Programmed by DNA to store food for the winter no matter what. It is greedy too... It will chase its children away from the area and horde the peanuts for itself. People are the exact same. They store money / gold / etc in the same fashion and will kill each other to mantain that income / stash. Greed powered by fear thanks to DNA. Nothing can "deprogram' that, and it can be irrational at times.

What can be done about this incredible mystery: the puzzling financing of the mujahideen and then the war against Obama bin Laden, the world wide war on terror to root out al-Qaeda and then the support for al-Qaeda…and the most puzzling of all, the unqualified support for Saddam Hussein (Rumsfeld’s promise) and then the drastic war and the search and execution of Saddam?

Mystery solved when one applies the age old formula - who benefits? Answer: the State of Israel - and its warmonger factions in America: propaganda, fundraising, blackmail, and, none dare say it, treason.  It becomes treason when the country is a war - and the neocons insist that it is a war - and one sells out his country for the benefit of another nation.

The assistance the U.S. is providing to Syrian rebels was made public by the Obama Administration, primarily because Romney was starting to make inroads into the question, Who loves Israel more, Obama or Romney?

Now, the sanctions on Iran, as Ron Paul accurately points out, are an act of war. And one wonders just how long the American people will watch the Olympics while their country is being voted away by its purchased legislators.

So to answer the question - Why is the United States assisting groups such as al-Qaeda and initiating severe sanctions on a sovereign country which through observation has a peaceful nuclear program? - it’s because its leaders will support any attack on any enemies of Israel.

Tightening the Noose on Iran : New sanctions on the Islamic Republic stack the deck for war. By Philip Giraldi August 3, 2012 in The American Conservative  (excepts)

Over the past two weeks there has been something like a competition between Republicans and Democrats to see who can do more for Israel by hyping Iran as a threat. Mitt Romney fired the first shot while speaking at the Veterans of Foreign Wars convention in Reno... Barack Obama fired back with a public signing of the United States-Israel Enhanced Security Cooperation Act..

Romney then traveled to Israel, where he declared Jerusalem to be its capital… Obama’s countermove was to send Defense Secretary Leon Panetta to Israel just after Romney departed to reassure the Israelis that the White House is serious about using force against Iran.

Moving on to phase two, Republicans and Democrats together are tightening the screws on Iran. On July 25, the Senate Committee on Foreign Relations hosted a session on “Iran’s support for terrorism in the Middle East” that featured leading neoconservatives Danielle Pletka of the American Enterprise Institute, Daniel Byman of the Brookings Institution’s Saban Center, and Matthew Levitt of the AIPAC-spawned Washington Institute for Near East Policy (WINEP). Six days later, President Obama issued an executive order blocking transactions from several Iranian banks and blacklisting other foreign banks that facilitate the purchase of Iranian oil, while the State Department issued its annual Country Reports on Terrorism for 2011. Announcing the release of the report, Ambassador Daniel Benjamin, State’s Coordinator for Counterterrorism, opined that “Iran is and remains the preeminent terrorism sponsor in the world.” On Wednesday there was a vote in the House of Representatives on the Iran Threat Reduction and Syria Human Rights Act of 2012, House Resolution 1095. It had 364 co-sponsors and passed by a vote of 421 to 6.  It will now go to the Senate where it could well pass unanimously.

It should surprise no one that the American Israel Public Affairs Committee (AIPAC) has been operating to increase pressure on Iran. There has been a series of letters and fact sheets advising Congress on the issue since the first draft of HR 1095 surfaced last year. It is generally believed that the bill was actually written by AIPAC. The following letter was sent to every congressman on Tuesday, on the eve of the vote on the Iran Threat Reduction Act. It was sent out on AIPAC letterhead and was signed by Executive Director Howard Kohr and two other AIPAC officers: (see article for full letter)

July 31, 2012

Vote Yes – The Iran Threat Reduction and Syria Human Rights Act (H.R.1905)

Dear Representative,

We write in strong support of H.R. 1905, The Iran Threat Reduction and Syria Human Rights Act of 2012. The legislation, authored by Representatives Ileana Ros-Lehtinen and Howard Berman, will be considered by the House on Wednesday. We strongly urge you to vote YES…

The letter demonstrates how AIPAC operates, and it makes several points to support its contention that Iran is a major threat, arguments that are either flat-out wrong or greatly exaggerated. Not surprisingly, these arguments have been picked up in the media and by members of Congress and have been repeated nearly verbatim as if they were fact.

The letter boasts of “the strongest set of sanctions ever enacted to isolate any country with which we were not in armed hostilities placing virtually all of Iran’s energy, financial, and transportation sectors under U.S. sanction.” Why? “Because Iran has rebuffed the opportunity for serious negotiations” and it has not complied “with its international obligations and end its nuclear weapons quest.” After the vote, Ileana Ros-Lehtinen, who had co-sponsored the bill, echoed those sentiments, stating that the legislation “seeks to tighten the chokehold on the regime beyond anything that has been done before.” …

Philip Giraldi, a former CIA officer, is executive director of the Council for the National Interest. Full article at>>>

The past policies of the US government has supported dictators throughout the world as a matter of convenience without thinking about what 'blowback" there might be in the future.

We did the same in Afghanistan--supplied weapons and funds to the worst of the worst of the mujhadeen. One being the Taliban that was created by the Pakistan Intelligence service-the ISI.
Where did that get us?

All dictatorial regimes fall, sooner or later, because of their total power that has so corrupted them that they cannot see the proper solution.

The leaders of countries that we support should be non-totalitarian, ethical, educated, and knowledgeable.
