Supreme Court Judge Bars Protesters From Zucotti Park, Denies Restraining Order

Tyler Durden's picture

Not quite the outcome expected by the shower-impaired crowd:

  • OCCUPY WALL STREET' PROTESTERS BARRED FROM PARK, JUDGE RULES
  • OCCUPY WALL STREET' PROTESTERS RESTRAINING ORDER DENIED
  • NEW YORK JUDGE RULES AFTER POLICE FORCIBLY REMOVED PROTESTERS

So... now what?

All they bring to the table is their own demise, as they make the incoherent demand that criminals stop being criminals and act on their behalf. Except they don't realize the extent of the criminal syndicate. Or if they do, they believe they can fix it, making the criminal facade function as a beneficial social system.

Here's a test. Go to your local occupation and look for this flyer.

This just lets both sides save face.  The cops and Bloomberg can say they restored the peace, and the protestors can disband until spring, when it will be better weather for protesting against social injustice.

Win win situations are so bullish.  I'd say BTFD, but there won't be any more dips ever again after this.

Nice idea.

In the absence of a firm leader, who could give a coherent statement of purpose, it was bound to be nothing more than a camp.

The reality is any movement requires a leader. It also requires an astute understanding of the issues, particularily the interconnected way finance and governement work today. I saw nothing to suggest that this collection of people had the understanding required to make this an actual movement with purpose.

To bad.

Tue, 11/15/2011 - 18:15 | 1880502 dexter_morgan
dexter_morgan's picture

Hopefully I am wrong, but sometimes I get the feeling that the lack of purpose and coherent statements was intentional. What would be the benefit of that? Draw you own conclusions as this all plays out.

Or perhaps its just that there were too many differing opinions about what is the cause and solution to the crony capitalism we live under. Is it more government control, which ultimately leads to less individual freedoms, or getting the government out of the way so to speak and letting Wall Street and other corporate entities bear the failure of their faulty decision making and wasted investment?

I'm not in any way smart enough to know the all the answers, but seems to me that the FRB is the oil that greases the palms of the crony capitalists and elected officials, and perhaps if the focus was on bringing their role and actions to light 9and to end) it would have gone farther. Who knows.

Sadly, this peaceful movement may be over, or worse yet, the next iteration won't be as peaceful.

In the debate ZH covered last night, Krugman said (and I am not joking or sarc phrasing) "Everyone is concerned about the deficit. What is the point of having a surplus? What would the nation do with it unless we had an alien species to export to?"

I am not joking. he said that. I would find the exact minute second mark but they took the video down.

A Nobel PhD in economics cant figure out a reason to not run a deficit. I am one of the dumbest people in the world, but I was thinking, "Hey if we had a surplus, we could lower taxes on american citizens. The Aliens didnt complain when the US has surpluses before"

I watched it and I believe you are incorrect.  While I dislike the philosophy of Krugman and will insult him I do prefer to be honest.  I believe during his opening statement he was discussing the flow of goods and the U.S. would need another planet to sell to because there are no places indcluding emerging economies that the U.S. can create a surplus to sell to.  It was more a comment about the current global problem as compared to the Japanese lost "duodecade" (my word not his).

Tue, 11/15/2011 - 23:58 | 1881542 wisefool
wisefool's picture

I am willing to stand corrected, but I dont think he purely meant a trade surplus. his whole speil is stimulus through deficit spending so that nations would be enticed to repatriate the dollars to america buying our "surplus goods" which is primarily a service economy and real estate.

We tried this trick before on the japanese. they bought high end real estate here, but then had to sell it all back a drastically reduced prices. The chinese are not going to fall for that trick again. whether here or in europe. When they do start using their USD/UST/EUR they are going to buy assests that produce a high ROI and have low taxation/nationalization risks.

Again, I am willing to stand corrected and will try to find the video/transcript.

At about the 31 min mark Krugman's opening statement.  He discusses that during Japan's downturn they could pull themselves out of it by exporting to more prosperous nations which, in the debate comparison, the U.S. doesn't have as a luxury unless they find another planet to sell to.

Everywhere else in the civilized world "Supreme Court" means the highest and final court, but in New York it means the lowest trial court.

Why? You ask? Because 100 years ago when Supreme Court judgeships were given as favors to friends of Tammany Hall everyone wanted to be a Supreme Court Judge. So they changed the name of the trial courts (circuit courts in most places) to Supreme Courts, and they made the highest court of New York the Court of Appeals.

Political corruption, it's a way of life!

Point well taken about the not so Supreme Court's odd name.

One other point of local color - although the park is privately owned, there is an easment in favor of public use 24 hours a day, which is broader than the rules governing publicly owned public parks.  New York City often requires a developer to do something like this in exchange for permission to do something like build a taller builder than the zoning rules would normally allow, or to block off a public alleyway.

So Bloomberg FINALLY grows some balls.  He should have ordered the NYPD to clear these libtard hippies out of that public space months ago.   If he's shown some resolve back in September,  like police in Australia and elsewhere,  these lazy, dirty clowns would never have been to generate as much unwarranted attention as they have.   If the NYPD had busted a few heads early on these little cry-baby 'occupiers' would have run sraight back home to mommy and daddy and people who live and work around Wall Street would have been able to get on with their lives without having to put up with this noisy, smelly disgrace.

Lets be clear:  these 'protesters' don't understand capitalism at all.   To them Jamie Dimon and Llloyd Blankfein are some sort of anti-christs -whereas the reality is that these guys provide the liquidity that keeps our system working, and sustains our standard of living.   But 'working' is something these punks will never understand.

No, that is communism for the loser wealthy elite  F*ck that.  Look Wall Street should have failed, Lehman failed, majority of America failed but Wall Street didn't...it gamed the system/government and the people.  The banks should have been broken up, restructured and reset.  Till the next boom.  Didn't happen.  The next bust, which is very very soon will obliterate Wall Street and yes, they will go to Congress again and ask for cash.  Whilst you and others struggle to cover overhead costs, fuel, lifestyle or whatever.  You think that is fair?

Zuccotti Park is privately owned. I realize that OWS protestors reject the ownership or creation of any private property (not just land), but at the moment we are still living in the United States of America.

The owners have Improved this place to make it a nice park for which there is public access. We don't have to pay a dime to enjoy the place. But that doesn't make it ours.

Yes, I realize they have a contract with the city and that differentiates this private ownership from your own backyard. If your argument is with their contractual obligations then you should argue the points in the contract specifically.

Right, because the OWS crowd is so much worse than the 350LB, IQ75, food stamp guzzling, backwater baby factories that exist in the US like in WV. But some young, out-of-work folks go and protest the banking industry and they're the scumbags that need killin'. Riiiiigggghhhht.

And instead of seeing an opportunity to educate, as in, the enemy of my enemy is my friend, you deride them and call them hippies. And you know, most of them weren't even alive when that hippie ball got rolling.

Too bad it's boiling apathy. My son's girlfriend is all into OWS, so he's been to the local occupation a few times. His attempts at discussing fiat, fractional-reserve banking and sound money have gotten nowhere (eyes glaze over). If he mentions gold or silver, he's suddenly one of the evil 1%, and thus ignored (or talked over).

They actually went to Zucotti for the weekend, so it will be interesting to hear his contrast between the two events. Even better so, since she wanted to go "where people were doing something real" instead of the sitting around bickering they saw at the local general assembly.

Looks grim.  One enormous long-term problem is that there are just too many people.  After the Black Plague, there were suddenly a lot fewer workers in Europe.  Therefore, due to the Law of Supply and Demand, with the supply of workers being low and the demand virtually the same (due to wars), the workers who survived suddenly had a lot more bargaining power, which they immediately used to get much more freedom.  Nowadays, planetary population is increasing by many millions every year, so that the supply of humans keeps increasing.  At the same time, due to mechanization and computerization, the demand is not increasing.  So, in accordance with the Law of Supply and Demand, humans become worth less every year.  That makes it easier every year for elites to push workers further and further down.  And, one might notice, many so-called "churches" have long acted and are still acting in the interest of elites, and against the interest of workers, by telling workers to do the things that increase population ever more: have lots of babies, and don't use contraception or abortion.

Underpopulation - The Real Problem

In 2010, the UN Population Division (UNDP) found that 79 countries, including 36 in the less developed world, had fertility rates that were below the level needed to ensure the long-term survival of the population. Most of the rest, the agency warns us, are likely to enter this danger zone over the next few decades. In this prediction, the UNDP is certainly correct.

According to the agency’s “low-variant” projection, historically the most accurate, by 2050 three out of every four countries in the less developed regions will be experiencing the same kind of below-replacement fertility that is hollowing out the populations of developed countries today. Such stark drops in fertility, cautioned the UNPD, will result in a rapid aging of the populations of developed and developing countries alike. With the number of people over 65 slated to explode from 475 million in 2000 to 1.46 billion in 2050, existing social security systems will be threatened with collapse. It will prove difficult, if not impossible, to establish new ones.

These sobering projections show that the population of the world will continue to creep up until about the year 2040, peaking at around 7.6 billion people. This is only a fraction more than the almost seven billion that the planet supports at present. Then the global population implosion, slow at first, but accelerating over time, begins. We fall back to current levels by 2082, and then shrink to under 5 billion by the turn of the next century. That population will be much older than we are today.

This is the real population crisis. This population implosion, by reducing the amount of human capital available, will have a negative and dramatic impact on every aspect of life.

/Stop beating around the BUSH.  1913 was the turning point of our country...  the FEDERAL RESERVE and the ZIONIST that cooked it up.  If you do a careful analysis of WAR FINANCING throughout recent history, you get an indisputable picture of just who and what theoligy has usurped our CONSTITUTIONAL REPUBLIC.  The MIXING is not the problem as much as it is the SCAMMING BANKING FAMILIES.  The MIXING is part of the recepi for what we have today however...  " DEVIDE AND CONQUER"

History shows us the FIAT money never lasts very long..  Fiat societies also do not survive very long.

The difference this time I sence is that we have the INTERNET and the like of Dr Aln Sabrosky, Dr Norman Finkelstein, Dr Shlomo Sands, Dr July Woods, Dr Ron Paul and Dr LOVE!!!

To put it directly and to the point...   If we need to rid ourselves of money monopolies like the Federal Reserve and not allow manipulation to occur in our courts such as what we have now...  three out nine supreme court judges are Jewish , Zionists and it was a Jewish judge that allowed the Israeli mossad agents arrested on 9/11 to be deported to Israel without much fuss...  even though they blew up a car-bomb on King st NYC.

So it is not so much MIXING it is WE THE PEOPLE being total idiots and allowing ourselves to be manipulated with floride ease.

I'm confused a little here, are the protestors banned from the park or just not allowed to set up a tent city?

There are always limits to free speech (yelling fire in a crowded theater, etc) so are they just saying they can't take up residence there but can continue to protest, or that they cannot be in the park period?

This is a constitutional issue – the right to assemble and the right to protest; and this action has been taking place on public property. If private landowners in New York have issues and are trespassing on private property, that’s one thing. But neither Mayor Bloomberg nor any other single individual owns the park; it’s a public park.

Michael Stallman with his 25 years on the bench needs to learn the Constitution.
