The bottom line from the WSJ:

A quick overview of the ruling: A divided Supreme Court upheld the constitutionality of the Obama administration’s health-care law, in one of the most anticipated high-court rulings in a generation. The court said Congress was acting within its powers under the Constitution when it required most Americans to carry health insurance or pay a penalty—the provision at the center of the two-year legal battle. It upheld the mandate as a tax, in an opinion by Chief Justice John Roberts.

 

The ruling is a victory for Democrats and President Barack Obama, who had passed the biggest reworking to the health system since the creation of Medicare in the 1960s and faced the prospect of the court nullifying their effort. It also averts disruption for hospitals, doctors and employers who have spent more than two years preparing for changes in the law.

 

Even as the law’s fate was in doubt, the administration moved ahead with implementing its provisions. It has been negotiating with states to set up exchanges where consumers can buy subsidized insurance policies and sign up millions of lower-income Americans for Medicaid. Some states, including Florida and Texas, refused to cooperate because they expected the law to be overturned.

 

For Mitt Romney, the high court\’s decision basically means he won\’t have to change his stump speech. Expected to speak later today, Mr. Romney is sure to promise to repeal the law if he\’s elected. It also means he\’ll face less pressure to offer specifics on what he\’d replace the law with — a positive for a campaign that tends to shy away from details.

More from inside the court, from our Brent Kendall, who will be going through the ruling line by line: The court’s ruling is largely a victory for the Obama administration.  The court’s 59-page opinion rejects the government’s primary argument that Congress’s power to regulate interstate commerce gives lawmakers the authority to require citizens to buy insurance or pay a penalty.  But the court goes on to uphold the insurance mandate on other grounds.  “It is reasonable to construe what Congress has done as increasing taxes on those who have a certain amount of income, but choose to go without health insurance,” Chief Justice Roberts writes.  “Such legislation is within Congress’s power to tax.”

To force someone to buy something is to deny the right to using their own labor and property which is expressed as money. To me that's probably the most scary part of this whole ruling.  The Supreme Court felt it was necessary to define it as a tax when no other court below it would.  They have just opened up the Pandora's box of 'penalties as taxes'.  They have just greenlighted the wet dream of every piece of shit in government that wanted to further ram down the throat of the public 'what's best for us'.  Fuck.

In order for the Mandate to become a Tax, it has to be brought before Congress AGAIN.

I'm sure I'm already on a number of lists, but that thought crossed my mind as I was posting it.

To the US Govt, "tyranny" (which the Founders revolted against), like "terrorism," is, by definition, incapable of being carried out by the US Govt. The govt. defines terrorism as countries or groups  acting against American interests and engaging in violence against civilians for political gain.

Thus, when "scary Muslims" kill US citizens, they are "terrorists." But when Obama kills civilians in drone strikes for political gain, he and the US Govt are merely protecting American interests, not engaging in terrorism.

Likewise, it seems to me that the abuses we face today are at least equal, if not more attrocious, that those the Founders railed against as tyranny and despotism. Yet, because the abuses we endure are perpetrated by the institution designed to protect our interests, the thought of rebelling against such abuses like the Founders did seems almost unspeakable to the general public. We are taught to believe that, like terrorism, tyranny can only come from outside forces. This, of course, is completely naive, but the vast majority of the general public has swallowed it hook, line, and sinker.

Then again, it's estimated that only about 40% of the colonists supported the Revolution. It may have even been less. The point is, tyranny is tyranny, and there comes a point where a larger enough chunk of the population wakes up and realizes that enough is enough. The words of the Declaration, as ominous as they may be to TPTB, stand as true today as they did when they were written. The only difference is that this time the threat is coming from within our own government. This doesn't change the fact that our interests are no longer represented and the abuses continue to pile on. When will we say, ENOUGH IS ENOUGH?

Your point in your third paragraph crossed my mind, too. The infringements and abuses the founders faced were in many ways less that what we endure today. I do not have troops in my home...yet, but most other freedoms are gone. I do believe there are many who want to fight this or who would like to peaceably take a few states and reestablish a government based upon inalienable rights. The fundamental problem I see is that most Americans today, even conservatively oriented do not dispute the government's right to rule and make rules in all aspects of life. They do not recognize a government limited to common defense and the protection of liberty and individual rights. They cannot conceive of a life where you don't even think about government as a daily factor in your life, creating and tweaking all sorts of rules, benefits and economic outcomes for the collective good.

I think the revolution was actively supported by less than a third depending on what you read. However, the middle third watched passively while a third supported the King. Most of life breaks down that way...a third for, a third against and a third undecided or confused.

fascism and communism are kissing cousins. In the former you have ostensibly privately owned means of production, but in practice, the state imposes such tight regulation that the 'private' nature of private institutions is a sham. The state dictates who can be hired, at what wage, what goods can be sold, and at what price. Consumers are left with no choices because the state imposes cartels and price controls.

'Bureaucrats' in communist countries vs 'industrialists' in fascist ones... in both systems you have an oligarchy completely controlling the economy. It's a distinction without a difference.

Fascists tend to be nationalists, whereas communists are internationalists. That's probably the biggest real difference between the two.

What if the folks in Boston on 16DEC1773 had decided, “Well, standing on this street corner is against the law, so we’re going to just disperse like the soldiers/cops are telling us to?” To this day, particularly in regard to the O.C. attack on the protestors seated on the campus sidewalk by uniformed LEOs, I believe those students would have been completely justified, morally, in standing up and kicking the ever-loving-dogshit out of the officers doing the spraying. “The officers were in fear of their safety!” Bullshit! I’ve been in fear of my safety. I’ve seen others in fear of their safety. Those Stasi-wannabe stormtroopers were not at all in fear of their safety. They reveled in the chance to assault those “dirty, smelly, hippies,” with no threat of repercussions.

 

The pending legislation in the form of SOPA and PIPA are affronts on this amendment as well. The recent case of a judge legislating from the bench that only the “authorized” press is protected is further proof that the government no longer feels obligated to provide the protections provided by the first amendment.

I have met several and know several who are trying to get in and on average they seem less moral than most I know these days. I personally believe they are prepared to serve a totalitarian state in many ways. An example would be that ALL police officers speed routinely...all of them unless they are desk jockeys. Yet, they line you up in speed traps for the purpose of revenue. The courts add on court costs to pay their salaries and then start processing the newest revenue source, the red light camera tickets. Now we will add people not paying their healthcare "tax". They will be processed right next to the people who refuse to buy auto insurance. Last time I was in traffic court it was $1000 for no car insurance with half waved if you got it in 30 days. I expect the same for health insurance.

The point is that they know there is no particularly moral aspect to the law. It is a game and they have the authority and guns. To preserve themselves about two thirds will turn those guns on you...and just say it it simply their job, nothing personal you understand.

N. Korea survives because "law enforcers" are willing to kill their fellow citizens to preserve themselves. It has always worked this way.

I do not think I could be in law enforcement these days unless I was a local small town sheriff in Mayberry. There I could keep a lid on the true bad guys, refuse all speed traps unless someone is actually being dangerous and tell other LE to get the hell out of my jurisdiction...or I will have Barney put that damned bullet in his gun.

The constitutional republic was laid to rest on 9/11/2001.  They're just mopping up a few niches now.

This is not so different from the requirements, mostly enacted in the last 50 years, that legally requires one to have   automobile insurance.  Now the insurance companies, in partnership with the state, have increased the premiums dramatically and they use the state's police power to make sure you pay whatever they decide you should pay.  Competition is minimal.  The same thing is evolving out of the partnership between the state and the health insurance industry.  It's all about controlling and shearing the sheep.
