The bottom line from the WSJ:

A quick overview of the ruling: A divided Supreme Court upheld the constitutionality of the Obama administration’s health-care law, in one of the most anticipated high-court rulings in a generation. The court said Congress was acting within its powers under the Constitution when it required most Americans to carry health insurance or pay a penalty—the provision at the center of the two-year legal battle. It upheld the mandate as a tax, in an opinion by Chief Justice John Roberts.

 

The ruling is a victory for Democrats and President Barack Obama, who had passed the biggest reworking to the health system since the creation of Medicare in the 1960s and faced the prospect of the court nullifying their effort. It also averts disruption for hospitals, doctors and employers who have spent more than two years preparing for changes in the law.

 

Even as the law’s fate was in doubt, the administration moved ahead with implementing its provisions. It has been negotiating with states to set up exchanges where consumers can buy subsidized insurance policies and sign up millions of lower-income Americans for Medicaid. Some states, including Florida and Texas, refused to cooperate because they expected the law to be overturned.

 

For Mitt Romney, the high court\’s decision basically means he won\’t have to change his stump speech. Expected to speak later today, Mr. Romney is sure to promise to repeal the law if he\’s elected. It also means he\’ll face less pressure to offer specifics on what he\’d replace the law with — a positive for a campaign that tends to shy away from details.

More from inside the court, from our Brent Kendall, who will be going through the ruling line by line: The court’s ruling is largely a victory for the Obama administration.  The court’s 59-page opinion rejects the government’s primary argument that Congress’s power to regulate interstate commerce gives lawmakers the authority to require citizens to buy insurance or pay a penalty.  But the court goes on to uphold the insurance mandate on other grounds.  “It is reasonable to construe what Congress has done as increasing taxes on those who have a certain amount of income, but choose to go without health insurance,” Chief Justice Roberts writes.  “Such legislation is within Congress’s power to tax.”

It is interesting that apparent majority here (at ZH not USA) can clearly see the dire situation we are all in, how we got here and who the culprits are, yet fail to connect the dots to Milton Friedman’s ideology (hidden under catchy abstract phrases like free-markets etc.). Instead they blame socialism, communism, unions, people on food stamps, unemployed, opposing political parties, etc.

What’s happening around us is a series of crisis and the Chicago Boyz never ever let a good crisis go to spoil. The people behind them own the media, they own the education system and the above mentioned political parties. Every time when their policies prove disastrous (and they always do) they blame whom? Why, everybody who’s not them. And apparently it works. Even here.

Hey, Meathead, I work in the industry, too. Let me ask you who set up this system? The government sets the rules, gives all the advantages to insurers and employers and demands lowest prices. Therefore, the cash guy actually has to pay the most so everyone else in the system can be assured they are getting steep discounts. Until recently doctors were not allowed to treat uninsured for free or reduced, right?!? Yes, you know this. If you treated cash patients for a lower price it would negate your contract or you had to treat the HMO patients for the same price, right? Government demands the lowest prices on everything from services to meds. So, if a pharma company gave free meds to the hospital to start patients on then the government had to get all their meds for free, too, right? Yes!

If healthcare is a right then you can walk in anywhere and demand another person serve you without payment. So, it is okay if they go bankrupt fulfilling your theoretical right. It's not a right because it makes slaves out of the providers.  

I will happily go to Texas with my "fucking tards" friends. We will live a life free of redistribution and government intervention. You will actually own your property, keep your money, save or  not save for retirement and have to honorably negotiate with your healthcare providers as to services and prices.

You go to your government controlled utopia with all your "rights" and free stuff. Let's meet in 20, then 30 then 50 years and see who is doing better, okay? All you other libertarian fucktards please join me in Texas or somewhere similar. I expect John Gault will be sitting with us.

This is actually a good outcome.

The decision was made based on current jurisprudence. This is positive for the legitmacy of SCOTUS. Interesting that is was the Chief Justice who recognized that the legitmacy of the Court was at stake here.

NOW IF YOU HATE THIS LAW it is up to the legislative branch to repeal it. IT IS NOT PROPERLY A FUNCTION OF SCOTUS to act in an extra-legislative manner.

Btw, i an not an Obama supporter. I am a supporter of the rule of law and the old fashion notion that it is the cornerstone of democracy.

If you don't want the law, than ensure the legistlative branch repeals it.

Can we stop acting like it's the first time an industry lurched towards consolidation to the detriment of the individual, with token obstruction from the federal govt?

As far as the Spectrum is considered, left and right can claim victory because 1) the left needs any affirmation they could possibly get and 2) the Right needs a good "solid" straw man going into the presidential election.

I'd love to wordle the language of the decision to see how many times the word "tax" is used.  The Right's collective dong should engorge incrementally each time that magical word appears.  And, this makes Romney's chief shortcoming as far as Right planks are concerned - universal health care in Mass. - as dwarfish by comparison.  Obama's left screwed this up before Romney could ever have.  So there.

Meanwhile, the mold that is JP Morgan's loss was glossed over, News Corp spins out, and Republican's sued for unlimited campaign contributions.  Europe is still fucked up.  I imagine something is happening in Syria / Iran theater to the tune of quiet capitulation.

Personally I think the health care bill was extra-vilified by the Koch brothers as a stalking horse to kill their real target: cap and trade legislation.  No early Tea Party rant or website failed to invoke both, and honestly the business community never really gave a shit about this health care crapola (more than, say, the minimum wage).  But climate change, that was going to pass when both Presidential candidates were supporting cap and trade, just four years ago... and that had to be stopped.

So this Obamacare hullabaloo was primarily to rope in folks as foot soldiers.  Cap and trade is dead, so really they already won.  This isn't the main event.

But maybe that's just me.

This was a joke anyway.  I admit, the law was poorly written and resulted in litigation which went to the supreme court.  If the law would hav been written to raise a flat tax on everyone for (some TBD amount) and the proceeds used to buy insurance for people who qualified and also allow a tax credit (in the amount of the flat tax) for those who already had insurance, this would have been done already.

This is the slippery slope of the nanny state...  once the government injects itself into the market (in this case paying for peoples' healthcare), it then can justify expansion into ancillary areas (requiring all to have insurance so that, conceptually, the government's share is less burdensome).  Same thing will happen with mandating the food eaten by snap recipients...  smoking...  what activities are "too dangerous" to be covered...  etc... 

until, of course, central planning meets its inevitable conclusion.

I went to the ER in 1992 for a laceration, was there for an hour, bill $80. Went to the ER for a laceration three months ago, didn't need stitches and got dermabond. COST $1800!!!!

For profit healthcare works when there is no insurance and lawyers are kept away. You kill private practice and focus on centralized medicne and this is what you get.

Seriously?  The insurance company executives all just lit Cubans and opened up the good scotch.  They now have access to the money of all those who previously couldn't afford insurance.  (They still can't afford it, but now they have to.) That's 50 million or so more people giving them money, and the best part is, they don't have to do the enforcing, since the government is holding the gun.
