The bottom line from the WSJ:

A quick overview of the ruling: A divided Supreme Court upheld the constitutionality of the Obama administration’s health-care law, in one of the most anticipated high-court rulings in a generation. The court said Congress was acting within its powers under the Constitution when it required most Americans to carry health insurance or pay a penalty—the provision at the center of the two-year legal battle. It upheld the mandate as a tax, in an opinion by Chief Justice John Roberts.

 

The ruling is a victory for Democrats and President Barack Obama, who had passed the biggest reworking to the health system since the creation of Medicare in the 1960s and faced the prospect of the court nullifying their effort. It also averts disruption for hospitals, doctors and employers who have spent more than two years preparing for changes in the law.

 

Even as the law’s fate was in doubt, the administration moved ahead with implementing its provisions. It has been negotiating with states to set up exchanges where consumers can buy subsidized insurance policies and sign up millions of lower-income Americans for Medicaid. Some states, including Florida and Texas, refused to cooperate because they expected the law to be overturned.

 

For Mitt Romney, the high court\’s decision basically means he won\’t have to change his stump speech. Expected to speak later today, Mr. Romney is sure to promise to repeal the law if he\’s elected. It also means he\’ll face less pressure to offer specifics on what he\’d replace the law with — a positive for a campaign that tends to shy away from details.

Explain to us all how that has changed.   Cost will still be the same, so what NOW will happpen is:

 

1)  The gov't doesn't pay the providers for the treatement so the providers stop giving the treatment

2)  Perhaps the gov't eats the cost of the treatment and we have the economic collapse at the mid of 2013 instead of 2014, but looking at other socialized medicine models, this doesn't happen.   You will be denied.

3)  You wait 6 months to a year to see an MD to treat the disease because most MD's will have quit and few are going into medicine any more anyways.   Then a gov't bureaucrat will decide the disease is too advanced to justify paying for treatment so you can opt to pay out of pocket assuming the drug manufacturer is still making the drug that is no longer paid for.

 

YAY ?!?!

 

By the way, ask Greece how their standard of living is right now.   I'd avoid asking the one's who are literally starving to death right now, I'd avoid asking the farmers who are giving away free food to keep people from dying, I'd avoid asking medical personnel because they've run out of medical supplies in virtually every hospital, and I'd avoid those who are losing power because power plants are not getting payments so power is being shut down.   Rockin system you got there buddy.

I am going to break your world model a little more. I work in a part of the healthcare field and I can assure you that medical care in socialist Europe is directly and indirectly subsidized by the USA. Everyone who even thinks about developing a medicine, a new MRI machine or a way to do remote surgeries is thinking of the free-er market of the USA and how much narrower their profits...if any will be in various European countries. If Europe was the only market you'd have less than half the stuff you have now. Europeans are sort of medical welfare states.

I will also tell you that the private insurance system also indirectly subsidizes our current government system. A nursing home cannot make squat on the government plans but the private plans pay enough to get them some margin. It works the same in medical offices, hospitals and pharmaceuticals. You make your money in the free market and then can suffer the crappy reimbursements the government mandates by law.

You actually reflect the problem of collectivist societies, namely that everyone thinks they really know everyone else's business. We all think we know plenty about oil and energy delivery, car production and EPA rules, medicine and healthcare delivery, etc. You don't. They are all complex systems that should be left alone. The market will find the right prices, quantities and qualities of goods and services. Government warps them out of all recognition. There is a profound arrogance inherent in central planning.

You couldn't be farther from truth. I can tell you that neither me nor any of my children nor any of my friends and their children has been to state hospitals lately.

Everyone who can afford it pays cash to private doctors here ALTHOUGH we are all being forced to pay state healthcare insurance. The system is so corrupt and providing such a lousy service you don't want to experience.

But it is perfectly understandable. When you remove natural mechanisms of wealth distribution and competition and IMPOSE monopolies, taxes and insurances sooner than later you get corruption. In time the entire society is corrupt in one way or another (not because of public healthcare alone, but due to all such practices).

I'm an MD, and here's what I can say to those here.   Good luck finding an MD in the future.   Get a dual citizenship with Canada now because the wait to see an MDthere will be much shorter than what is coming to the USSA.   As bad as anyone here thought Obamacare MIGHT be, it will be much, much MUCH worse.   Few here truly understand the consequences of this decision as far as it impacts quality and delivery of health care, and this is one of the most educated reader populations I have encountered.

I work with alot of Doctors ..... you ain't seen nothing yet ....

these men & women make a lot of sacrifices and have become litigation pinatas.  No one in their right mind can now advocate their son or daughter go into the medical profession ...even if you want to help others ..... but that is what the Left wants to do .. tell everyone what they must or must not do ... according to their enlightened elitest and most often corrupt purposes. See the fact that Chicago has been the largest segregated urban area in USA for decades with the resulting annual slaughter of African American innocents (children) .....but not one academic or 'news' organization can examine this fact (go read Mike Royko's classic, "Boss" if you doubt this assertion!) ..... just so one political party can suffocate the town/state.

I am a lawyer by background (among other more financially oriented credentials/licenses .... lots of tests and CE, etc.) ... thank you legal profession for smothering the economic energy of this country under 'policy' add-ons & enhancements.  All my entrepenurial impulses are eliminated now ..... and I refuse to become a crony capitalist which is the only path forward now .....

I work with a lot of physicians, as well. When the teeth kick in many are going to retire. They don't want the required EMR systems, the paperwork, hassle, lower reimbursements, longer hours, unreimbursed work, etc.

I believe entrepreneurs of all sorts are going to reevaluate America as a preferred place to start or expand businesses.

There is a similar trend in England.  The doctors work Mon-Fri for the gubmint, on Saturday they do elective cases for those who can pay out of pocket and don't want to wait.  Market forces will insert themselves into any universal healthcare plan Congress can invent.  It will quickly morph into a two tiered system separating the haves and have nots.

Did government invent doctors, their training, medicines, MRI machines, water test kits, fire engines, etc.? They don't even invent tanks, planes or rifles we use in war! Know why government could not close the oil well at the bottom of the gulf? Because they didn't know how! They did not know how to do Medicare and Medicaid except for the fact there was private insurance out there for them to copy and modify!

Even law enforcement and security can be private. We hire a sheriff to protect our lives and property as an efficiency to doing it ourselves. We make voluntary trades with our expertise and training. You do to medical school and take care of me and my family and I will grow corn and cattle to feed yours. Instead of trading beef for healthcare we trade money which represents our labor. It's a perfectly honorable system. I cannot force the doctor to treat me for free and he cannot force me to give him for food for free. However, out of compassion I might share my food if he needs it and he might share his medical knowledge if I am short on cash. Charity is also honorable and there is no coercion. In fact, there is real gratitude. Ever see a welfare recipient gush with gratitude to anyone or do they just demand more?

I know people don't want to hear is but the law is constitutional, the oral arguments did not focus in on the issue.  The oral arguments did not focus in that they are just adding a tax on top of the existing tax code.  Only those subject to the IRC are subject to the provision.  Now, the assumption is everyone is subject to the IRC but this is false, the US Treasury does not issue determinations as to your taxable status which a hearing can be provide pursusant to the APA.   

There is only a mandate for the people subject to the code.  The US treasury does not provide any determination of your status.

Sec. 7852. Other applicable rules

(a) Separability clause If any provision of this title, or the application thereof to any person or circumstances, is held invalid, the remainder of the title, and the application of such provision to other persons or circumstances, shall not be affected thereby.
