US Totalitarianism Loses Major Battle As Judge Permanently Blocks NDAA's Military Detention Provision
Back in January, Pulitzer winning journalist Chris Hedges sued President Obama and the recently passed National Defense Authorization Act, specifically challenging the legality of the Authorization for Use of Military Force or, the provision that authorizes military detention for people deemed to have "substantially supported" al Qaeda, the Taliban or "associated forces." Hedges called the president's action allowing indefinite detention, which was signed into law with little opposition from either party "unforgivable, unconstitutional and exceedingly dangerous." He attacked point blank the civil rights farce that is the neverending "war on terror" conducted by both parties, targetting whom exactly is unclear, but certainly attaining ever more intense retaliation from foreigners such as the furious attacks against the US consulates in Egypt and Libya. He asked "why do U.S. citizens now need to be specifically singled out for military detention and denial of due process when under the 2001 Authorization for Use of Military Force the president can apparently find the legal cover to serve as judge, jury and executioner to assassinate U.S. citizens." A few months later, in May, U.S. District Judge Katherine Forrest ruled in favor of a temporary injunction blocking the enforcement of the authorization for military detention. Today, the war againt the true totalitarian terror won a decisive battle, when in a 112-opinion, Judge Forrest turned the temporary injunction, following an appeal by the totalitarian government from August 6, into a permanent one.

The permanent injunction prevents the U.S. government from enforcing a portion of Section 1021 of the National Defense Authorization Act's "Homeland Battlefield" provisions.
The opinion stems from a January lawsuit filed by former New York Times war correspondent and Pulitzer Prize winner Chris Hedges and others. The plaintiffs said they had no assurance that their writing and advocacy activities would not fall under the scope of the provision.
Government attorneys argued that the executive branch is entitled to latitude when it comes to cases of national security and that the law is neither too broad nor overly vague.
"This court does not disagree with the principle that the president has primacy in foreign affairs," the judge said, but that she was not convinced by government arguments.
"The government has not stated that such conduct - which, by analogy, covers any writing, journalistic and associational activities that involve al Qaeda, the Taliban or whomever is deemed "associated forces" - does not fall within § 1021(b)(2)."
What is ironic, is that in the ongoing absolute farce that is the theatrical presidential debate, there hasn't been one word uttered discussing precisely the kind of creeping totalitarian control, and Orwellian loss of constitutional rights, that the biparty-supported NDAA would have demanded out of the US republic. Why? Chris Hedges said it best:
The oddest part of this legislation is that the FBI, the CIA, the director of national intelligence, the Pentagon and the attorney general didn’t support it. FBI Director Robert Mueller said he feared the bill would actually impede the bureau’s ability to investigate terrorism because it would be harder to win cooperation from suspects held by the military. “The possibility looms that we will lose opportunities to obtain cooperation from the persons in the past that we’ve been fairly successful in gaining,” he told Congress.
But it passed anyway. And I suspect it passed because the corporations, seeing the unrest in the streets, knowing that things are about to get much worse, worrying that the Occupy movement will expand, do not trust the police to protect them. They want to be able to call in the Army. And now they can.
He is 100% correct, and today, if it weren't for his lawsuit, the saying that someone, somewhere in the world might possibly "hate America for its liberties" would have been the biggest lie conceivable.
Also, the total fascist takeover of America would now have been a fact.
Some other insights from Hedges, who explained back in January, just why he is suing Barack Obama:
This demented “war on terror” is as undefined and vague as such a conflict is in any totalitarian state. Dissent is increasingly equated in this country with treason. Enemies supposedly lurk in every organization that does not chant the patriotic mantras provided to it by the state. And this bill feeds a mounting state paranoia. It expands our permanent war to every spot on the globe. It erases fundamental constitutional liberties. It means we can no longer use the word “democracy” to describe our political system.
The supine and gutless Democratic Party, which would have feigned outrage if George W. Bush had put this into law, appears willing, once again, to grant Obama a pass. But I won’t. What he has done is unforgivable, unconstitutional and exceedingly dangerous. The threat and reach of al-Qaida—which I spent a year covering for The New York Times in Europe and the Middle East—are marginal, despite the attacks of 9/11. The terrorist group poses no existential threat to the nation. It has been so disrupted and broken that it can barely function. Osama bin Laden was gunned down by commandos and his body dumped into the sea. Even the Pentagon says the organization is crippled. So why, a decade after the start of the so-called war on terror, do these draconian measures need to be implemented? Why do U.S. citizens now need to be specifically singled out for military detention and denial of due process when under the 2001 Authorization for Use of Military Force the president can apparently find the legal cover to serve as judge, jury and executioner to assassinate U.S. citizens, as he did in the killing of the cleric Anwar al-Awlaki in Yemen? Why is this bill necessary when the government routinely ignores our Fifth Amendment rights—“No person shall be deprived of life without due process of law”—as well as our First Amendment right of free speech? How much more power do they need to fight “terrorism”?
Fear is the psychological weapon of choice for totalitarian systems of power. Make the people afraid. Get them to surrender their rights in the name of national security. And then finish off the few who aren’t afraid enough. If this law is not revoked we will be no different from any sordid military dictatorship. Its implementation will be a huge leap forward for the corporate oligarchs who plan to continue to plunder the nation and use state and military security to cow the population into submission.

It's indisputable that the US Govt is a monstrous and insane global mass-murderer, the evidence for it is overwhelming. The only real difference here with regard to other major fascist war-mongering states is that the US has not yet been punished or held to account or it's leaders executed for their numerous violent crimes and war-making against the peace of our world, and against civilised behaviour.

I think if you want to be technical, "totalitarian" is an adjective applied to governments, and "terrorism" is only ever used to describe actions commited by NON-government actors. Meaning: it's not called "terrorism" when the BATF lands a death-squad on your roof, but it is "terrorism" when a guy throws a brick through the window of city hall.
The USA is certainly a totalitarian state, though. Go ahead and refuse to consent to a search when a cop wants to frisk you and see how it all plays out. If you survive (which is still reasonably likely if you're "white"), you'll be introduced to a whole new set of rules about life in Murka you may never have known about before.
I'd love the believe that somewhere, checks and balances are still working; that somewhere there are still reporters reporting the real news and fighting for the freedom of the press; and that somewhere there is a judge or two courageous enough to check the ever increasing reach of the executive branch. Congress didn't drop the ball, they licked some. It seems that the judges are our only hope in terms of protecting our rights.

I do work hard educating non-traditional college students. I teach them how to read and write, and it's not easy. I'm fairly stringent with them. I get paid either way, so it would be much easier on them and me to just pass them along, but I won't stomach it. And it has cost me. Students aren't always grateful if they're not simply stamped and processed. Also, I have spoken out a lot in my classes, and it has affected my career. I've paid a price. I've also done my time on the anti-war protest lines locally and in Washington. I've also been a canvasser. And I'm a widely published poet depsite the political nature of my work--no easy task. I have done what I've felt like I could do.
I'm sure a lot of us are doing what we can. And I certainly appreciate what Hedges has done here (and the judge).
But that story about "getting" OBL is crap. I call 'em like I see 'em. And that, too, is a part of doing what I can.
I guess we have to take what we can get.

Wow, thanks for the props. I don't speak out in class anymore, partly because I wanted to keep working, and mostly because I teach entirely online now. Driving back and forth to distant classes and disparate times just sucked, and the confined format of online courses keeps me focused and out of trouble.
Besides, I should stick to the topic regardless of how much I think I might be helping open minds. But for a long time, I opened many minds. One young student even sent me an email with a picture of herself standing beside all of the FEMA coffins stacked in our lovely southern state. I also pissed off plenty of students, too, which is not a good thing, really. Bunch of little flag-waving fascists where I live, though.
I do think that teaching critical thinking is important and that I can apply it to the literature or readings our students have. Clearly, I no longer try ambitious endeavors like assigning Chomsky. The main reason the students hated that one was b/c they actually had to learn new words and terms. Sigh.
I do think, however, that awareness is our only way out of this ditch--or our only way to start crawling out. And I think that's directly related to the average college students' abilities to read carefully, understand the logical structure and rules of sentences, write decently, and think critically. And I think that, for a paltry salary of poverty and ridicule, basically, I provide a service to the nation. I hope I do, anyway. I try.
These days I focus mostly on grammar and mechanics and on making students clearly organize their thoughts. While such requirements may seem pedantic, they do help students progress. And I try to assign and discuss literature that is worthwhile.
The most exciting part of my job over the years has been being able to see students develop their skills within the time frame of my courses. Another exciting facet is that, even though I've been teaching exclusively online for the last four or five years, I still get recognized all over town by former students, people I haven't seen in years. Happened just this week, in fact. My wife says I'm a rock star. I wish.

When I wrote my two senators, Dianne Feinstein and Barbara Boxer, about this provision in the NDAA 2012 bill, I received the following rationalizations. Take them for whatever they're worth - they offer insight on how the political class thinks. Or at least how the political class wants citizens to perceive the thinking. My Republican representative, Scott Campbell, received my kudos for voting against.
From Feinstein:
Dear [x]:
Thank you for your continued interest in the detention authorities that are part of National Defense Authorization Act. I understand that this is an important issue to you, so I am writing to update you on the status of the legislation and my effort to help defend Americans' constitutional right to due process.
As you know, the defense bill contains a provision authorizing the U.S. government to detain suspected terrorists until the end of hostilities. Although the defense bill calls for periodic reviews of their detention, I strongly oppose this detention provision. In our democracy, due process is a fundamental right, and it protects us from being indefinitely detained by the government without charge.
For this reason, I offered an amendment to the defense bill to prohibit the indefinite detention of U.S. citizens without charge or trial. Unfortunately, on December 1, 2011, this amendment failed by a vote of 45 – 55.
However, I did sponsor a compromise amendment that passed the Senate by a vote of 99 – 1 stating that the defense bill should not be read as providing any new detention authorities of U.S. citizens. Although I would have preferred to have restricted the government's ability to detain U.S. citizens without charge, this compromise at least ensures that the defense bill does not expand the government's authority in this area. As you may know, this amendment was included as section 1021(e) of the final version of the legislation as approved by Congress.
Despite my longstanding opposition to the detention provisions, I voted in favor of the legislation. I did so because it ensures that our troops deployed around the world have the equipment, resources, and training they need to defend our nation.
Please know that I remain dedicated to helping ensure that our detention authorities are consistent with our Constitution and our values. Accordingly, I introduced the "Due Process Guarantee Act of 2011" (S. 2003) on December 15, 2011. This bill states that a Congressional authorization for the use of military force does not authorize the indefinite detention—without charge or trial—of U.S. citizens and lawful permanent residents who are apprehended domestically. The bill clarifies that such detention authority only exists in cases where the Congress specifically provides it, unlike the current situation where the general language of the Authorization for the Use of Military Force against al Qaeda is interpreted by some as providing detention authority. For your reference, I have attached a copy of the bill, and I ask for your support as it proceeds in the Senate Judiciary Committee and hopefully to the Senate Floor.
Again, I am pleased that you remain engaged in this important issue. Like you, I am a firm believer in our constitutional rights, and I will continue my efforts to protect them. Unfortunately, this amendment failed by a vote of 38-60.
I also voted for an amendment offered by Senator Feinstein that would have clarified that mandatory military detention would apply only to terrorist suspects captured outside the United States. This amendment also failed by a vote of 45-55.
I strongly oppose any expansion of military detention authority that erodes our civil liberties. That is why I am a co-sponsor of S.2003, the Due Process Guarantee Act. This important bipartisan legislation would protect American citizens arrested within the United States from being held indefinitely by the U.S. military.
Although I disagree with many of the provisions in the NDAA, I voted for it because it includes a number of measures for our troops and their families, including a pay raise requested by President Obama and important health care benefits.

Judge Forrest had better hope that her ruling is not overturned by a higher court because the ruling, in itself, could be deemed to be "substantial support" for Al Queda, et. al., making her subject to indefinite detention.

The Pentagon's response to this ruling "Good thing nobody cares when a tree falls in a forest! We'll just draft a new law the works around the ruling by claiming they are no longer citizens and instead, they're 'enemy combatants' and house them overseas where our laws don't apply!"
Oh, that particular law has already been drafted. Ever heard of the Enemy Expatriation Act? Fortunately it was referred to committee (where it will hopefully die, die, die), but I have no doubt the intention was to prop up or provide a work around in case the outcry over NDAA became too loud.

After the judge ordered the temporary injunction, the House passed an amdt that takes away your right to immediate Habeas Corpus, which requires a person under arrest to immediately be brought before a judge or into court.
Steven Vladeck blogged at Lawfare:
First, the 30-day provision in Rep Louie Gohmert’s amdt would arguably allow the government to preclude a detainee’s access to court (or counsel) for 30 days, whereas under current law, the detainee may file the moment he is ‘in custody under or by color of the authority of the United States.’ Second, it introduces uncertainty regarding whether individuals arrested within the United States but out of immigration status are entitled to pursue habeas relief (never mind the countless immigration cases where such relief has historically been available—and the compelling constitutional arguments supporting that jurisprudence).
