Was The NYPD Responsible For 10 Of The 11 People Shot Yesterday?

Update: Yes it was - Police: All Empire State shooting victims were wounded by officers

The official media-friendly narrative explaining yesterday's latest tragic shooting incident in midtown Manhattan in which a recently unemployed Jeffrey Johnson, 58, walked up to his former boss and shot him three times point blank before "calmly" walking away, is that Johnson also shot 9 other people, luckily none fatally, before being taken down by the NYPD. Sadly, as so often happens these days, the "media-friendly" narrative is wrong, and as CBS and Guardian report, Johnson did not fire during the quote unquote shootout, in which at least nine other perfectly innocent were hit, all of them by stray NYPD bullets.

From CBS: "Police said it is unlikely that Johnson fired during the shootout." Uhm, then isn't shootout a somewhat inaccurate word? "One witness told investigators that Johnson fired, but ballistics tests don’t back that up, authorities said... At least nine other people on the street were also shot, but Mayor Michael Bloomberg said it is unclear whether they were shot by the suspect or police. “Some may have been shot accidentally by police officers who responded immediately,” Bloomberg said." In other words of the (at least) 11 people shot yesterday, 2 of whom fatally, the NYPD was responsible for 10 of those shot, 9 of whom were literally "collateral damage" in a non-shoot out, and should be sacrificing various animals to their assorted guns that the NYPD, in missing their designated target, is at least quite atrocious in hitting any major organs. All of which of course begs the question: is a hit-to-miss (and potentially hit-to-casualty) ratio of less than 10% for New York's finest really acceptable and is this the kind of statistic that NY City wishes to boast in enticing new tourists?

Robert Asika was among those wounded, shot in the elbow from a distance of around eight feet by one of the two police officers who confronted Johnson. He accused police of "shooting randomly", and said he saw at least two others hit by police bullets.

 

"If you're gonna aim try and aim perfectly. If you wanna aim at the target, you got to know what you're doing because it's the street," Asika said. "I could have been dead right now. I could have been dead."

 

Asika was working on 5th Avenue on Friday morning, selling tickets for tour buses and the building's observation deck. He had only been in the job a week, after having been unemployed for over a year. "I was just standing there and I saw people running. I didn't want to run because I wanted to know why people were running so I turned around and I saw this guy," he said.

Police said Johnson been employed for six years as a designer of women's accessories at Hazan Imports. Kelly said during a press conference that he was laid off as part of a downsizing at the firm. Kelly described the gunman as a "disgruntled former employee" who came back to confront his former manager. "He shot and killed the former co-worker, striking him three times," Kelly said.

 

Johnson moved to draw his weapon, a .45 caliber handgun, as the officers approached, police said. There are conflicting reports as to what happened next. "The [police] tape clearly shows that the gunman had the gun out, and was trying to kill the officers," Bloomberg said. Other officials at the scene reportedly said the man had not fired on police.

 

The two police officers discharged 14 rounds, killing Johnson outside the entrance to the Empire State Building. Kelly at first said Johnson fired on officers, but police later said they were trying to determine whether Johnson fired. "These officers ... had absolutely no choice," Kelly said. "This individual took a gun out very close to them and perhaps fired at them."

He didn't. Instead he was mowed down in a cannonade of fire by the NYPD which has shot at least 9 other perfectly innocent bystanders, of whom miraculously none were killed.

Four women and five men were taken to city hospitals with gunshot wounds, but none was believed to be in a life-threatening condition. Police shut down nearby streets as forensic teams checked the gunman's body. The FBI were quick to confirm that the attack was not an act of terrorism.

 

Askia described the scene when officers caught up with Johnson. He said the gunman stopped six feet away from him, with two officers about eight feet in the other direction. "All of a sudden the guy stopped, and he was facing a cop who was following him," Asika said.

 

"He just reached in his suit and took out the gun, and I saw him pull it [towards] the cops. I'm like, is this guy for real? One of the cops was trying to shoot back at him and one of them shot me while the other one shot the guy."

 

"As soon as the bullet hit me, I felt like I didn't feel it. But then as soon as I tried to get up, I couldn't get up. I looked there and the blood was gushing out," Asika said.

 

"I was crawling, trying to get across the street, to the safe side of the street. I got across the street and I just fell at the bus stop and I was laying there and I couldn't get up no more. I was so tired, I was so scared. I've never been scared like that in my whole life."

Erica Solar, a mother of two who works as a receptionist on 37th Street, was hit in the back of the leg as she made her way to Dunkin' Donuts. Solar's friend, Christopher Collins, found her lying on the street as he got off a bus on his way to work.

 

"She was basically in shock. She didn't know if she had gotten stabbed or if she had gotten shot, but she just knew she was bleeding, and I was just there trying to keep her calm until paramedics arrived," Collins told the Guardian.

 

"It was chaotic. Everybody was running, cops were there immediately," Collins said. Solar was taken to Bellevue hospital, about a mile from the Empire State Building.

 

Another among the wounded was Media Rosario, from Brooklyn, who like Solar was hit in the back of the leg. She said that everything happened so fast, she saw people running, and when she turned around to see what happened, she was already shot," said her sister-in-law, Auselis Rosario.

Asika said Bloomberg visited him in hospital, but he received no apology from police.

That's explainable: the Mayor was likely distracted by his profound confusion how a deranged assassin with intent to kill was so blatantly unaware of New York City Administrative Code § 10-131 on the use of Firearms, which effectively makes any use or carrying of guns in the city of New York illegal.

Oh well, time to cut the maximum legal size of a New York soda drink by edict one more time.

I say; Thank you cops, you are a credit to your force and to the people that pay your salaries and are 2 very courageous individuals.

Yes the NYPD is responsible for sending all beat cops to additional training about how to minimize non perpetrator injury.

Back to hard slab revolvers that make you plan a shot.

The cops panicked, and started tapping the trigger on those semi-automatics without lining up the shot.

A double action revolver requires more trigger pull for each shot, and if you have 5 or 6 shots before relaod you are going to aim a little more carefully.

Methinks that the reason for the shooting was because the cops confronted the guy in public. And yes it is OK to second guess the cops and what they did and how they did. From my angle, they shot 9 people. Huge liability and lack of current and concurrent training is glaringly revealed. Mayor Bloomberg has shown us where his money is NOT being spent.

Knew this would be the reason for the other 9 innocents being shot.  NYPD basically the only ones that can carry a gun legallly in New York City shot 9 innocent people.  You can tell from the video cops are idoits confronting a known gunman who just shot someone(and most likely killed him from what they knew at the time) in a crowded street.  They should have just followed him from a distance, they would have known previous to chasing him who he was since there was an eyewitness to the initial shooting who ID'd him(co-worker lady with guy that got killed). 

But, instead these two idiots greatly escalated a dangerous situation by confronting him there with all those people and having a one-sided shootout.  Be interesting to see if the Johnson ever even got a shot off.

All the innocent bystanders injured here need to sue NYPD.

My brother in law is an old Vietnam combat vet.  Over the years he has mentioned several times the need for a cool head during firefights.  Most people get fairly spooked when bullets are whizzing and they are about to get shot.  Some guys would just run blindly to cover, getting shot in the back in the process.

It takes balls to be a Josie Wales, and all the donuts and steroids in the world won't replace them.  These cops freaked out and started blazing away, on a crowded public sidewalk. 

Officer safety was foremost in their minds, as always. I see none of them were hurt, thank goodness.  /sarc

Actually, if I were standing behind the perp, I would want them to use .45acp 230gr hydro-shok HP's or just soft points. Much less likely to penetrate with deadly energy left.

They seem to have been using 9mm. That is a higher velocity round, much better penetration. And at 8ft HP/SP/FMJ isnt gonna make much difference.

As far as the Police shooting in NYC goes, more than likely, the NYPD uses ammunition that is not of the Hollow Point type which Home Land Security ordered several million rounds and Social Security and Weather Service ordered hundreds of thousand of rounds.

 

If so, that may have reduced the number of kills, with wounds instead of death. It is important to understand the role of a handgun for police and citizens. The concept is that a hand gun is a defensive weapon and used to stop the bad guy before he can get to you or harm others. +P ammo used by Government agencies deliveries more energy when it hits and causes more of a stopping power. Hollow point will expand and maybe fragment causing more deaths. Or because of more extensive bone, tissue, and blood transport systems, cause loss of limbs and long term disability.

 


This incident makes it clear the hollow point ammunition should not be issued by any Government agency. I understand the trade off argument is valid. A 250 pound male in good condition fueled by drugs that make him danger squared, needs the most lethal ammunition. But, America should not use flame throwers, fragment grenades, mustard gas, or Hollow Point bullets upon its population.

 

I am not anti-police and think that many of the problems they face are induced by the Federal Government and a Lawyer system that is demonic. However, in this case, loss of job and pension or reduction of pension may need careful review.

 

It may be that compassion for both those shot and the shooters may be a hard row to hoe.

All things change and I can tell you that today's military, right down to the US Marines are very different.   They all know the various ME wars are for oil and geopoloitical positioning. They all know they'll be no jobs when they return home. They all know  they might be able to become a cop or a Homeland Security flunky  so their military training is simply an easy transition to those positions.

What they don't know is the Constitution and Bill of Rights.  These soldiers etc are brainwashed and like most ranks in most wars will follow the orders of their superiors regardless of their validity. Just try to disobey a blatantly illegal order. You'll immediately be treated as an enemy combatant ,get court martialed by "perfumed princes" and spend the next decade attempting to clear yourself.

It's easier,, when the CO says,"kill those hostiles" that you simply kill the hostiles ..now they may be hostiles or not, the point is you dare not buck the system and think .... thinking is not allowed.

When was the last time a Lt.Gen or above was ever called to account for the actions of his command?

The reality of this most unfortunate incident:

Shooter number 1, Mr. Johnson, carried a Spanish .45 that was capable of holding 7 rounds (reported as 8 yesterday)

The Star PD is a compact .45 ACP that has a magazine with a 6 shot capacity, + 1 chambered round = 7 rounds

Mr. Johnson reportedly shot the victim three times, but he discharged 5 rounds. The initial report from the eye witness walking next to Mr. Johnson's victim, who knew both of them, was that Mr. Johnson fired his first round into the man's chest. It is likely that he fired 4 more rounds as he lay on the ground, strking him 2 more times in the head / face.

Counting? That's 7 - 5 = 2 rounds left in his gun.

The police found one round left in the magazine, and ejected one round from the chamber.

How many shots did Mr. Johnson fire into the crowd? That answer would be zero, zilch, nada.

How many shots did Mr. Johnson fire at the police? That answer would be zero, zilch, nada.

The poorly trained cops, who are posted on anti-terrorism duty by the Empire State Building, fired, not 14 but 16 rounds at Mr. Johnson (in WSJ today)

They hit Mr. Johnson 7 times. That leaves 9 rounds zipping through the crowded streets of Midtown Manhattan at rush hour.

They were 6 to 8 feet away, two of them blazing off rounds. Mr. Johnson never returned fire, and they missed more than half the time, killing him in a "hail of gunfire" (NYPD description). The end result was that the police shot 9 bystanders. While 6 have been released, we have heard nothing of three that are still in the hospital.

Let's see how Mike Bloomberg spins this into "heroes" defending us from life, liberty and the pursuit of happiness, and describes how second amendment rights should be repealed, because the police keep us safe.  Nothing against the cops, but they clearly were not well trained, the terrorist hysteria and militarization of police forces is probably a good causal back drop, and the several descriptions using the phrase "collateral damage" are Orwellian at best. Such a phrase only makes sense if we are at war and this is a war zone, and the participants include enemy combatants.

One round, the fellow would have been down, two done for. One round from someone not in uniform would have been childs play. As someone said yesterday, good thing the cops do not carry full auto weapons.

Mr. Mayor, guns on the street are not safe and your police force has proven this without a shadow of a doubt. If you hear gunfire in New York, stay as far away from the cops as is humanly possible. If you carry to protect yourself and those around you, don't get caught, since you will almost certainly be unable to attain a carry permit in the city.

There needs to be a very clear recognition that cops today are not the cops of the 1950's.  Todays cops are specifically trained in counter terrorism ans since the passage of the NDAA all US Citizens in the eyes of the police are potential terrorists. They know they have UNLIMITED power to subdue you and what video doesn't show you is while the suspect is on the ground with a knee in his back just how much resistence is he puting up compared to the cops continued increaseing pressure while crying ( for the cameras sake) "quite resisting"

The shooter killed his ex-boss who fired him. Could it be that he was fired because the economy has been destroyed by those inhabiting offices a few blocks further downtown in Manhattan? Maybe he was simply a bad or incompetent employee. But IMO more likely is that he was a victim of people like Jamie and Lloyd and Jon and Timmy and Ben. My guess -  this guy chose the wrong part of town, and the wrong target.

Oh, and all those stray shots by the cops - they would have had a much better chance of hitting someone worth hitting in a Wall Street crowd. Who knows, maybe even a limo or two would have gotten in the way. Just sayin ... if you're going to provoke the cops into spray & pray, choose the right venue.

a few years ago in atlanta, a judged conspired with a police thug to grant a search warrant on a 92 year old black woman who was "suspected" of dealing drugs. the police saw that she had a rusted out useless revolver so they slammed down the door and pumped her full of 22 bullets, as you do when you are over powered by decrepit feeble 92 year old grandmother.

If one of those wounded had been a major Wall Street magnate, Bloomberg would be Paraguay by now.  As it is, sounds like he's trying to downplay the glaring fact that NYPD are not taught to protect the "little people." Seems that the NYPD really is Wall Street's army; not public servants.

This however, does not change the fact that they appear to have created a completely unnecessary confrontation in the middle of a busy street. WTF did they expect to happen?

NYC Cops should been trained to kill with one single bullett. My understanding is that they are trained to shoot low when there are civilians in the line of fire...OK, fine...but they still fucked up....

Did they even have to fire a single round?

They made the mistake of confronting the guy with police officers in uniform.    The should have swarmed him from behind and tackled him to the ground...or they could have easily followed him around using the Google cameras...they could have taken him into custody and let that maggot rot in prison...

 The fact that multiple cops had to fire 16 rounds to kill 1 criminal and wound 9 is maddening and sad....

I read an official report that stated the NYPD has over 600 "misses" per year on average. Never call 911 unless you want your friends, family, or yourself to be approached by trigger happy cops. This incident should be the "shots heard round the world" when it comes to citizens relying on cops for what citizens should be doing for themselves.

A few years ago some young punks stole my wifes car in the middle of the night. The car was pulled over shortly... after running a stop sign. The thiefs "almost ran over  an officer" as they made a break for it in our car ( after pulling over). Minutes later the police were at our residence after tracing the vehicle, the cops were all pumped up because "one of theirs" was almost hit by our car. They treated me and my wife like criminals for allowing our car to be stolen while we slept, it was as if we were the criminals. We were interrogated in our home ( half asleep ) .... No apology necessary when an officer is almost hurt.

There are plenty of false narratives these days, but that is no excuse for intellectual sloth, for substituting a false meta-narrative that the credulous immediately adopt as truth. The fact that the cops shot people was reported in the media the same day of the shooting--it was on drudge for pete's sake. Now police ballistics have proved it, the police admitted it.

Where exactly did this supposed 'media friendly' narrative come from? Is this whole 'paranoid friendly narrative' in the article based solely on "Kelly first said..."? There is no cover-up. As the cops say, "Move along folks, there is nothing to see here..."

PS. I recall an incident where a driver was driving toward a cop during a traffic stop. The cop emptied his entire glock magazine at the windshield and never hit the driver. So, lots of shots and misses is not to be unexpected.

Also, I am reading many british media outlets these days. They do a better job of covering america than american media outlets do. And as socialistic as they are, they are a bit sour on obama these days.
