The First Amendment Is Under Serious Assault In Order To Stifle Anti-Israel Boycotts

Assaults on freedom speech can be found in many aspects of American life these days, but one specific area that isn’t getting the attention it deserves relates to boycotts against Israel.

Increasingly, we’re seeing various regional governments requiring citizens to agree to what essentially amounts to a loyalty pledge to a foreign government in order to participate in or receive government services.

I’m going to highlight two troubling examples of this, both covered by Israeli paper Haaretz. The first relates to Kansas.

The First Amendment squarely protects the right to boycott. Lately, though, a legislative assault on that right has been spreading through the United States –  designed to stamp out constitutionally protected boycotts of Israel…


Over the past several years, state and federal legislatures have considered dozens of bills, and in some cases passed laws, in direct violation of this important ruling. These bills and laws vary in numerous respects, but they share a common goal of scaring people away people from participating in boycotts meant to protest Israeli government policies, including what are known as Boycott, Divestment, and Sanctions (BDS) campaigns.


Today, the ACLU filed a lawsuit challenging one of those laws — a Kansas statute requiring state contractors to sign a statement certifying that they do not boycott Israel, including boycotts of companies profiting off settlements in the occupied Palestinian territories.


We are representing a veteran math teacher and trainer from Kansas who was told she would need to sign the certification statement in order to participate in a state program training other math teachers. Our client is a member of the Mennonite Church USA. In response to calls for boycott by the church and members of her congregation, she has decided not to buy consumer goods and services offered by Israeli companies and international companies operating in Israeli settlements in the occupied Palestinian territories. Our client is boycotting to protest the Israeli government’s treatment of Palestinians and to pressure the government to change its policies.


Earlier this year, our client was selected to participate as a contractor in a statewide training program run by the Kansas Department of Education. She was excited to use her skills to help train math teachers throughout the state, but when she was presented with a form requiring her to certify that she “is not currently engaged in a boycott of Israel,” she told the state that she could not sign the form in good conscience. As a result, the state refuses to let her participate in the program.


Kansas’s law, and others like it, violates the Constitution. The First Amendment prohibits the government from suppressing one side of a public debate. That means it cannot impose ideological litmus tests or loyalty oaths as a condition on hiring or contracting.

If this was the only example of such behavior, I suppose we could dismiss it as a one-off, misguided directive. Unfortunately, this sort of thing is far more common than any of us would like to admit.

Here’s another recent example, from the article, Houston Suburb Won’t Give Hurricane Relief to Anyone Who Boycotts Israel:

A Houston suburb will not approve grants to repair homes or businesses damaged in Hurricane Harvey if the applicant supports boycotting Israel.


The city of Dickinson’s application form for storm damage repair funding includes a clause stating that “By executing this Agreement below, the Applicant verifies that the Applicant: (1) does not boycott Israel; and (2) will not boycott Israel during the term of this Agreement.”

No other clauses about political affiliations or beliefs are included in the form.


The state of Texas passed a law in May banning state entities from contracting with businesses that boycott Israel. The law, one of 21 passed in states around the country in the past few years, has been criticized by the American Civil Liberties Union as unconstitutional.

This is totally insane. I don’t care what you think about Israel, the above is completely unacceptable in a free society and we should all be making a stink about it. Please share with friends and family.

The law over not helping people who boycott Israel does appear to violate my concept of freedom for sure, and I don't like stopping people from boycotting either as A peaceful form of protest. But I have additional questions that I noticed you didn't ask, would it be acceptable for the american government to boycott iran or north korea? Would most americans support the boycott of nazi's, or would that have different rules associated with it. Also I think you would have more legitimacy if you included some big picture considerations, like Israel is A small nation of A small people the Jews, if A sizable percentage of americans boycotted products from Israel, I imagine that most of the companies that sold them may stop doing so in favor of companies from nations who are not boycotted, unless they were medical supplies. If most nations at the united nations voted to force white gentiles to pay reparations for their inhumane ways, which they claimed no matter how much evidence existed against the claim, would not white people break with the majority consent and attempt to support other white gentile nations? Just like white gentiles, Jews cannot control how much money they are able to make, or how unequal we are. We can boycott nations, watch as their economies collapse and buy up their companies for pennies on the dollar, but that’s cruel and would only increase anger towards Jews, which would only lead to pointless fighting, because there is no way for nations in the world to live as separatists, in A world with nuclear weapons and plenty of brown people who are to dishonest for the truth about white gentile inequality, or Jewish inequality, and too bitter and willing to behave immorally in order to force their right to make white gentiles not influence their nations, and to force them to give them back the money that they stole from brown people that made them be unequal in the first place. That is exactly what many white gentiles also believe about the Jews. Money is influence, it already bought the right to influence the media, the immigration policy and the rest. I guess where I am ending up is that freedom doesn’t appear to work to avoid setting A precedent that will harm your country in the long run, and the majority or even the righteous and rational minority simply has to stand up for what’s right. I remind you that gun control as you want it will not survive majority rule in America, neither will white free speech, even if you call it white free speech, and point out that’s obviously discriminatory. Just like Jews cant call the shots because they don’t make up A majority, or have free speech without getting robbed in America, or Israel if A majority of gentiles is able to rob Jews in Israel. They will do the same to white gentiles for sure. They did it to south Africa, and now thousands of south africans have been murdered and assaulted because of it, and billions of dollars of productivity have been destroyed for decades. Can you put up A sign that you boycott black nations due to their violent behaviors towards non blacks? Or boycott muslim support of the conquest of Israel and the violation of equal rights for Jews as dhimi (second class citizens)? Racism against Jews is massive, unresolved, and is good for America to stand up to. I don’t think you can pretend that America will allow you to boycott arab muslims or africans, so only saying freedom in relation to Jews is discrimination and more evil because they aren’t violent, and earned their money despite tremendous racism. what you may consider dulling, is ((their)) idea of sharpening - and its all been promised to ((them)) by their (("god")) with whom they have a covenant - and dont expect a usurped story from a couple millenia ago to have much worth when you wind up praying to your enemy, who you think is your ((friend.))(the colloquial you, of course, I am not assuming you JS are a christian or muslim.  but there's enough of them out there whose ancestors were converted by the sword) the depth of lies is deeper than people imagine its going to be quite a task to kill off yhvh, but I'm up for the challenge.  if only I could find a box of Roddy's special glasses for yall....(but I wont treat you all like louis gosset jr and beat you up just to wear them)

The government forces us to buy shit from people we don't want to buy from all the time. Not only are they not forcing you to buy anything from Israel, all they require is a claim that you don't refuse to do so out of spite. Sounds like an expansion of our rights to me. First time the government has ever asked nicely for you to spend money on something only if you want it.

Wow, no comments yet.  I am down with this.  Totally unacceptable.There was another story about a bill proposed in Congress recently which would impose both civil and criminal penalties against citizens supporting an Israeli boycott.  The sponsors of the bill were not aware of the penalties proposed, up to $1MM in fines and some jail time on the criminal side.  NOT AWARE OF THE PENALTIES.I doubt they had even read the bill.  Just following orders.

We all know that Marx was a Jew and created a revolutionary doctrine that led to at least a hundred million people killed.  It would be one thing if they turned against it but no, they like the results and they back it and infiltrate with it to this day.We can all see that this system is here now and the wheels are turning.  I just listened to some historians discussing the real fatality numbers of the Jewish Bolshevik Revolution and they will never fully know.  Zero credible historians deny the primary role of Jewish people, or that it was entirely their movement.  It was way over twenty million though.  It was probably at least 25 million and it couldn't have been lower than 22.  One way to look at it is that they slaughtered about a million human beings a year, plus.  It's a damn industrial slaughter machine. If people think this exact same system with the same bankers behind it all wont do that to us they are serious mental handicaps.  I would somewhat understand it if it was just a system of conquering but there is real hatred and malice behind it that defies explanation.  Could they be holding a grudge against us from the ancient past of something?  What the hell did any of us ever do but give them sanctuary, a place to prosper, and dying to protect their illegal stolen state?  What did Russia ever do to them? You know damn well that they will slaughter us like pigs anyway, just like a Palestinian.  They are the creators of Communism.  Their cultural Marxist groups are working on us from every angle as we speak.  They have even shot our police officers.  Soros is bringing waves of government paid terrorists in to the entire west.  Those western backed terrorists raped, tortured and pillaged tiny children in Syria.  Israel is pleased with it.  Those people didn't do shit to anybody either.  There are a half million dead in Iraq, Russia is scared, the Ukraine went down, 500 people just got murdered by an op in Vegas to disarm us...  If people think they wont gut us like fish they are shitting themselves and they need to take a gander at where Marxism always leads.  The free shit equality utopia ends up with starving people nailed to barns with their guts on the floor.  They are here and they is no doubt.  If people aren't afraid it's because they are stupid.
