Arizona Cop Acquitted For Killing Crawling Man Who Was Begging For His Life: Graphic Video

Arizona jurors watched the video below, which shows former Mesa, Arizona, police officer Philip Mitchell Brailsford shooting and killing a man who was begging for his life and attempting to follow the officer's orders to crawl down a hotel hallway.

Yesterday, the jurors found Brailsford not guilty of second-degree murder and reckless manslaughter. Do you agree? (Warning: The video is pretty graphic.)

The incident occurred in January 2016. Daniel Shaver apparently was showing off a pellet gun, and it was visible through the hotel room window. This promped somebody to call to the hotel front desk, which prompted a call to the police.

So it wasn't unreasonable for police to approach the hotel room thinking the encounter might be dangerous. They knew there was a gun there, and they didn't know it was a pellet gun. But that video shows some truly baffling decisions by Brailsford that escalated the situation to make it even scarier, not the least of which was that Brailsford's bluster and open threats of violence made him appear as terrified as Shaver.

The contents of the body camera footage had been described to the public before, when Brailsford was first charged, but the video itself was withheld until this morning. NBC notes:

The detective investigating the shooting had agreed Shaver's movement was similar to reaching for a pistol, but has said it also looked as though Shaver was pulling up his loose-fitting basketball shorts that had fallen down as he was ordered to crawl.

 

The investigator noted he did not see anything that would have prevented officers from simply handcuffing Shaver as he was on the floor.

Forcing Shaver to crawl toward the police like this increased the likelihood that Shaver would lose balance and make wild movements, and Brailsford's bizarre orders were probably confusing even to a sober person.

Oh, and here's an interesting detail from the Arizona Republic:

The judge did not allow jurors to hear about an etching on the dust cover of the rifle Brailsford used to shoot Shaver, which said "You're f--ked," because he felt it was prejudicial.

Shaver's parents have filed a wrongful death lawsuit against the city of Mesa. Brailsford was fired for poor performance two months after the shooting. Would anybody care to bet that he tries either to get his job back in Mesa or to get a job with another law enforcement agency elsewhere?

Cops used to have no problem going "hand to hand" with knives, guns or 3 on one for bigger guys.

Now they start off with guns and a shaky, sweaty trigger finger.

No Miranda, no charges...this poor scared citizen, no matter what fucking color, was just a kid...prone on the floor...while 3 fucking over-200Lb cops couldn't go put cuffs on him???? He fully "cooperated" with the bizarre commands and completely illegal "just obey" psychopath egoism.

As a father, and someone who saw cops in action in the 60's and 70's, this is nowhere near the world I grew up in and it frightens me that my children may have to be confronted by psychopaths like this.

What kind of fucking Nazi state is being allowed (and encouraged by the jury) to unfold in this country???

My family fought the fucking Nazis with pride.

Why do so many in America not see this as fascism?

I don't know Tarzan, I saw a man pick a three years old up by his hair and shake him because he looked at me, this happened at the Wallmart, he told him you don't look at anyone but me, you watch me. So there is a lot of sickness in society, although this fellow seems to be a self confessed looney.

I didn't do anything Cynicles, I am ashamed that I didn't have enough courage to do 'something' I know I lost some claim to humanity by my actions, Since that happened I've wondered if it was his child, it didn't look like him, perhaps a Welfare Child, perhaps he was conditioning it for slavery, who knows? And how many have seen similar things and done nothing and what can you do?

WTF man, the cop was on an ego trip, so consumed with his "authority" and asserting his "control" of the situation he disregarded life.The first time the "suspect" (suspect in what is left to the imagination, owning a pellet gun?) showed confusion was the time to de-escalate...AFTER...forcefully (verbally) getting the guy to comply (which he did) any rational-sane cop recognizes this is an act of submission on the "suspects" part. This is murder.

Yeah the guy is on the floor, no threat or very little threat, he never produced a weapon (pellet gun or otherwise) and he's staring at a hall full of cops (or at least two that I can see, known to be there from his body cam) with AR's and pistols pointed at him.He's clearly not suicidal (he said "Don't shoot me!"). And he's not homicidal either as he hasn't shot anyone or robbed anyone or threatened anyone.Some (not all for emphasis) of these cops are clearly deranged and with this guy running around with the inscription of "You're fucked" inscribed on his personal weapon that the department allows him to use...points (to me) to something deeper inside this department. One of his co-workers had to have seen the inscription and I would think any normal cop (or human being for that matter) would have said "Hey man. Thats not cool to have on the job."  I don't have problem with him carrying or using a personal weapon he's familiar with but with that inscription on it, it launches off into egotism and boastfulness on a professional level. Its not being used in the military. Its not sitting in the corner of his bedroom waiting to be used on a home invader as in..."You're fucked"...and I'm telling everyone I don't have a problem with that gun at his house and he can write "Nigger Killer" or "Madonna Suck On This!" on it for all I care.But not on the job, it stays at home for his own personal use.

The jury had to not only ignore the video but everything you just pointed out. I have to speculate that the either the jury was stacked with ringers or "court" ruled everything inadmissable...very similar to what's been going on with the Bundy trial fiasco in Las Vegas. The judge backed off on that one pehaps fearing jury nullification because they were having none of it.LTER opines a few pages away, and I agree with him, that BLM is a construct of TPTB that manages to inject race into this to dilute anger towards bad cops. It is very effective. I can't remember names or specifics but not long ago a white cop shot/killed a black guy (hardly a saint) after a car chase. Right before he shot him he shouted into his dash cam he was going to. The cop of course said he was reaching for a gun. It was revealed in the trial the cop found a gun in a bag in the back seat of the car with zero dna from the dead guy, but only dna from the cop. The guy was also aquitted and the msm showed a bunch of blacks shut down a mall (as though there weren't others not engaged in shutting down malls but just pissed right off). I pointed this out and got junked into oblivion.

I agree the whole thing is over the top. Still, the video represents only part of the story. Were’re not getting everything the jury got.

What was the first mistake the “kid” made? Did the police try to contact him before the couple came around the corner? If not, why not? The couple seemed surprised, but also maybe boisterous. If they were ignoring other people’s concerns because it was only a pellet gun, then that is cause for the policeman to behave in an escalated manner.

Was he playing with the gun in the window? Is that why someone called the police? Not a crime, but possibly someone looking for trouble.

Given that there were at least two policemen there, why not just handcuff him where he was? Because of the geography? They don’t know if someone else is coming around the corner.

We have to have the whole story before assuming the jury was totally wrong.

This was a deliberate attempt by the cop to escalate the situation to such a point that the suspect was so stressed that it was impossible for him to comply. This is clear by the orders the cop is giving with the repeated threats that the suspect would be shot if he did not comply 100%. The only rational reason to do that is because the cop WANTED to shoot so he set up the suspect for failure to justify the shooting. The video clearly shows the cops intent to shoot the suspect is clear. This is one sick mother fucker. This should have resulted in at least a manslaugher conviction.The shooting was completely unnecessary. Once the female suspect was cuffed, any threat to the officers was at least cut in half. There was absolutely no need to have the male suspect crawl to the officers after the female was in custody and not a threat. One of the 2 officers could have easily approached the suspect while he was spread eagle on the floor and cuffed him, then searched him for any weapons while the 2nd officer covered them.

That happened to me years ago. We had just rented a new office and i didn't enter the alarm code in time. They never gave me the "password"  for the alarm company. I had gone in at night to set up the computers.The cop wasn't as militant as this one but he definitely had a gun pointed at me. I made sure to follow every word properly, slowly and very deliberately.Long story short, i made sure to get the password and still remember it to this day.

I don't know what proper procedure is in such cases.Without saying he deserved to be shot, it just seems like the kid was a bit lax about the whole thing.There must be a better way to handle these situations.Is it even possible to move forward on your knees with your ankles crossed?

Yeah, could be. The only thing is the cop made allowances for that in his instructions. If he shot him anyway, he probably would've been convicted. There's also the girl. She listened and is ok.Seems like the best thing would've been to have that kid lie flat, arms and legs spread out while the other cop cuffed him.I don't know..... I'm definitely not liking the loud ass cop but the kid was just acting stupid. He had no reason to reach behind his back like that. His hands should've been visible at all times.I realize it may not be a popular position to take but if I  were a cop on a gun call I'd want their hands visible at all times. I think everyone else in that position would as well.

What was his crime? What was his charge? Was he under arrest? Where were his Miranda rights? Does Miranda include "doing" and not just "saying"?

Yes, it fucking does. He did not have to "incriminate" himself by knee-crawling without any charges or announcement of arrest.

This was simply a sick, fucked up execution with murderous intent.

Dude, chill.  We're talking about how things actually work in real life.The time to sort legal issues out is not under such circumstances. Correct or not, you just comply 100% and get him fired afterwards.I've been pulled over on BS traffic stops in the middle of the day and I make sure my hands are visible at all times. I never reach into the glove compartment or for my wallet without telling them first. And when I do, it is done slowly and carefully.I don't talk to the police even in a social setting. If they tell me they're a cop, I politely create an excuse and move on. You make it sound as if I like this overly militarized attitude. I hate it.You're looking for Andy Taylor and he's been gone a long time.

'A bit lax'???  The kid was practically blubbering.  Hardly a hardened criminal with bad intent on his mind.  Surprised he didn't piss his pants. The cop on the other hand definitely had a bad intent.  He was looking for any reason to shoot and he found one.Ironically he was fired 2 months after this event for poor performance.  I really hope some other police agency doesn't hire this psycho.

He was scared shitless and there is a 99.999999% chance he was no threat at all. That isn't the point.As you wrote above, that cop was looking for an excuse to shoot. So, why give him one?  That kid gave him at least 2.Good cop, bad cop, shit cop.... it does not matter at that moment. You do EXACTLY what you are told, live through the ordeal and then sue the fuck out of them, start investigations, force them to retake training classes..... whatever.

The victim had been drinking and was in no fit state for the kind of nonsense he was being subjected to.Imagine - one moment you're having a civilised drink with friends, the next moment you've fallen into the hands of a sadist with a machine gun playing Call of Duty in his head.The officer was in a highly excited state and was itching for an excuse to shoot him. These militarised cops, in combat gear, are not seasoned men-of-the-world gifted with integrity - they are infantile fantasists. Check out the consistently expressionless, child-like face of Philip Mitchell Brailsford - it is utterly devoid of feeling, self-consciousness, self-doubt, or the kind of basic awareness that makes us human.

The cop was playing my authority... and just looking for an excuse to shoot someone and wet his personal M4.Anyone who has watched this video, this cop treating the kid like a dog, and thinks it "look likes" the kid is reaching for a gun, is just an absolute retard. This cop was setting up the kid for failure.
